Jurisprudentie internationaal en Europees socialezekerheidsrecht
Dit is de eerste keer dat de jaarkroniek âJurisprudentie internationaal en Europees socialezekerheidsrechtâ verschijnt in dit tijdschrift, maar desalniettemin de achtste op rij.Met het oog op het profiel van TRA is de opzet gewijzigd. Na een bespreking van de meest in het oog springende uitspraken van het jaar, is de kroniek ingedeeld langs assen van de sociale risicoâs, waarbij, in verband met de raakvlakken met het arbeidsrecht, de nadruk is komen te liggen op werkloosheid, ziekte en arbeidsongeschiktheid. Met deze benadering konden heel wat interessante uitspraken op de wal worden getrokken. Als eerste van de âtoppersâ gaan we in op een arrest van Hof van Justitie EG (HvJ EG) waarin wordt bezien of de uitsluiting van werkzoekenden van het recht op bijstand door de beugel kan van het Europese discriminatieverbod (paragraaf 1).Vervolgens besteden we aandacht aan een Poolse zaak waarin het Europees Hof voor de Rechten van de Mens (EHRM) de stopzetting van een onterecht toegekende uitkering zeer streng toetst (paragraaf 2). Als derde topper bespreken we de langverwachte uitspraak van de Centrale Raad van Beroep (CRvB) waarin deze zijn visie geeft op de verhouding tussen de tewerkstellingsplicht in de bijstand en het verbod op dwangarbeid, een onderwerp dat we inmiddels aanduiden als de âschoffelaarsproblematiekâ (paragraaf 3). En ten slotte gaan we kort in op een oordeel van het Europese ComitĂ© voor Sociale Rechten over het recht op huisvesting voor illegalen, een uitspraak die ook voor de sociale zekerheid gevolgen heeft (paragraaf 4). Na deze toppers bespreken we uitspraken op het terrein van vijf sociale risicoâs. In het kader van de Werkloosheidswet (WW) wordt onder meer aandacht besteed aan de verkorting van de maximale uitkeringsduur (paragraaf 5). Is dit te beschouwen als een ongerechtvaardigde ontneming van een eigendomsrecht? Bij ziekte en arbeidsongeschiktheid bezien we onder meer of het gewijzigde Schattingsbesluit arbeidsongeschiktheidswetten naar het oordeel van de CRvB een verboden onderscheid naar leeftijd teweegbrengt (paragraaf 6). Bij het ouderdomsrisico komen we twee uitspraken over een wooneis tegen (paragraaf 7). Wat betreft de overige risicoâs zijn met name de ziektekosten relevant. Pensionadoâs klagen dat zij premies Zorgverzekeringswet (Zvw) moeten betalen voor de zorg die zij in hun woonland ontvangen. De CRvB heeft daarover prejudiciĂ«le vragen gesteld (paragraaf 8). Ten slotte hebben we nog aandacht voor enkele perikelen aan het front van de bijstand (paragraaf 9)
Precessional cyclicity of seawater Pb isotopes in the late Miocene Mediterranean
Astronomical tuning in the Mediterranean region is primarily based on organicallyâmediated proxies, such as cyclicity of organic rich layers or changes in foraminiferal assemblages. Both during and post deposition, organic proxies can be affected by complex processes not immediately related to the changes in precession (insolation) they are assumed to reflect. Here we present an isotopic proxy which exhibits precessional cyclicity yet is inorganic. Seawater lead (Pb) isotope records over four precessional cycles between 6.6 and 6.5 Ma, from bulk sediment leachates of three Messinian, circumâMediterranean marginal locations, show variations consistent with precessional cyclicity. During insolation minima, the Pb isotope signatures from all three sites converge to similar values, suggesting a regional process is affecting all three locations at that time. Data from the marginal sites are compared with new data from ODP Site 978 and published data from a variety of geological archives from the Mediterranean region to determine the mechanism(s) causing the observed variability. While the comparisons are not fully conclusive, the timing of events suggest that increased dust production from North Africa during insolation minima is the most likely control. This hypothesis implies that authigenic marine Pb isotope records have the potential to provide a reliable inorganic tie point for Mediterranean cyclostratigraphy where subâprecessional resolution is required. An inorganic tie point could also provide the means to resolve longâstanding problems in Mediterranean stratigraphy on precessional and subâprecessional timescales which have been obscured due to postâdepositional changes (e.g., sapropel burnâdown) or suboptimal ecological conditions (e.g., the Messinian Salinity Crisis)
Changes of the Atlantic meridional overturning circulation of the past 30ka recorded in a depth transect at the Blake Outer Ridge
Oceans and climate are a tightly coupled system interacting with each other in various ways such as storage of
carbon dioxide in the deep ocean. Within the global conveyor belt the Atlantic Meridional Overturning Circulation (AMOC) holds a key function, transporting warm salty surface waters from the tropical to the northern Atlantic where deep water formation takes place. Following the continental rise of North America this newly formed deep water propagates southward as Western Boundary Undercurrent (WBUC) ventilating the deep Atlantic. In the past (e.g. the last glacial cycle) strength and geometry of the AMOC have changed significantly. This study aims to provide a better understanding of the temporal and spatial (also depth depended) evolution of the AMOC in the western Atlantic sector since the last glacial (âŒ30 ka). We have investigated four sediment cores of the Blake Outer Ridge (30°N, 74°W; ODP 1059 to 1062) in a depth transect from 3000 to 4700 m water depth in the main flow path of the WBUC. We measured four down-core profiles of neodymium (ΔNd) and 231Pa/230Th isotopes for the reconstruction of water mass provenance and circulation strength of the last âŒ30 ka. In contrast to published Nd isotope and 231Pa/230Th records from the Blake Ridge area our records are of unprecedented resolution, resolving climate key features of the North Atlantic region: Heinrich Stadials (HS) 1 and 2, the Last Glacial Maximum (LGM), the BĂžlling-AllerĂžd and Younger Dryas (YD). Radiogenic Nd isotope signatures during the LGM reveal AABW to be the prevalent water mass in the deep western North Atlantic. The trend to more unradiogenic signatures during the deglaciation point to an increased formation of NADW which was again replaced by AABW during YD. The Holocene shows the most unradiogenic signatures and therefore established NADW. The circulation strength-proxy 231Pa/230Th indicates reduced LGM deep circulation, a pronounced slowdown during HS1 and a strong and deep circulation during the Holocene. Compared to isotopic records from the Bermuda Rise (ODP 1063) we found depth depended geometry changes of the WBUC which have occurred through the last glacial. Here, we focus on how deep northern sourced water has reached during phases of reduced circulation (indicated by increased 231Pa/230Th ratios) and the timing of this southward progradation of lower NADW
