A Prova Oral na Justiça do Trabalho: meio formador da verdade

Direito.Esse trabalho se deu origem acerca da necessidade de rever a posição do Juiz do Trabalho no que se refere à sua função jurisdicional enquanto analisado seu poder, para produzir força com responsabilidade de julgar um contencioso entre o forte e o fraco. Para isso, buscam-se elementos na prova oral que possam chegar a uma verdade aproximada, considerando a utilização da prudência no momento da investigação, pois é elemento fundamental na colhida da oitiva dos fatos. Observando o aspecto social das partes, empregador-empregado, e o grau de liberdade na apreciação da prova, a carga probatória segue-se mais pesada sobre a empresa, uma vez que embutido o axioma da inversão do ônus da prova, favorece ao empregado a oportunidade do seu pleito. O legislador adotou uma atitude anti-igualitária no Processo do Trabalho, entendendo que nesta fase, que toma corpo a desigualdade dos meios de prova postos à disposição do trabalhador e de seu empregador, a prova oral dá corpo ao processo, estruturando-se como espinha dorsal. A judicatura se vale de recursos técnicos-científicos, porém há que se comprometer também com o ético-estético, uma vez que na qualidade de agente transformador da sociedade contemporânea, comprometido com a cidadania, o Juiz promove a alteração de práticas distorcidas, o que o leva a um devir. Para isso, na busca da verdade aproximada, ele passa por uma leitura dinâmica dos fatos postos em julgamento, munido do pensamento jurídico-crítico, transmudando os procedimentos tradicionais e operando com bastante equilíbrio, mormente em se tratando da inversão do ônus da prova. Na tentativa de extrair a verdade aproximada da prova existente nos autos, respaldado tanto na Consolidação das Leis do Trabalho – CLT quanto no Código de Processo Civil – CPC e noutros instrumentos admitidos por lei, também se norteia utilizando a sensibilidade, a sagacidade e a flexibilidade de espírito, para não perder e deixar escapar quaisquer singularidade em relação à questão a ser avaliada. Levando em conta a Prova Oral uma ferramenta tão fundamental, concluiu-se que o Juiz do Trabalho, adequado aos fatos, tem um papel crucial na formação da verdade relativa, quando, através do Devir, faz o uso de forças ativas e exerce o papel de Juiz-cartógrafo-cidadão

Empreendedorismo em odontologia: montagem de consultório do planejamento ao funcionamento

The job market is becoming increasingly competitive and dentistry is no different. It requires dentists to have multi-professional knowledge, including financial management, administration, entrepreneurship and marketing. The aim of this work was to describe how to set up a dental practice, an important stage in professional practice. A room was acquired in a commercial building in the center of the city of Patos de Minas, with a total area of 60.11 m², divided into two dental rooms. Both are equipped with a sterilization unit and there is also a small office.  The commercial room also has two bathrooms. The first, sized to ensure accessibility, was for patients. The second is for staff. The reception area has a waiting room and a recreational area. Space has also been set aside for coffee and water. In addition, the practice of dentistry also requires regularization of the activity with public bodies, by obtaining certain documents, such as a municipal or state health permit, municipal registration or registration with a private health waste collection company, among others. This study showed that setting up a dental practice is not something that is widespread in the scientific community, and that there are few scientific articles on the subject. We therefore hope that this work can contribute both to the preparation of other similar articles and to providing guidance for recent dental graduates.O mercado de trabalho mostra-se cada vez mais competitivo e na odontologia este cenário não é diferente, exigindo do cirurgião-dentista um conhecimento multiprofissional, abrangendo, além das competências próprias, conhecimentos sobre gestão financeira, administração, empreendedorismo e marketing. O objetivo deste trabalho foi descrever a montagem de um consultório odontológico, importante etapa para a atuação profissional. Foi adquirida uma sala localizada em um prédio comercial situado no centro da cidade de Patos de Minas, com área total de 60,11 m², dimensionados em duas salas odontológicas. Ambas foram equipadas com central de esterilização, possuindo ainda um pequeno escritório.  A sala comercial conta ainda com dois banheiros. O primeiro, dimensionado para garantir a acessibilidade, foi destinado aos pacientes. O segundo foi destinado aos funcionários. A recepção conta com uma sala de espera e com espaço recreativo. Também foi reservado espaço para café e água. Além disso, o exercício da odontologia exige, ainda, a regularização da atividade junto aos órgãos públicos, mediante a obtenção de alguns documentos, tais como alvará sanitário municipal ou estadual, cadastro municipal ou em empresa privada de coleta de resíduos de saúde, entre outros. Observou-se com a elaboração deste trabalho que a montagem de consultório odontológico não é algo muito difundido no meio científico, verificando-se a escassez de artigos científicos abordando o tema. Esperamos, dessa forma, que o presente trabalho possa contribuir tanto para elaboração de outros artigos semelhantes, quanto para orientar os recém graduados em odontologia

Heliconias of the Baixo Juruá Extractive Reserve: economical potential for Amazonian traditional population

Extractive Reserves (Reservas Extrativistas-RESEX, in portuguese) are defined as territorial spaces destined for auto-sustainable exploration and conservation of renewable natural resources for the traditional population. Moreover, they are an alternative source of income for improving life conditions of the local families. Amongst the possibilities of income for the communities that make up the RESEX, which we discuss, is the use of Heliconia understorey herbs. The Heliconia genus is one of the colorful groups of tropical forest non-timber plants. However, as an income source, it is unknown to the RESEX communities. We registered 11 species of Heliconia in the Baixo Juruá Extractive Reserve with potential as ornamental plants: H. acuminata, H. densiflora, H. hirsuta, H. lasiorachis, H. stricta, H. chartacea, H. juruana, H. marginata, H. psittacorum, H. spathocircinata and H. tenebrosa. Currently in Brazil, the commercialization of ornamental plants is expanding, but the Amazonian region seems not to be following this trend, demonstrating perhaps lack of political initiative. Even though it causes some impact on fauna an flora, the practice of extractive economy inside the forest reserves in Amazonia helps keep the ecological functions of the forest intact, preventing future losses of regional biodiversity. Additionally, it guarantees the continuity of traditional populations in the natural areas, with direct effect on the local and regional economy.Reservas extrativistas (RESEX) são espaços territoriais destinados à exploração sustentável e conservação dos recursos naturais renováveis, por populações extrativistas. Além disso, tem como finalidade implantar alternativas de renda que contribuam para a melhoria das condições de vida das famílias locais. Dentre as variadas possibilidades de renda pelas comunidades que compõem as RESEX, destacamos neste trabalho o uso das helicônias. As espécies de Heliconia são um dos mais vistosos grupos de plantas herbáceas das florestas tropicais. Entretanto seu uso como fonte de renda é desconhecido pelas comunidades que compõem a RESEX. Registramos 11 espécies de Heliconia na RESEX do Baixo Juruá com uso potencial como plantas ornamentaisH. acuminata, H. densiflora, H. hirsuta, H. lasiorachis, H. stricta, H. chartacea, H. juruana, H. marginata, H. psittacorum, H. spathocircinata e H. tenebrosa. Atualmente o mercado de plantas ornamentais está em expansão no Brasil, mas a Amazônia parece não estar acompanhando este processo, demonstrando falta de iniciativa política. A economia na forma do extrativismo praticada dentro das reservas florestais na Amazônia, mesmo acarretando alguns impactos diretos sobre a fauna e a flora, ajuda a manter as funções ecológicas originais da floresta evitando perdas futuras de biodiversidade regional. Doenças virais exantemáticas emergentes com manifestações orais: sarampo e monkeypox

With the increasing number of cases of Measles and Monkeypox, the dentist has great importance in the early diagnosis, due to the characteristics and oral manifestations of the conditions, which can appear even before the systemic manifestations. The objective of this work is to identify the oral alterations resulting from Measles and Monkeypox, showing the characteristics of these oral lesions. This is an integrative literature review carried out under the parameters of the PRISMA strategy, with a search in the Pubmed, Scielo, Virtual Health Library (VHL), and EBSCO Host databases. After applying the inclusion and exclusion criteria, 14 articles were selected for characterization. Measles has a pathognomonic sign in the oral cavity, called Koplik's spot, appearing as numerous bluish-white macules, with sizes from 1 to 3 mm, surrounded by an erythematous halo. Monkeypox, on the other hand, presents itself as spherical bullous lesions with a reddish border, circumscribed and with deep roots, measuring from 2 to 5 mm in diameter. Measles and Monkeypox are considered reemerging diseases due to a significant increase in cases in recent years, which increases the chances of dentists (DCs) encountering the oral lesions of the disease. Therefore, it is extremely important to have knowledge on the subject so they can contribute to the early diagnosis and consequently to the regression of cases.Com o crescente número de casos das doenças sarampo e monkeypox, o cirurgião-dentista possui grande importância no diagnóstico precoce, devido a características e manifestações orais das condições, que podem surgir até mesmo antes das manifestações sistêmicas. O objetivo desse trabalho foi identificar as alterações bucais decorrentes do sarampo e da monkeypox, evidenciando as características dessas lesões bucais. Trata-se de uma revisão integrativa da literatura realizada sob os parâmetros da estratégia PRISMA, com busca nas bases de dados Pubmed, Scielo, Biblioteca Virtual em Saúde (BVS), e EBSCO Host. Após a aplicação dos critérios de inclusão e exclusão, 14 artigos foram selecionados para caracterização. O sarampo possui um sinal patognomônico na cavidade bucal, denominada mancha de Koplik, surgem como inúmeras máculas branco-azuladas, com tamanhos de 1 a 3 mm, circundadas por um halo eritematoso. Já a monkeypox apresenta-se como lesões bolhosas de formato esférico e borda avermelhada, circunscritas e de raízes profundas, medindo de 2 a 5 mm de diâmetro. O sarampo e a monkeypox são considerados doenças reemergentes por apresentar um aumento significativo dos casos nos últimos anos, o que aumenta as chances de cirurgiões-dentistas se depararem com as lesões orais da doença. Logo, é de suma importância o conhecimento sobre o assunto para que assim, possam contribuir para o diagnóstico precoce e consequentemente regressão dos casos

Limitations and Management of Static-guided Endodontics Failure

Endodontic treatment in severely calcified canals is always a challenging task because it can result in accidents such as deviations or perforations. Recently, guided endodontics has become an alternative approach for pulp canal calcification, facilitating the location of root canals more predictably through the combined use of cone-beam computed tomographic imaging, oral scanning, and endodontic access guides. Although several reports have shown that guided endodontics is safer, faster and can be performed without an operating microscope and by less experienced operators, the technique has limitations, and iatrogenesis may occur. This article describes the limitations of static-guided endodontics and possible causes of failures. In the present case, not fixing the guide to the bone and inaccuracies generated by manually performing mesh merger software led to root perforation. Endodontic microsurgery was effective in resolving this case and should be considered the treatment of choice when guided endodontics cannot be used safely or when it fails

Redes Interorganizacionais e Criação de Valor Corporativo no Brasil

Objective: In this study we evaluated the association between interorganizational networking and corporate value creation in 218 non-financial firms traded on B3. Method: Using descriptive, inferential and multivariate statistical techniques, we analyzed information regarding 2,080 board members (15,611 observations) for the year 2016 retrieved from reference forms and the EconomaticaÒ database. Results: Our results show that firms are more likely to create value if they limit the sharing of directors with other firms to 8 interlockings and keep at least 2 and at most 4 independent directors on the board. Contributions: We conclude that the corporate value creation was greater for firms practicing board interlocking than otherwise, making it possible, in light of Resource Dependence Theory, to demonstrate a positive association between interorganizational networking indicators and measures of corporate value creation.Objetivo: Esta pesquisa investiga a relação entre a prática de redes interorganizacionais e a criação de valor corporativo em 218 companhias não financeiras listadas na B3. Método: Com o apoio de técnicas de estatística descritiva, inferencial e multivariada, foram analisadas informações do ano de 2016 relacionadas aos 2.080 conselheiros e diretores, totalizando 15.611 dados, extraídos dos formulários de referência e da EconomáticaÒ. Resultados: Verificou-se que as empresas têm maior probabilidade de criar valor se limitarem o compartilhamento de seus conselheiros e diretores com outras empresas em até 8 interlockings e possuírem no mínimo 2 e no máximo 4 conselheiros independentes em suas estruturas administrativas. Contribuições: Conclui-se, com fundamento na Teoria da Dependência de Recursos, que empresas conectadas em rede, por meio de board interlocking, podem contribuir para melhorar a atividade econômica umas das outras, além de sugerir que a existência de laços corporativos favorece a criação de valor corporativo

Hydroponic Lettuce Production and Minimally Processed Lettuce

Lettuce is a leafy vegetable most consumed in Brazil, and is considered the basis for salads and can be grown by hydroponics system. Hydroponics is a viable alternative to be implemented, with benefits for soil conservation and preservation of water sources. This work aimed to study the market of trailers snacks in Pelotas to analyze the economic feasibility of deploying an enterprise for the production of hydroponic lettuce, minimally processed, on a farm located in the city of Pelotas. The trailers were classified as small, medium and large, according to the consumption of lettuce. From market analysis, facilities and greenhouses for hydroponics area for processing of lettuce with flowchart of activities and mass balance were designed. The lettuce is produced from seeding to minimal processing, consisting of packing to delivery the whole lettuces and cut and pack the other portion, which will also be packaged for shipment. For the optimization of space in the greenhouses, a system of trails that allow them to glide over the stands, being compressed, opening corridors through which people ranging transplanting or harvest the lettuces, only where needed was created. The economic and financial analysis was performed using the indicators to establish the viability of the project or not. These indicators are: NPV (Net Present Value), IRR (Internal Rate of Return) and payback. The analysis was performed in a planning horizon of 10 years and considering a TMA (Average Attractiveness ) of 11.6 % pa Three scenarios for implementation of the project, the amount of greenhouses ranging from one to three different percentages of sales and production over time were studied. The project proved to be unfeasible with only a greenhouse, but two or three greenhouses is feasible to be implemented. However, when deployed, the project with two greenhouses in the first year, and three greenhouses in the first two years will profit. The best option would be two or three greenhouses, depending on the amount to be invested and the availability of capital to withstand years without profitability. Technically, the project proved feasible by enabling large area in a small amount of lettuce is produced by hydroponic system, hydroponic lettuce and minimally processed snack bars for an interesting product, as it is practical and hygienic. It is recommended to study whether the project would become more attractive with the production of other crops such as tomato, zucchini, among other hydroponic

Drying Tomatoes in a Small Tray Dryer

Drying tomatoes with high initial moisture content have advantages such as: maintenance of mineral constituents, inhibition of the action of microorganisms, reduction of the cost of transportation, handling, and storage and is an alternative to the problems of waste disposal and pollution. Moreover, dried products, besides the more economical and affordable package, is an option for light and quick meals. Small and low cost tray dryers are hard to find in the Brazilian market. Producing your own dehydrated food is a practice used in many countries for domestic consumption, as a gift, for small-scale enterprises, because some people appreciate handmade products that are related to a healthier product, without additives. The present study aimed to dry tomatoes and evaluates the characteristics such as: loss of final mass, drying time, and cost of drying in a portable low cost tray dryer. The dryer was built in plastic body and trays. Two heating conical resistors with 600 W each, and a 26W-fan were used. Approximately 1.4 kg of tomatoes was used in this test. They were previously sliced, washed, and the endocarp and seeds were removed. The weight loss during the process was obtained ​​by successive weightings of tomatoes in the trays each hour. The final drying was determined when the tomatoes were around 25% of moisture content. The initial moisture content of the tomatoes was determined by oven drying using 10 g of chopped tomatoes, dried at 95°C for 24h. To evaluate the drying cost the yield of dried tomatoes, the losses during the preparation of the fresh tomatoes slices, the drying time, and the rate of product ready for the drying period were determined. The energy cost was R$4,72, plus R$ 0,30 of osmotic solution, additional R$7.80/kg of tomatoes (off season). The final cost was R$ 12,82 (U$S 5.35) to process 1 kg of fresh tomatoes. During the season, one can buy tomatoes at R$ 1,00/kg, which reduces the cost to R$6.02/kg (U$S 2.50). Whereas the process reduces weight by 10.83 times, the pound of dried tomatoes would cost R$65,20 (U$S 27.15) in crop condition. As this portable dryer holds 2 kg of tomatoes by drying, the cost could be reduced to R$3.66/kg (U$S 1.55) considering fresh tomatoes or R$39,60/kg (U$S 16.50) dried tomatoes. The dryer presented the ideal medium parameters for drying fruits (51.6°C and 1.2 m/s) in a drying process of 8 hours. The cost per hour of drying in this experiment, due to be in between tomato crop season was considered high. However, there are conditions to reduce this cost at the harvest time and by increasing the density of tomatoes in the dryer trays

Guided Endodontics in Complex Scenarios of Calcified Molars

This study aimed to report a case series and describe the use of guided endodontics in complex symptomatic cases of mandibular and maxillary molars; presenting calcification of all three root canals. The arches of the referred patients were scanned, and high-resolution cone-beam computed tomography (CBCT) imaging was performed. Then, the taken CBCT and tooth scans were aligned and processed using software. A virtual copy of a drill was superimposed onto the scans and evaluated in 3 dimensions. Subsequently, a 3-dimensional (3D) template was designed and printed. Drilling was performed and a radiograph was taken to confirm its position. The canals were reached and endodontic treatment was performed. At the 12-month follow-up, the teeth were completely asymptomatic. The use of guided endodontics _in cases of calcification in molars_ was demonstrated to be a viable and reliable alternative treatment. IMPACTO DEPRESSIVO NO CUIDADOR IDOSO DE PACIENTE DEMENCIADO

O presente estudo teve como objetivo relatar o impacto no cuidador idoso de um paciente com demência, cuidado em domicilio pela esposa, bem como relatar os sintomas sugestivos de depressão na idosa cuidadora de seu marido demenciado. Os cuidadores dos portadores de demência com alterações comportamentais estão expostos a maior risco de desenvolver depressão e estresse, tornando-se importante o conhecimento acerca da dimensão dessas condições potencialmente causadoras de impacto individual e sobre o sistema de saúde. No presente relato de caso fica evidente o impacto na esposa, que é idosa, e que cuida de um paciente idoso com síndrome demencial gerando sintomas associados à depressão e ansiedade. Os níveis de estresse da mesma relacionaram-se aos sintomas neuropsiquiátricos e comportamentais do paciente, que afetou as atividades básicas da vida diária, perda cognitiva, a evolução da demência, ao tempo de cuidado e ainda ao fato de residirem juntos. Observou-se ainda um impacto na saúde da cuidadora que necessita de atendimento multiprofissional. Existindo assim, a necessidade de uma intervenção com uma abordagem sistêmica envolvendo o casal, a fim de sanar ou amenizar tais impactos, na tentativa da manutenção da saúde física e psíquica não somente do idoso, mas também de sua esposa. Os profissionais de saúde devem estar aptos a prover suporte precoce e adequado à senhora E.B.B., com o objetivo de minimizar problemas a esta família. Por fim, confirmamos empiricamente a tensão sofrida por aquele que cuida juntamente com o adoecer do mesmo
