    AN ECONOMIC MODEL FOR IRRIGATION WELL MANAGEMENT IN A DECLINING AQUIFER

    A computerized model is developed that uses the aquifer characteristics and irrigation requirements to estimate hydraulic properties of a well pumping from an unconfined aquifer with a steadily declining water table. The model simulates electrically-powered well operation under the most economical conditions. High versatility of model inputs allows examination of many facets of well management. One example is the effect of electricity price on the ratio of energy cost of total cost of supplying water at different average total heads. At current electricity prices, energy accounted for 65 to 70 percent of total water costs. In a second example, as average annual efficiency decreased, average annual cost per acre-foot increased and average annual pumping volume decreased, leaving average annual total energy costs almost constant.Resource /Energy Economics and Policy,

    Jurisdiction—Indirectly Affecting Land in Another State by Judgment in Personam

    A husband and wife were residents of Wyoming. In a divorce proceeding in that state, having both parties before it and having jurisdiction over the subject matter of the suit, the Wyoming court granted a decree of divorce to the wife. The decree ordered the husband to deliver to the wife a quit claim deed to property in Nebraska. The husband did not comply with this order. Instead, he left Wyoming and went to the situs of the land in Nebraska and brought a suit there to have the Wyoming decree declared void and to quiet his interest in the property. The wife cross-petitioned asking that the Wyoming decree be enforced, or in the alternative, to quiet title in the wife to the husband\u27s interest in the property. The Nebraska Supreme Court remanded the case to the trial court with orders to render a judgment either enforcing the order of the Wyoming Court, or in the alternative, quieting title in the wife to the husband’s interest in the property. The problem presented in this case is the effect, in Nebraska, of a decree of a sister state ordering a conveyance of Nebraska real estate. The maxim that a court of one state cannot directly affect or determine title to real property located in another state is not as final as it sounds. Under the guise of “indirectly affecting” real property, courts of one state may affect real property in another by rendering an in personam order to convey title to that land. Once this order becomes final, it is then backed by the full faith and credit clause of the United States Constitution

    The WTI Incinerator: The RCRA Citizen Suit and the Emergence of Environmental Human Rights

    The WTI Incinerator currently operates in East Liverpool, Ohio, burning toxic waste despite a district court ruling that held it posed an imminent and substantial risk to both human health and the environment. Unfortunately for the Ohio plaintiffs, the Circuit Court of Appeals in this case misinterpreted the RCRA (Resource Conservation and Recovery Act) Citizen suit provision, barring any remedy for the Ohio citizens who brought the suit. This flawed interpretation has been adopted nationwide by other Appellate Circuit Courts. This article compares the remedies available to U.S. citizens for environmental harms with those remedies available to the citizens under the European Union Court of Justice, the European Court of Human Rights, and the Inter-American Court of Human Rights, using the WTI Incinerator as a case study. This article argues that Congress needs to rewrite the RCRA citizen suit provision to allow for the remedies it originally intended to allow U.S. citizens the same redresses against environmental harms enjoyed by those citizens in other international jurisdictions

    Ethics in Accounting: Sustainability as a Predictor of Financial Statement Usefulness

    This paper examines the impact of ethics on financial statement usefulness in 120 publicly traded companies. Because ethics are difficult, if not impossible, to quantify, Corporate Social Responsibility ratings are used as a proxy. The potential implications of this study are vast, though the main idea is that investors would be able to make better financial decisions should the hypothesis come to fruition. Contrarily, investors will also be able to avoid potentially bad investments if they can ascertain certain companies that lack ethical values. In this paper, I will discuss several facets of corporate ethics such as creative accounting in addition to delving deeper into what it means for firms to be sustainable. Using data from the Roberts Environmental Center at Claremont McKenna College in conjunction with financial data from Wharton Research Data Services and panel data techniques, I find that only within the food and beverages industry is there a correlation between ethics and financial statement usefulness. This finding lends distinct support for the hypothesis and also begs the question of how corporate ethics vary between industries

    The Death of Conrad Unger: Some Conjectures Regarding Parasitosis and Associated Suicide Behavior

    The death by suicide of Gary J. Shipley’s close friend, Conrad Unger (writer, theorist and amateur entomologist), has prompted him to confront not only the cold machinery of self-erasure, but also its connections to the literary life and notions surrounding psychological bewitchment, to revaluate in both fictional and entomological terms just what it is that drives writers like Unger to take their own lives as a matter of course, as if that end had been there all along, knowing, waiting. Like Gérard de Nerval, David Foster Wallace, Ann Quin and Virginia Woolf before him, Unger was not merely a writer who chose to end his life, but a writer whose work appeared forged from the knowledge of that event’s temporary postponement. And while to the uninitiated these literary suicides would most likely appear completely unrelated to the suicide behaviors of insects parasitized by entomopathogenic fungi or nematomorpha, within the pages of this short study we are frequently presented with details that allow us to see the parallels between their terminal choreographies. He investigates what he believes are the essentially binary and contradictory motivations of his suicide case studies: where their self-dispatch becomes an instance of necro-autonomy (death as solution to an external thraldom, or the zombification of everyday life as something requiring the most extreme form of emancipation), while in addition being an instance of necro-equipoise (death as solution to an internal thraldom, or the anguish of no longer being able to slip back comfortably inside that very everydayness). The deadening claustrophobia of human life and achieving a stance outside of it: both barbs on the lines that can only ever detail the sickness, never cure it. Through extracts and synopses of Unger’s books, marginalia and underscorings selected from his extensive library, and a brief itinerary of his movements in that last month of exile, a picture of the writer’s suicidal obsession begins to form, and it forms at the expense of the man, the idea eating through his brain like a fungal parasite, disinterring the waking corpse to flesh its words
