    Licenced to Thrive? Podcasting and Copyright Law in Canada

    This article examines podcasting and its specific characteristics to see, first, where it fits within Canada’s copyright law, and second, how the licensing regime for musical works in Canada applies to podcasting. The discussion next turns to whether or not the current licensing regime for podcasting is desirable in light of the purpose of copyright in Canada, and with a view to the various interests at stake: those of artists, in being paid, and those of society, in enabling podcasters to access material in order to produce their work. An examination of the current and proposed licensing regime and its implications leads to the conclusion that it is not very feasible for amateur or non-commercial podcasters to operate legally in Canada if they use musical content, and that at the very least, podcasting should be covered by different tariffs than commercial Internet broadcasters or download services. The paper then goes on to explore suggestions that have been made to better serve the interests of rights holders, while also allowing more inexpensive access to users — the people who consume (listen to or watch) podcasts — in the online environment

    Election by Lot and the Democratic Diarchy

    This thesis argues that ‘democracy’ can better be understood in terms of a conceptual diarchy of ‘isonomia’ (equal political rights) and ‘isegoria’ (equal speech rights), rather than the conventional diarchy of ‘will’ and ‘opinion’ that originated in the era of absolute monarchy. As the proposed diarchy has its origin in classical Greece, the thesis starts with a brief overview of the institutional changes in sixth-, fifth- and fourth-century Athenian democracy that implemented the distinction in different ways, and examines some of its dysfunctions. The particular aspect of Athenian democracy under focus is sortition – the random selection of citizens for public office – viewed in antiquity as democratic, whereas election was viewed as an aristocratic or oligarchic selection mechanism. The thesis takes issue with Bernard Manin’s claim that the ‘triumph of election’ was on account of the natural right theory of consent, arguing that sortition-based proxy representation is a better way of indicating (hypothetical) consent than preference election. The thesis then seeks to clarify the concept(s) of representation – essential to the implementation of the democratic diarchy in modern large-scale societies – and to study how the diarchy has been reincarnated in modern representative democracies, along with an examination of the pathologies thereof. Consideration is given as to what the deliberative style of assemblies selected by lot should be, alongside evaluation of the epistemic potential of cognitive diversity and the ‘wisdom of crowds’. Given the need for both isonomia and isegoria to assume a representative form in large modern states, Michael Saward’s Representative Claim is adopted as a theoretical model to extend the reach of political representation beyond elections. The thesis concludes with tentative proposals as to how the fourth-century reforms (delegation of the final lawmaking decision to randomly-selected nomothetic courts) might be used as a template for modern institutions to resolve some of the problems of mass democracy

    Susceptibility and response to infectious disease is, in part, heritable. Initial attempts to identify the causal genetic polymorphisms have not been entirely successful because of the complexity of the genetic, epigenetic, and environmental factors that influence susceptibility and response to infectious disease and because of flaws in study design. Potential associations between clinical outcome from sepsis and many inflammatory cytokine gene polymorphisms, innate immunity pathway gene polymorphisms, and coagulation cascade polymorphisms have been observed. Confirmation in large, well conducted, multicenter studies is required to confirm current findings and to make them clinically applicable. Unbiased investigation of all genes in the human genome is an emerging approach. New, economical, high-throughput technologies may make this possible. It is now feasible to genotype thousands of tag single nucleotide polymorphisms across the genome in thousands of patients, thus addressing the issues of small sample size and bias in selecting candidate polymorphisms and genes for genetic association studies. By performing genome-wide association studies, genome-wide scans of nonsynonymous single nucleotide polymorphisms, and testing for differential allelic expression and copy number polymorphisms, we may yet be able to tease out the complex influence of genetic variation on susceptibility and response to infectious disease

    Comparing visions for CAP reforms post 2015: Farmer intentions and farm bio-economic modelling

    This paper illustrates the impacts of two of the potential CAP reform post 2015 scenarios using an optimising farm level model and compares results with farmers’ perception about the policy changes, captured in a farmer intentions survey. The model results suggest that beef farms suffer a loss in farm net margins under fully decoupled (up to -21%) as well as under partially decoupled scenario (up to -19%) compared to current historical single farm payments. The model also shows that farm respond by reducing the number of beef animals on farm by up to 5%. However, under a partial decoupled scenario, beef farms increase calf numbers by 15% to benefit from coupled calf payment. A survey of 1,400 beef producers with respect to their intentions toward 2020 was conducted in the Summer of 2013. A set of hypothetical payment scenarios was used to test self-reported response to a number of scenarios related to expanding and extensifying. These were compared with the modelling results and found a range of responses which could, we argue, be used for future calibration and ‘sense-checking’ of results within future modelling strategies

    Agri-environmental diversification: Linking environmental, forestry and renewable energy engagement on Scottish farms

    AbstractIn this paper we broaden the debate on agri-environmental scheme participation to include farm woodland expansion and renewable energy production, developing a conceptualisation of ‘agri-environmental diversification’. Utilising structural equation modelling, we assess a telephone survey of 2416 Scottish farmers, undertaken in 2013. Findings demonstrate the path dependencies of farming participants, with those already engaged in each of these activities the most likely to plan to be involved in future. Similar factors have influenced the uptake of all three activities since 2005, and intention to increase involvement by 2020. Farmers who are: younger, better educated, information-seeking, certified as organic, receive subsidies, have non-farming income and plan to continue farming in the medium term, are more likely to plan for future engagement in the three activities. Environmental attitudes are also important, but a stronger relationship was found between observation of environmental gains from agri-environmental schemes and the three forms of agri-environmental diversification, suggesting that scheme involvement enables farmers to learn to produce, recognise and value environmental goods. We argue that when assessed within the broader perspective of agri-environmental diversification, agri-environmental scheme participation may represent an initial step on a farming trajectory that involves multiple forms of agri-environmental engagement

    The IUCN Red List of Ecosystems: motivations, challenges, and applications

    Abstract In response to growing demand for ecosystem-level risk assessment in biodiversity conservation, and rapid proliferation of locally tailored protocols, the IUCN recently endorsed new Red List criteria as a global standard for ecosystem risk assessment. Four qualities were sought in the design of the IUCN criteria: generality; precision; realism; and simplicity. Drawing from extensive global consultation, we explore trade-offs among these qualities when dealing with key challenges, including ecosystem classification, measuring ecosystem dynamics, degradation and collapse, and setting decision thresholds to delimit ordinal categories of threat. Experience from countries with national lists of threatened ecosystems demonstrates well-balanced trade-offs in current and potential applications of Red Lists of Ecosystems in legislation, policy, environmental management and education. The IUCN Red List of Ecosystems should be judged by whether it achieves conservation ends and improves natural resource management, whether its limitations are outweighed by its benefits, and whether it performs better than alternative methods. Future development of the Red List of Ecosystems will benefit from the history of the Red List of Threatened Species which was trialed and adjusted iteratively over 50 years from rudimentary beginnings. We anticipate the Red List of Ecosystems will promote policy focus on conservation outcomes in situ across whole landscapes and seascapes
