L'italiano nell'epoca della globalizzazione

L'articolo cerca di fare il punto sulla situazione reale dell'italiano nella situazione attuale, nel momento in cui esso rischia di essere preso in una pericolosa tenaglia: da una parte l'inglese afferma sempre di più il suo primato, dall'altra si manifestano forti spinte regionalistiche, vengono varate leggi per la protezione delle minoranze, altre lingue locali premono per avere uno status protetto dalla legge rubando spazio alla lingua nazionale. Intanto, però, la partita decisiva di questo capitolo della 'questione della lingua' non si gioca in casa, in Italia, ma in Europa, dove si stanno per scegliere le cosiddette 'lingue di lavoro' comunitarie. Di fronte a tutto ciò, c' è chi vanta i successi internazionali dell'italiano e si compiace delle 'magnifiche sorti progressive'. In realtà è meglio essere molto più cauti nel valutare la situazione in corso.The article attempts to provide an account of the real situation faced by Italian in its current circumstances, at the moment in which there is a clear risk of it finding itself, as it were, between the devil and the deep blue sea: on the one hand, English is constantly reasserting its primacy, and on the other, there are strong regional impulses; the approving of laws aimed at protecting minorities; and other local languages pushing for a legally protected status that, in effect, rob space from the national language. Meanwhile, however, the decisive game in this chapter on the «questione della lingua» is not being played at home in Italy, but away in Europe, where the so-called «working language» of the community is about to be chosen. In light of all this, there are those who nevertheless make great show of the international successes of Italian, and are delighted with its «magnifiche sorti progressive» (magnificent, progressive fortune). In reality, it would be far better to show greater caution in evaluating the current situation

The essay retraces the controversy between Hans Kelsen and Carl Schmitt on the 'Custody of the Constitution' in the light of the historical events of the end of the Weimar Republic. Methodologically, it starts from the idea that it is useful to study legal ideas as historically given in their political and social context. It will be shown how the theoretical positions of the two great jurists on the protection of the constitutional order, jurisdiction and emergency were reflected in the 1932 Prussia v. Reich trial. It is precisely this hard case that offers the opportunity to measure the impact of jurists, courts and institutional actors on a situation of ‘political’ emergency

L’articolo cerca di mettere in chiaro il sistema delle idee linguistiche di Baretti, disperse in più scritti di generi diversi, cercando di individuarne le costanti fondamentali, spesso difficili da definire anche a causa della vis polemica che caratterizza quasi tutti i suoi interventi e ne accentua il carattere spesso contraddittorio. Infine, si individua la chiave di lettura delle intuizioni più interessanti di questo autore in relazione alle idee linguistiche: questa chiave si collega strettamente alla sua professione di insegnante di italiano all’estero.   More languages give more ideas: the international vocation of Baretti’s linguistics The article tries to clarify Baretti’s system of linguistic ideas, dispersed in several writings of different genres, trying to identify their fundamental constants, often difficult to define also because of the vis polemica that characterizes almost all of his interventions and accentuates the often contradictory character. Finally, the key to reading the most interesting insights of this author in relation to linguistic ideas is identified: it is primarily linked to his profession as an Italian teacher abroad

Le politiche statunitensi di ricostruzione della giurisdizione in Germania e Giappone, tra «occupazione trasformativa» e «national security liberalism». Alcuni spunti a partire dall’opera di R.W. Kostal.

L’articolo indaga, dal punto di vista del diritto, la politica degli Stati Uniti verso i due grandi Stati sconfitti della Seconda Guerra Mondiale, la Germania e il Giappone. Partendo dalle ricerche dello storico del diritto Rande Kostal e dagli scritti dei giuristi Karl Loewenstein ed Helmut Quaritsch, il tema viene sviluppato in rapporto al tentativo statunitense di creare nei due Paesi occupati quelle istituzioni legali in grado di assicurare la transizione a un regime liberal-democratico, in particolare una magistratura indipendente. Come si cercherà di dimostrare, il progetto andò incontro a un sostanziale insuccesso, non solo per la resistenza delle élite giuridico-amministrative degli Stati sconfitti, ma anche per l’oscillare della stessa politica statunitense tra le opposte esigenze dettate dai propositi di una «occupazione trasformativa», da un lato, e di un «national security liberalism», o di una politica di potenza, dall’altro. Lo studio delle ragioni del fallimento americano nel Secondo dopoguerra si potrebbe rivelare, in questa prospettiva, ancora oggi utile per comprendere i limiti che ha incontrato il trapianto delle istituzioni tipiche del liberalismo, politico e giuridico, in contesti diversi da quello d’origine.The essay investigates United States legal policy towards the two major defeated states of the Second World War, Germany and Japan. Starting from the research of the legal historian Rande Kostal and the writings of the jurists Karl Loewenstein and Helmut Quaritsch, the theme is developed in relation to the United States attempt to create in the two occupied countries those legal institutions capable of ensuring the transition to a liberal-democratic regime, in particular an independent judiciary. As will be shown, the project met with substantial failure, not only because of the resistance of the legal-administrative elites of the defeated states, but also because of the oscillation of United States policy itself between the opposing demands dictated by the intentions of a «transformative occupation», on the one hand, and a «national security liberalism», or power politics, on the other. In this perspective, the study of the reasons for American failure in the post-World War II period could prove still useful today to understand the limits encountered in transplanting the typical institutions of liberalism, both political and legal, into contexts other than the original one

GRAMMATICHE E VOCABOLARI NELLA SCUOLA DEL REGNO D’ITALIA

L’intervento cerca di fare il punto su ciò che gli studi di oggi possono aggiungere a quanto già si sa relativamente alle grammatiche e ai dizionari nella scuola dell’Italia unita, dal 1861 alla fine della seconda guerra mondiale. La valutazione di questo patrimonio bibliografico è qui avviata verificando quanto se ne dice nella Storia della grammatica italiana di Ciro Trabalza (1908), un manuale ricco di riferimenti, dato alle stampe nel momento del pieno successo dell’idealismo crociano, cioè proprio quando la grammatica veniva svalutata, collocata sotto la categoria di pseudo-scienza. L’esame delle discussioni di allora, a cui partecipò Croce medesimo, aiuta a meglio definire gli interessi moderni degli studiosi, cioè le modalità con cui la grammaticografia (e la lessicografia) possono essere vantaggiosamente collegate alla storia del libro scolastico, all’editoria per i giovani, alle riforme della scuola, ai metodi didattici, alla pratica scolastica, alla funzione sociale dell’insegnamento.   Grammar books and dictionaries in schools in the kingdom of italy The article examines what can be added to the studies on the history of school grammars and dictionaries published after the Italian unification, between 1861 and the end of World War II. The bibliographical patrimony starts from the masterpiece by Ciro Trabalza Storia della grammatica italiana (1908), a volume full of references, published at the apex of the idealism of B. Croce when grammar was devalued, considered less than a pseudo-science. Croce himself took part in the debates of the period, and reexamining those linguistic and philosophical discussions, we can better define how grammaticography (and lexicography) are linked to the history of textbooks, the children’s book publishing industry, school reforms, teaching methods and the social function of teaching

This article aims to reconstruct the Italian legal system’s reaction to the international crisis following the Russian invasion of Ukraine. The article focuses on the government's regulatory power in relation to the crisis, highlighting how both successive governments, one year after the start of the war crisis, preferred to resort to “ad hoc” legislation instead of using the legal instruments provided by the legal system. In particular, the article focuses on the relationship between the governmental decrees and the l. no. 145 of 2016 and on the decision to classify the list of armaments sent to the theatre of war
