    Chimpanzee Rights: The Philosophers' Brief

    In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons.     Empty spaces and the value of symbols: Estonia's 'war of monuments' from another angle

    Taking as its point of departure the recent heightened discussion surrounding publicly sited monuments in Estonia, this article investigates the issue from the perspective of the country's eastern border city of Narva, focusing especially upon the restoration in 2000 of a 'Swedish Lion' monument to mark the 300th anniversary of Sweden's victory over Russia at the first Battle of Narva. This commemoration is characterised here as a successful local negotiation of a potentially divisive past, as are subsequent commemorations of the Russian conquest of Narva in 1704. A recent proposal to erect a statue of Peter the Great in the city, however, briefly threatened to open a new front in Estonia's ongoing 'war of monuments'. Through a discussion of these episodes, the article seeks to link the Narva case to broader conceptual issues of identity politics, nationalism and post-communist transition

    Unequally egalitarian? Defending the credentials of social egalitarianism

    In his new book, Luck Egalitarianism, Kasper Lippert-Rasmussen responds to challenges raised by social egalitarians against luck egalitarianism. Social egalitarianism is the view according to which a just society is one where people relate to each other as equals, while the basic premise of luck egalitarianism is that it is unfair if people are worse-off than others through no fault or choice of their own. Lippert-Rasmussen argues that the most important objections to luck egalitarianism made by social egalitarians can either be largely accommodated by luck egalitarians or lack the argumentative force that its proponents believe them to have. While Lippert-Rasmussen does offer a version of luck egalitarianism that seems to avoid some of the main lines of criticism, he mischaracterizes parts of both the form and the content of the disagreement, and thus ultimately misses the mark. In this paper, we provide a substantive, a methodological and a political defense of social egalitarianism by elaborating on this mischaracterization. More work must be done, we argue, if social egalitarianism is to be dismissed and its concerns genuinely incorporated in the luck egalitarian framework. Until this is done, the supposed theoretical superiority of luck egalitarianism remains contested

    Political mobilisation by minorities in Britain: negative feedback of ‘race relations'?

    This article uses a political opportunity approach to study the relationship of minority groups to the political community in Britain. The main argument is that the British race relations approach established in the 1960s had an important effect that still shapes the patterns of political contention by different minority groups today. Original data on political claims-making by minorities demonstrate that British 'racialised' cultural pluralism has structured an inequality of opportunities for the two main groups, African-Caribbeans and Indian subcontinent minorities. African-Caribbeans mobilise along racial lines, use a strongly assimilative 'black' identity, conventional action forms, and target state institutions with demands for justice that are framed within the recognised framework of race relations. Conversely, a high proportion of the Indian subcontinent minority mobilisation is by Muslim groups, a non-assimilative religious identity. These are autonomously organised, but largely make public demands for extending the principle of racial equality to their non-racial group. Within the Indian subcontinent minorities, the relative absence of mobilisation by Indian, Sikh and Hindu minorities, who have achieved much better levels of socio-economic success than Pakistani and Bangladeshi Muslims, suggests that there is also a strong socioeconomic basis for shared experiences and grievances as Muslims in Britain. This relativises the notion that Muslim mobilisation is Britain is purely an expression of the right for cultural difference per se, and sees it as a product of the paradoxes of British race relations

    Toward International Animal Rights

    The chapter starts from the observation that while animal welfare is increasingly protected in domestic jurisdictions, animal rights are still hardly recognised, although they would serve animals better. It argues that animal rights would need to be universalised in order to deploy effects in a globalised setting. The international legal order is flexible and receptive to non-human personhood which goes with rights. Also, the historical experience with international human rights encourages the animal rights project, because it shows how similar conceptual and normative difficulties have been overcome. Animal rights would complement human rights not the least because the entrenchment of the species hierarchy as manifest in the denial of animal rights in the extreme case condones disrespect for the rights of humans themselves

    Community based rehabilitation: a strategy for peace-building

    BACKGROUND: Certain features of peace-building distinguish it from peacekeeping, and make it an appropriate strategy in dealing with vertical conflict and low intensity conflict. However, some theorists suggest that attempts, through peace-building, to impose liberal values upon non-democratic cultures are misguided and lack an ethical basis. DISCUSSION: We have been investigating the peace-building properties of community based approaches to disability in a number of countries. This paper describes the practice and impact of peace-building through Community Based Rehabilitation (CBR) strategies in the context of armed conflict. The ethical basis for peace-building through practical community initiatives is explored. A number of benefits and challenges to using CBR strategies for peace-building purposes are identified. SUMMARY: During post-conflict reconstruction, disability is a powerful emotive lever that can be used to mobilize cooperation between factions. We suggest that civil society, in contrast to state-level intervention, has a valuable role in reducing the risks of conflict through community initiatives

    Language motivation in a reconfigured Europe: access, identity, autonomy

    In this paper, I propose that we need to develop an appropriate set of conceptual tools for examining motivational issues pertaining to linguistic diversity, mobility and social integration in a rapidly changing and expanding Europe. I begin by drawing on research that has begun to reframe the concept of integrative motivation in the context of theories of self and identity. Expanding the notion of identity, I discuss the contribution of the Council of Europe's European Language Portfolio in promoting a view of motivation as the development of a plurilingual European identity and the enabling of access and mobility across a multilingual Europe. Next, I critically examine the assumption that the individual pursuit of a plurilingual identity is unproblematic, by highlighting the social context in which motivation and identity are constructed and embedded. To illuminate the role of this social context, I explore three inter-related theoretical frameworks: poststructuralist perspectives on language motivation as 'investment'; sociocultural theory; and theories of autonomy in language education. I conclude with the key message that, as with autonomy, language motivation today has an inescapably political dimension of which we need to take greater account in our research and pedagogical practice

    The Ethnic 'Other' in Ukrainian History Textbooks: The Case of Russia and the Russians

    This paper examines portrayals of Russia and the Russians in two generations of Ukrainian history textbooks. It observes that the textbooks are highly condemning of Ukraine's main ethnic other in the guise of foreign ruler: the tsarist authorities and the Soviet regime are always attributed dubious and malicious intentions even if there is appreciation for some of their policies. By contrast, the books, certainly those of the second generation, refrain from presenting highly biased accounts of the ethnic other as a national group (i.e. Russians). Instances where negative judgements do fall onto Russians are counterbalanced by excerpts criticizing ethnic Ukrainians or highlighting conflicting interests within the Ukrainian ethnic group. The negative appraisal of the ethnic other as foreign ruler is clearly instrumental for the nation-building project as it sustains a discourse legitimating the existence of Ukraine as independent state. However, recent trends in history education, the paper concludes, suggest that the importance of nurturing patriotism as a national policy objective is diminishing
