Art as an Escape from Torture
“I think about how to get out of this prison. Despite being in prison, I try as much as I can to get my soul out of prison. I live a different life when I am making art.” Moath Al-Alwi, a detainee at the Guantánamo Bay naval detention center in Cuba, expresses the importance of art as a means of escape from his current conditions of imprisonment in a letter to his lawyer. Now approximately 40 years old, having spent half of his life at Guantánamo without ever being charged with a crime, Moath turns to his imagination for release. In an effort to combat terrorism and house suspected terrorists following the attacks of September 11, 2001, the United States opened the detention facilities in Guantánamo (GTMO) in 2002. Research and legal cases on behalf of detainees have emphasized the injustice of indefinite detention and the extreme violations of human rights that take place in GTMO. The detainees are not protected by the Geneva Convention or recognized as prisoners of war. While torture is considered to be a heinous crime against humanity, the US argues that their torturous practices are not actually torture through the use of euphemisms. Detainees are essentially only entitled to Habeas Corpus rights, which allows them to question why they are being held. To escape their circumstances, many channel their emotions into art. GTMO implemented an art program in 2010 that allowed detainees to participate in classes on a biweekly basis. While in class, detainees remain shackled to the floor and have only basic supplies, and their art is subject to destruction at any time. In this project, I analyze how detainees use the artistic process in extremely difficult circumstances to create alternatives for themselves that do not exist in their legal and physical contexts. Building off the work of research on the restrictions that the U.S. imposes on artwork in Guantánamo, I investigate the extent to which detainees can truly escape torture through art because they lack freedom of expression within GTMO.https://orb.binghamton.edu/research_days_posters_2021/1044/thumbnail.jp
Patent Amendments and Prosecution History Estoppel Under Festo
On November 29, 2000, the Federal Circuit retroactively reduced the value of nearly 1.2 million unexpired United States patents by announcing a new rule for the somewhat obscure doctrine of prosecution history estoppel. Designed to foster clarity in patent applications, this new pronouncement in Festo Corp v. Shoketsu Kinzoku Kogyo Kabushiki Co. allows for easy copying of some patented inventions and reduces patent owner\u27s ability to prove infringement. What influences the worldwide genetic structure of sperm whales (Physeter macrocephalus)?
The interplay of natural selection and genetic drift, influenced by geographic isolation, mating systems and population size, determines patterns of genetic diversity within species. The sperm whale provides an interesting example of a long-lived species with few geographic barriers to dispersal. Worldwide mtDNA diversity is relatively low, but highly structured among geographic regions and social groups, attributed to female philopatry. However, it is unclear whether this female philopatry is due to geographic regions or social groups, or how this might vary on a worldwide scale. To answer these questions, we combined mtDNA information for 1091 previously published samples with 542 newly obtained DNA profiles (394-bp mtDNA, sex, 13 microsatellites) including the previously unsampled Indian Ocean, and social group information for 541 individuals. We found low mtDNA diversity (Ď€ = 0.430%) reflecting an expansion event <80 000 years bp, but strong differentiation by ocean, among regions within some oceans, and among social groups. In comparison, microsatellite differentiation was low at all levels, presumably due to male-mediated gene flow. A hierarchical amova showed that regions were important for explaining mtDNA variance in the Indian Ocean, but not Pacific, with social group sampling in the Atlantic too limited to include in analyses. Social groups were important in partitioning mtDNA and microsatellite variance within both oceans. Therefore, both geographic philopatry and social philopatry influence genetic structure in the sperm whale, but their relative importance differs by sex and ocean, reflecting breeding behaviour, geographic features and perhaps a more recent origin of sperm whales in the Pacific. By investigating the interplay of evolutionary forces operating at different temporal and geographic scales, we show that sperm whales are perhaps a unique example of a worldwide population expansion followed by rapid assortment due to female social organization.Genetic samples from the 'Voyage of the Odyssey' were collected under permit #0751-1614 from the US National Marine Fisheries Service

Collateral damage to marine and terrestrial ecosystems from Yankee whaling in the 19th century
Yankee whalers of the 19th century had major impacts on populations of large whales, but these leviathans were not the only taxa targeted. Here, we describe the “collateral damage,” the opportunistic or targeted taking of nongreat whale species by the American whaling industry. Using data from 5,064 records from 79 whaling logs occurring between 1840 and 1901, we show that Yankee whalers captured 5,255 animals across three large ocean basins from 32 different taxonomic categories, including a wide range of marine and terrestrial species. The taxa with the greatest number of individuals captured were walruses (Odobenus rosmarus), ducks (family Anatidae), and cod (Gadus sp.). By biomass, the most captured species were walruses, grampus (a poorly defined group within Odontoceti), and seals (family Otariidae). The whalers captured over 2.4 million kg of nongreat whale meat equaling approximately 34 kg of meat per ship per day at sea. The species and areas targeted shifted over time in response to overexploitation of whale populations, with likely intensive local impacts on terrestrial species associated with multiyear whaling camps. Pacific Ocean–wide profile of CYP1A1 expression, stable carbon and nitrogen isotope ratios, and organic contaminant burden in sperm whale skin biopsies

The International Oceanographic Commission recommends ocean health monitoring programs to investigate the presence of marine contaminants and the health of threatened species and the use of multiple and early-warning biomarker approaches.
Objective: We explored the hypothesis that biomarker and contaminant analyses in skin biopsies of the threatened sperm whale (Physeter macrocephalus) could reveal geographical trends in exposure on an oceanwide scale.
Methods: We analyzed cytochrome P450 1A1 (CYP1A1) expression (by immunohistochemistry), stable nitrogen and carbon isotope ratios (as general indicators of trophic position and latitude, respectively), and contaminant burdens in skin biopsies to explore regional trends in the Pacific Ocean.
Results: Biomarker analyses revealed significant regional differences within the Pacific Ocean. CYP1A1 expression was highest in whales from the Galapagos, a United Nations Educational, Scientific, and Cultural Organization World Heritage marine reserve, and was lowest in the sampling sites farthest away from continents. We examined the possible influence of the whales’ sex, diet, or range and other parameters on regional variation in CYP1A1 expression, but data were inconclusive. In general, CYP1A1 expression was not significantly correlated with contaminant burdens in blubber. However, small sample sizes precluded detailed chemical analyses, and power to detect significant associations was limited.
Conclusions: Our large-scale monitoring study was successful at identifying regional differences in CYP1A1 expression, providing a baseline for this known biomarker of exposure to aryl hydrocarbon receptor agonists. However, we could not identify factors that explained this variation. Future oceanwide CYP1A1 expression profiles in cetacean skin biopsies are warranted and could reveal whether globally distributed chemicals occur at biochemically relevant concentrations on a global basis, which may provide a measure of ocean integrity.Funding was provided by National Institute of Environmental Health Sciences grant P42-ES-0469, Superfund Basic Research Program grant P42ES007381, NOAA Sea Grant NA86RG0075 R/B-162, and the Ocean Alliance
Sex bias in biopsy samples collected from free-ranging dolphins

population structure and ecology. In small cetaceans, the gender of individuals usually cannot
be determined at sea, and population sex ratio has to be inferred indirectly. We used
molecular sexing to determine the gender of 340 biopsy samples of bottlenose dolphins,
Tursiops truncatus, spotted dolphins, Stenella frontalis, and common dolphins, Delphinus
delphis, collected around the Azores and Madeira. Sex ratio was globally skewed in favor of
males, and differed between species and archipelagos. Skew was probably influenced by the
selectivity of biopsy collectors and seasonal or year-round predominance of males in natural
populations. Skew was also influenced by sampling duration and intensity. In the Azores,
when several samples were successively collected within the same group, the proportion of
female samples decreased as a function of sample order. This trend indicated a tendency for
females to increasingly avoid the boat while samples were being collected. It showed that
males and females reacted differently to the perturbation caused by the biopsy sampling
