    California\u27s Suppression Statute-An Examination of Renal Code #1538.5

    California Penal Code section 1538.5 codifies the motion to suppress evidence. This Article examines the practical application of Penal Code section 1538.5, including a discussion on the scope of coverage, the procedure at the hearing, and appellate review. The scope of Penal Code section 1538.5 is contentious. There is much concern regarding the grounds on which challenges to search, seizure, and admissibility of confessions can be made. However, one thing is clear: Penal Code section 1538.5 can be invoked in both felony and misdemeanor cases. In both cases, the superior court can review rulings on motions to suppress evidence de novo in a special hearing. In addition, appellate review is available. In misdemeanor cases, both sides can request review of an adverse ruling, whereas only a defendant can appeal an adverse ruling in felony cases. In felony and misdemeanor cases, the appellate court must review the facts in the light most favorable to the prevailing party using a substantial evidence test. This Article concludes by assessing changes to and the success of the statute

    Occult fallopian tube carcinoma detected in routine pelvic washing specimens submitted for staging: Another justification for pelvic washing cytology?

    Peritoneal washing cytology is important in the staging, prognosis, and treatment schema for women diagnosed with gynecologic malignancies. Additionally, peritoneal washings are often performed before the specific diagnosis or even the distinction between benign or malignant lesion is known. Occasionally, the cytology and surgical pathology specimens, although obtained during the same procedure, will show unexpected and/or discordant findings. Perhaps, the greatest dilemma occurs when atypical cells suggestive of malignancy are identified in peritoneal washing specimens when a corresponding benign or discordantly low grade malignant diagnosis is made in the surgical pathology specimen. We present two such cases in which further investigation proved extremely valuable, not only leading to resolution of initially discrepant cytologic and surgical pathology findings but also in the process leading to second diagnoses of early fallopian tube carcinoma. Increasing evidence appears to be pointing to the fallopian tube as the site of origin of many serous carcinomas previously thought to be of primary pelvic or ovarian origin. These cases further confirm the utility of peritoneal washing cytology as a diagnostic modality when routine gross examination and sampling of the surgical specimens alone would have failed to provide the complete diagnosis.     Utility of PAX8 and PAX2 immunohistochemistry in the identification of renal cell carcinoma in diagnostic cytology

    The diagnosis of metastatic renal cell carcinoma (RCC) in cytology specimens may be difficult to confirm on the basis of cytomorphology alone. Often, immunohistochemistry serves as an important adjunct in confirming this diagnosis. Recently, PAX2 was shown to be useful in this regard. In this study, we sought to compare the utility of PAX8 to that of PAX2 immunohistochemistry in the diagnosis of RCC in cytology specimens. First, we verified the performance of PAX8 immunohistochemistry on a tissue microarray (TMA) composed of 54 cases of RCC; PAX8 immunoreactivity was seen in at least 10% of the tumor cells in all cases. Next, we applied PAX8 immunohistochemistry to cell block sections prepared from 24 cases of RCC, obtained from fine‐needle aspirates and effusion specimens. PAX2 immunohistochemistry was performed for comparison. Immunopositivity was defined as the presence of nuclear staining in at least 10% of tumor cell nuclei. Immunoreactivity for PAX8 and PAX2 was seen in 21 (88%) and 20 (83%) of the 24 cases, respectively. The presence of either PAX8 or PAX2 immunostaining was present in 22 of 24 cases, thus showing a total sensitivity of 92%. Overall, the results indicate that PAX8 and PAX2 are diagnostically useful adjuncts in confirming the diagnosis of RCC in cytology specimens. Diagn.     Correlation between hybrid capture II high-risk human papillomavirus DNA test chemiluminescence intensity from cervical samples with follow-up histologic results

    BACKGROUND: The Hybrid Capture II high-risk human papillomavirus (hrHPV) DNA test is a US Food and Drug Administration-approved nucleic acid hybridization assay using chemiluminescence for the semiquantitative detection of hrHPV in cervical samples. Patient samples and controls are used to calculate results as negative for hrHPV if 2.5, and “equivocal” if between 1.0 and 2.5. METHODS: The authors reported on the cervical histologic results of 209 patients demonstrating “equivocal” results for hrHPV from SurePath (204 patients) or ThinPrep (5 patients) vials, and compared patients in this cohort with atypical squamous cells of undetermined significance (ASC-US) cytology on the index cervical Papanicolaou (Pap) test (Group 1; n = 148 patients) with a patient cohort demonstrating unequivocal positive hrHPV test results (Group 2; n = 148 patients). The chemiluminescence intensity of hrHPV tests from patients in Group 2 were correlated with the presence and severity of dysplasia on subsequent histologic results, and patients were thereby stratified for their subsequent risk of cervical intraepithelial neoplasia (CIN) types II/III. RESULTS: Approximately 97% of hrHPV tests demonstrating “equivocal” results were found to be positive at the time of retesting, and 15% of biopsied cases demonstrated CIN II or III. Results of follow-up histology after an ASC-US diagnosis, expressed as a percentage of the biopsied cohort, were: CIN II/III: 16.5% in Group 1 and 22.4% in Group 2; CIN I: 27% in Group 1 and 23.5% in Group 2; and negative: 56.5% in Group 1 and 54.1% in Group 2. Chemiluminescence intensity did not appear to be correlated with the severity of dysplasia. CONCLUSIONS: The percentage of high-grade CIN in the “equivocal” hrHPV cohort is highly significant and therefore the management of these patients should be similar to the unequivocally positive population. After an unequivocal positive hrHPV test, the hrHPV chemiluminescence intensity does not appear to further predict the rate of high-grade CIN.     High elevation watersheds in the southern Appalachians: Indicators of sensitivity to acidic deposition and the potential for restoration through liming

    Southern Appalachian high elevation watersheds have deep rocky soils with high organic matter content, different vegetation communities, and receive greater inputs of acidic deposition compared to low elevation sites within the region. Since the implementation of the Clean Air Act Amendment in the 1990s, concentrations of acidic anions in rainfall have declined. However, some high elevation streams continue to show signs of chronic to episodic acidity, where acid neutralizing capacity (ANC) ranges from 0 to 20 ”eq L-1. We studied three 3rd order watersheds (North River in Cherokee National Forest, Santeetlah Creek in Nantahala National Forest, and North Fork of the French Broad in Pisgah National Forest) and selected four to six 1st order catchments within each watershed to represent a gradient in elevation (849–1526 m) and a range in acidic stream ANC values (11–50 leq L-1). Our objectives were to (1) identify biotic, physical and chemical catchment parameters that could be used as indices of stream ANC, pH and Ca:Al molar ratios and (2) estimate the lime required to restore catchments from the effects of excess acidity and increase base cation availability. We quantified each catchment’s biotic, physical, and chemical characteristics and collected stream, O-horizon, and mineral soil samples for chemical analysis seasonally for one year. Using repeated measures analysis, we examined variability in stream chemistry and catchment characteristics; we used a nested split-plot design to identify catchment characteristics that were correlated with stream chemistry. Watersheds differed significantly and the catchments sampled provided a wide range of stream chemical, biotic, physical and chemical characteristics. Variability in stream ANC, pH, and Ca:Al molar ratio were significantly correlated with catchment vegetation characteristics (basal area, tree height, and tree diameter) as well as O-horizon nitrogen and aluminum concentrations. Total soil carbon and calcium (an indicator of parent material), were significant covariates for stream ANC, pH and Ca:Al molar ratios. Lime requirement estimates did not differ among watersheds but this data will help select catchments for future restoration and lime application studies. Not surprisingly, this work found many vegetation and chemical characteristics that were useful indicators of stream acidity. However, some expected relationships such as concentrations of mineral soil extractable Ca and SO4 were not significant. This suggests that an extensive test of these indicators across the southern Appalachians will be required to identify high elevation forested catchments that would benefit from restoration activities

    Minimizing the diagnosis of “follicular lesion of undetermined significance” and identifying predictive features for neoplasia

    We used proposed standard morphologic criteria as a guideline to conduct a 10‐year retrospective review of thyroid fine‐needle aspiration specimens that were originally interpreted as “follicular lesion of undetermined significance” and followed by surgical intervention. We sought to investigate whether the indeterminate diagnosis could be minimized by assessing various cytomorphologic features and identifying the features predictive of neoplasia. Using the standard morphologic criteria, we semi‐quantitatively assessed a total of 24 cytomorphologic features in 123 aspirates and recorded an overall interpretation on completion of the review. Cyto‐histologic correlation was evaluated and logistic regression model was performed to identify cytomorphologic features predictive of neoplasia. Although 32 of 123 aspirates remained in the indeterminate category, the retrospective review reclassified 64 aspirates as non‐neoplasia and 27 aspirates as neoplasia. Histologic confirmation was achieved in 47 (73.4%) non‐neoplastic and 15 (55.6%) neoplastic aspirates with a diagnostic accuracy of 68.1%. Furthermore, our analysis demonstrated that neoplasia is positively associated with the presence of syncytial tissue fragments, isolated microfollicles, follicles with scalloped borders, scant cytoplasm, irregular nuclear membranes, nuclear overlapping, coarse chromatin, and increased cellularity. On the contrary, the presence of honeycombing tissue fragments, background colloid, and histiocytes inversely correlated with neoplasia. Overall, using proposed standard morphological criteria can minimize the diagnosis of “follicular lesion of undetermined significance,” and allow for more accurate cyto‐histologic correlation, and thereby playing a substantial role in reducing unnecessary surgical intervention.     The application of immunocytochemistry to direct smears in the diagnosis of effusions

    Metastatic malignancy represents a common cause of effusions. Immunocytochemistry (ICC) is useful in confirming malignancy and gaining insight into the site of origin. Cell blocks are commonly utilized for this purpose; nonetheless, when the malignant cells are sparse, they may not be represented in cell blocks thereby precluding immunophenotypic characterization. Thus, we sought to investigate the utility of direct smear preparations as a platform for ICC in the diagnosis of effusions. Air‐dried, unstained direct smears were prepared from 49 malignant effusions and 17 reactive effusions for comparison. ICC for EMA and MOC‐31 highlighted the tumor cells in 91 and 98% of the malignant effusions tested, respectively. EMA immunoreactivity was focally observed within the calretinin‐positive mesothelial cell population in 1 (6%) of the 17 reactive effusions. ICC for MOC‐31 was negative in all reactive effusions. Site‐specific immunomarkers were also evaluated. Immunoreactivity for Napsin‐A and TTF‐1 were observed in 78 and 67% of metastatic lung adenocarcinomas, respectively. ICC for PAX8 highlighted metastatic MĂŒllerian and thyroid carcinomas in 100% of cases tested. CDX‐2 immunoreactivity was observed in 25, 60, and 100% of metastatic gastric, pancreatic, and colorectal adenocarcinomas, respectively. Positivity for p63 was observed in 75% of metastatic urothelial cell carcinomas and the one case of pulmonary squamous cell carcinoma examined. Calretinin ICC highlighted the tumor cells in both malignant mesothelioma cases tested as well as the benign mesothelial cells in the reactive effusions. In conclusion, direct smears represent an effective platform for the performance of ICC in the diagnosis of malignant effusions. Diagn.     Using soil temperature and moisture to predict forest soil nitrogen mineralization.

    Abstract Due to the importance of N in forest productivity ecosystem and nutrient cycling research often includes measurement of soil N transformation rates as indices of potential availability and ecosystem losses of N. We examined the feasibility of using soil temperature and moisture content to predict soil N mineralization rates (Nmin) at the Coweeta Hydrologic Laboratory in the southern Appalachians. We conducted seasonal laboratory incubations of A and AB horizon soils from three sites with mixed-oak vegetation using temperature and moisture levels characteristic of the season in which the soils were collected. The incubations showed that temperature and temperature-moisture interactions significantly affected net soil Nmin. We used the laboratory data to generate equations relating net Nmin to soil temperature and moisture data. Using field-collected temperature and moisture data we then calculated Nmin on similar forest sites and compared predicted rates with in situ, closed-core Nmin measurements. The comparison showed that the in situ Nmin was greater than rates predicted from laboratory generated equations (slope =3.22; r 2 =0.89). Our study suggests that while climatic factors have a significant effect on soil Nmin, other factors also influence rates measured in the laboratory and in situ
