    A Comparative Analysis of the Immediate Post-Operative Complications Occurring After Subtotal Gastrectomy in Patients With Gastric Carcinoma

    DergiPark: 379014tmsjAims: The aims of this study were to scrutinize the immediate post-operative complications encountered after different subtotal gastrectomy procedures and to identify the safest surgical variant.Methods: In this retrospective, observational study data of 54 patients, of whom 32 were male and 22 were female,with a mean age of 65.7 years diagnosed with gastric carcinoma underwent a variant of subtotal gastrectomy in the Surgery Department of the Bucharest Clinical Emergency Hospital between January 2010 and December 2012 were recorded. The categorical statistical data was obtained with Chi-square method using GraphPad Prism and statistical significance was set at a p-value lt;0.05.Results: A total of 73 immediate post-operative complications were encountered in 23 (41.8%) patients classifiedinto local in 14 (19.2%) patients and general in 59 (80.8%) patients. The most common complication classified as local was leakage found in 5 (6.9%) patients, while the most frequent ones in general complications were secondary anemia presented in 17 (23.3%) patients and pulmonary compromise: pleural effusion in 3 (4.1%) patients. Ten associated surgical procedures were necessary, the most common being omentectomy (30%). Re-operation was deemed imperative in 5 (9.1%) cases , 4 (80%) of which were after Billroth I and 1 (20%) case was subsequent to Roux-en-Y Side-End Esophagojejunostomy. Three (5.6%) deaths were reported, 2 (66.7%) of which occurred after Roux-en-Y Side-End Esophagojejunostomy and 1 (33.3%) after the Billroth I variant.Conclusion: Billroth I yielded the highest number of complications, both local and general, compared to Hofmeister-Finsterer which generated the lowest number. The same pattern was noted with respect to the length of hospital stay. The longest operative time was recorded in Hofmeister-Finsterer and the shortest in Billroth I.     Att vittna Ă€r, med vissa fĂ„ undantag, en samhĂ€llelig skyldighet. Samtidigt hĂ€nder det att vittnen utsĂ€tts för hot och repressalier pĂ„ grund av sina förestĂ„ende vittnesmĂ„l. Detta har lett till att möjligheten att vittna anonymt uppmĂ€rksammats. Anonyma vittnesmĂ„l Ă€r idag inte tillĂ„tna i den svenska brottmĂ„lsprocessen. BĂ„de lagregler och processrĂ€ttsliga principer sĂ€tter stopp för ett sĂ„dant förfarande. Sedan mitten av nittiotalet har Europakonventionen haft ett stort inflytande över svensk rĂ€tt. Europadomstolen tillĂ„ter genom sin tolkning av artikel 6 EKMR att anonyma vittnen, i exceptionella fall, anvĂ€nds som bevismedel vid huvudförhandlingar. Statens offentliga utredningar har, trots Europadomstolens godkĂ€nnande, bibehĂ„llit en negativ instĂ€llning gĂ€llande ett införande av ett system med anonyma vittnen i svensk rĂ€tt. Anonyma vittnen anses vara ett hot mot rĂ€ttssĂ€kerheten i det svenska rĂ€ttssystemet. Genom en rĂ€ttsdogmatisk metod undersöker uppsatsen vilka processrĂ€ttsliga principer, rĂ€ttsregler och rĂ€ttssĂ€kerhetsintressen som förhindrar införandet av ett processuellt förfarande som tillĂ„ter anonyma vittnesmĂ„l i Sverige. Detta huvudsakligen genom studier av doktrin, statliga utredningar och praxis frĂ„n svenska domstolar. Uppsatsen behandlar Ă€ven för Europadomstolspraxis för att redogöra för hur domstolen funnit att anonyma vittnesmĂ„l i exceptionella fall inte strider mot EKMR. Undersökningar av Statens offentliga utredningar har lett fram till slutsatsen att det frĂ€mst Ă€r principen om partsinsyn tillsammans med den ringa omfattningen av hot mot vittnen som föranlett den svenska statens negativa instĂ€llning till införandet av ett processuellt system som tillĂ„ter anonyma vittnen. Principen om partsinsyn anses vara av sĂ„dan grundlĂ€ggande betydelse att en inskrĂ€nkning av principen anses Ă€ventyra rĂ€ttssĂ€kerheten i den svenska brottmĂ„lsprocessen. Samtidigt medger staten att tungt vĂ€gande intressen kan leda till en inskrĂ€nkning av principen och att Ă€ven vittnens rĂ€tt till sĂ€kerhet Ă€r ett rĂ€ttssĂ€kerhetsintresse som staten mĂ„ste ta hĂ€nsyn till. I Statens offentliga utredningar har det framhĂ„llits att frĂ„gan anonyma vittnen inte Ă€r fĂ€rdigutredd. Uppsatsen presenterar Ă€ven riksdagsmotioner som pekar pĂ„ att hot mot vittnen har ökat vilket kan betyda pĂ„ att en ny statlig utredning behövs.To give testimony is, with a few exceptions, a social obligation. At the same time, witnesses are sometimes exposed to threats and reprisals because of their upcoming testimonies. This has led to attention being given to the possibility to bear witness anonymously. Anonymously made testimonies are not permitted in Swedish criminal proceedings today. Both legal rules and procedural principles prohibits such proceedings. Since the mid-nineties the European Convention (ECHR) has had a major influence on Swedish law. Through its interpretation of Article 6 ECHR the European Court of Human Rights allows anonymous witnesses to, in exceptional cases, be used as evidence at main hearings. Official Reports of the Swedish Government has, despite the European Court of Human Rights’ approval, maintained a negative attitude regarding an adoption of a system with anonymous witnesses into the Swedish law. Anonymous witnesses are considered a threat to the Swedish rule of law. Through a legal-judicial method this thesis is to exam the procedural principles, legal rules and the interests assuring the rule of law that are preventing the imposition of a procedural proceeding allowing anonymous testimonies in Sweden. This is done mainly by studies of legal doctrine, governmental reports and cases from Swedish courts. The thesis will also account for cases from the European Court of Human Rights to clarify how the court has found anonymous testimonies, in exceptional case, not to lead to a violation of the ECHR. Through studies of Official Reports of the Swedish Government the conclusion is that it is mainly the principle of party transparency in combination with the low magnitude of threats against witnesses that has led to the negative approach of the Swedish state regarding an adoption of a procedural system allowing anonymous witnesses. The principle of party transparency is considered to be of such fundamental importance that a restriction of the principle is considered to jeopardize the rule of law in the Swedish criminal proceedings process. At the same time, the state admits that important interests can lead to a limitation of the principle and that the right to security for witnesses is of interest for the rule of law and must be taken into account by the state. Official Reports of the Swedish Government has accentuated that the question of anonymous witnesses is to investigate further. The thesis will also present motions submitted by the parliament that shows how threats against witnesses has increased in recent years which may imply that a new Official Report of the Swedish Government is needed
