    Infrared Rugates by Molecular Beam Epitaxy

    Rugates are optical structures that have a sinusoidal index of refraction (harmonic gradient-index field). As their discrete high/ low index filter counterparts, they can be used as narrow rejection band filters. However, since rugates do not have abrupt interfaces, they tend to have a smaller absorption, hence deliver a higher in band reflectivity. The absence of sharp interfaces makes rugates even more desirable for high-energy narrow band reflectors. In this application, the lack of a sharp interface at the maximum internal standing wave electric field results in higher breakdown strengths. Our method involves fabricating rugates, with molecular beam epitaxy, on GaAs wafers as an Al(x)Ga(1-x)As single-crystal film

    Who Are You? Difficulties in Obtaining Trademark Protection for Domain Names

    Three appellate decisions illustrate the difficulty of acquiring trademark protection for domain names that include a top-level domain (“TLD”), such as “.com.” Courts have characterized these marks as generic or merely descriptive, which carries implications for the party seeking registration: generic marks cannot be protected, while descriptive marks can, assuming they possess a secondary meaning that makes the mark distinctive. Generic and descriptive domain names often indicate the services a company provides, with the addition of the “.com” TLD to indicate online services. One key test of genericness is whether the public identifies the mark with a service generally or with a company specifically. This Article examines the rationales supporting the generic-descriptive distinction for domain names with TLDs. When a website does more than merely sell a product online that could be obtained in a brick and mortar store—such as providing additional consumer tools and flexibility unique to the online medium—the domain name has an increased chance of being viewed as descriptive and potentially protectable

    Off with the Head? How Eliminating Search and Index Functionality Reduces Secondary Liability in Peer-to-Peer File-Sharing Cases

    Peer-to-peer file-sharing service providers (P2Ps) allow Internet users to exchange electronic content, including music, movies, and other digital works. In Metro-Goldwyn-Mayer Studios, Inc. v. Grokster, Ltd., the Supreme Court unanimously disarmed such P2Ps by holding that it is unlawful to distribute programs that induce others to commit copyright infringement. Evolved technologies, such as dot-torrent, allow mass file exchanges between third-party users--an attempt to remove the P2P from the file-sharing equation. The court in Columbia Pictures Industries, Inc. v. Fung, however, imputed inducement from the search and index functionality of the P2P’s software, as well as the P2P’s encouraging behavior. The court in Arista Records LLC v. Lime Group LLC determined that LimeWire’s entire business model was founded on inducement. In both Fung and Lime Group, the P2P\u27s intent was deduced from its outward acts. In Perfect 10, Inc. v. RapidShare, the court noted that RapidShare did not provide search and indexing capability and actively policed its servers when notified of infringement. This technological-behavioral standard of inducement suggests that P2Ps cannot avoid secondary liability under the guise of removing themselves as the “head” of the file-sharing process

    Macroalgae contribute to the diet of Patella vulgata from contrasting conditions of latitude and wave exposure in the UK

    Analysis of gut contents and stable isotope composition of intertidal limpets (Patella vulgata) showed a major contribution of macroalgae to their diet, along with microalgae and invertebrates. Specimens were collected in areas with limited access to attached macroalgae, suggesting a major dietary component of drift algae. Gut contents of 480 animals from 2 moderately wave exposed and 2 sheltered rocky shores in each of 2 regions: western Scotland (55–56°N) and southwest England (50°N), were analysed in 2 years (n = 30 per site per year). The abundance of microalgae, macroalgae and invertebrates within the guts was quantified using categorical abundance scales. Gut content composition was compared among regions and wave exposure conditions, showing that the diet of P. vulgata changes with both wave exposure and latitude. Microalgae were most abundant in limpet gut contents in animals from southwest sites, whilst leathery/corticated macroalgae were more prevalent and abundant in limpets from sheltered and northern sites. P. vulgata appears to have a more flexible diet than previously appreciated and these keystone grazers consume not only microalgae, but also large quantities of macroalgae and small invertebrates. To date, limpet grazing studies have focussed on their role in controlling recruitment of macroalgae by feeding on microscopic propagules and germlings. Consumption of adult algae suggests P. vulgata may also directly control the biomass of attached macroalgae on the shore, whilst consumption of drift algae indicates the species may play important roles in coupling subtidal and intertidal production

    Integrated behavioural and stable isotope data reveal altered diet linked to low breeding success in urban-dwelling blue tits (Cyanistes caeruleus)

    Animals often show reduced reproductive success in urban compared to adjacent natural areas. The lower availability and quality of natural food in cities is suggested as one key limiting factor. However, only few studies have provided conclusive support by simultaneously assessing food availability, diet and fitness. We consolidate this evidence by taking a holistic approach, comparing blue tits breeding in forest, suburban and urban areas. We (a) assessed arthropod availability, (b) investigated parental provisioning behaviour, (c) inferred diet through stable isotope analysis, and (d) measured reproductive success. At the urban site, we found a significant reduction in caterpillar availability, the main food source of blue tits, and consequently urban tits fed their offspring with fewer caterpillars than forest and suburban birds. Stable isotope analysis confirmed that diet in the urban area was fundamentally different than in the other sites. Reproductive success was lower in both urban and suburban sites compared to the forest site, and was positively associated with volume of provisioned caterpillars. Our findings provide strong integrative evidence that urban blue tit nestlings are not receiving a suitable diet, and this may be an important limiting factor for urban populations of this and potentially many other species

    Housing is one of the necessities that must be fulfilled by every human being so that in the procurement of housing, the government has issued its own rules and regulations. Human needs are no less important that related to house is the existence of facilities. One of the essential means that needs to be held on housing is to conduct social activities or interaction among citizens. However, developers as providers of commercial houses in private housing have provided open space is also intended as one place for residents to social activities and did not escape the requirements of reforestation. The problem is what needs to be studied, what the problem is. This research is designed to find out the extent of the successful use of open space that has been provided by developers in private housing. By evaluating open space user satisfaction on house, referring to certain variables both from the non-physical and physical side is the method to be done in this research. The results of the study state that open space in Grand Serpong 2 housing is quite good from accessibility factors. But the less maintained condition of the open space made the residents less interested in visiting the room so that the occupants\u27 attachment to the space was not good enough. Hopefully, if the discovery of the response of housing, residents can be used as one of thought or consideration for the future for housing providers, to provide open space that can be utilized by the citizens

    A ship-based methodology for high precision atmospheric oxygen measurements and its application in the Southern Ocean region

    A method for achieving continuous high precision measurements of atmospheric O-2 is presented based on a commercially available fuel-cell instrument, (Sable Systems, Oxzilla FC-II) with a precision of 7 per meg (approximately equivalent to 1.2 ppm) for a 6-min measurement. The Oxzilla was deployed on two voyages in the Western Pacific sector of the Southern Ocean, in February 2003 and in April 2004, making these the second set of continuous O-2 measurements ever made from a ship. The results show significant temporal variation in O-2, in the order of +/- 10 per meg over 6-hourly time intervals, and substantial spatial variation. Data from both voyages show an O-2 maximum centred on 50 degrees S, which is most likely to be the result of biologically driven O-2 outgassing in the region of subtropical convergence around New Zealand, and a decreasing O-2 trend towards Antarctica. O-2 from the ship-based measurements is elevated compared with measurements from the Scripps Institution of Oceanography flask-sampling network, and the O-2 maximum is also not captured in the network observations. This preliminary study shows that ship-based continuous measurements are a valuable addition to current fixed site sampling programmes for the understanding of ocean-atmosphere O-2 exchange processes.
