    Jerome Frank’s Attack on the “Myth” of Legal Certainty

    One of the significant contributions of contemporary American legal realism has been the discussion of the origins, purpose, and efficacy of legal rules. Some writers have been extremely critical of the worship of legal rules and of the feeling by the lay public that rules can provide exactness and certainty in the law. Jerome Frank has been the most noteworthy exponent of this view, particularly in his pioneer book, Law and the Modern Mind, published in 1930. Frank would be the last person to deny the existence and the utility of legal rules. Yet, his attack on those writers who see only the legal rules and nothing else as law (especially the late Professor Joseph Beale) has led some writers to believe that Frank wanted a legal system that operated on a purely pragmatic basis. Frank fervently denies this accusation and says that men like Gray, Wigmore, and Judge Cuthbert Pound expressed similar doubts about the prediction value of legal rules and precedents

    Proportional assessment of X and Y chromosome-bearing spermatozoa in bull and boar ejaculates using conventional and real-time PCR techniques

    ï»żConsiderable variation in the percentage of Y-chromosome bearing spermatozoa (%Y-CBS) between ejaculates in the same male has been reported. Collection regime has been speculated to influence the degree of variation in %Y-CBS in bull ejaculates (Chandler et al., 1998). Experiments were designed to evaluate the effects of two collection regimes on %Y-CBS. Conventional PCR combined with gel electrophoresis and image analysis was employed to determine %Y-CBS in ejaculates from two bulls collected on 7-day intervals and two bulls on 21-day intervals. Real-time PCR technology was used to quantify %Y-CBS in the same ejaculates. Boar ejaculates were also analyzed with both techniques and compared to the percent male piglets in litters resulting from the assayed ejaculates. Collection day (P\u3c0.0001) significantly affected %Y-CBS as determined by both PCR methods. Ejaculate nested within bull (P\u3c0.07) was significant in the conventional PCR study and collection frequency (P\u3c0.0001) in the realtime PCR trial. Ejaculate nested within boar was highly significant (P\u3c0.0001) for both technologies. Boar was significant (P\u3c0.002) in the conventional PCR study. Predicted %Y-CBS determined by real-time PCR was significantly correlated (0.52, P=0.004) to percent male piglets. Both PCR techniques were effective in quantifying the variation in %Y-CBS in bull and boar ejaculates. Manipulation of %Y-CBS via collection regime may prove valuable for altering the secondary sex ratio in animal agriculture

    Cellular tracking in time-lapse phase contrast images

    The quantitative analysis of live cells is a key issue in evaluating biological processes. The current clinical practice involves the application of a tedious and time consuming manual tracking procedure on large amount of data. As a result, automatic tracking systems are currently developed and evaluated. However, problems caused by cellular division, agglomeration, Brownian motion and topology changes are difficult issues that have to be accommodated by automatic tracking techniques. In this paper, we detail the development of a fully automated multi-target tracking system that is able to deal with Brownian motion and cellular division. During the tracking process our approach includes the neighbourhood relationship and motion history to enforce the cellular tracking continuity in the spatial and temporal domain. The experimental results reported in this paper indicate that our method is able to accurately track cellular structures in time-lapse data

    Familial and peer influences on sport participation among adolescents in rural South African secondary schools

    This study was designed to investigate the influences of family and peers on sport participation amongst adolescents in secondary schools at Hlanganani rural area of Limpopo Province, South Africa. A total of 172 learners (108 females and 64 males) attending three public secondary schools in Hlanganani rural area volunteered to participate in the study. Results indicated that adolescents preferred peers to family for support in sport participation. In terms of gender, no significant differences (p>0.05) were noted between mean values for school boys and girls with regard to family influence. Boys reported more tangible support, whereas girls indicated a preference for emotional support. Sport participation among learners is likely to increase when they receive informational, tangible, emotional and appraisal support from their parents and peers
