The Accommodation of Customary Law to Islamic Law: Distribution of Inheritance in Aceh from a Pluralism Perspectives
With the emergence of receptie theory, there was a conflict between customary laws and Islamic law in the past, resulting in a protracted systemic conflict. However, the opposite occurs in the context of legal practices in Aceh, namely the accommodation of the two legal systems. This study aims to elucidate the incorporation of customary laws in Islamic law as it pertains to inheritance issues in Aceh. This study analyzes empirical legal research through the lens of legal pluralism. The data was gathered through in-depth interviews and literature reviews. This study found that various inheritance-related cases involving substitute successors, joint assets, heirs of different religions, and obligatory wills for adopted children are examples of how Islamic law accommodates customary laws. The two factors responsible for the accommodation of adat in Islamic law are the nature of the law, which is dynamic, elastic, and flexible, and the sociological condition and personality of the Acehnese, which support this integration. Moreover, this accommodation has a positive impact on the lives of people so that the maintenance and observance of adat or customs become firmer, the law functions as social control and Islamic law is cultivated in society. Theoretically, in the context of legal pluralism, accommodation between adat in Islamic law creates a space for harmonization as the main goal of this theory, not the theory of receptie which gives birth to conflicts and conflicts between legal systems
SANKSI KEBIRI DALAM PERSPEKTIF HUKUM ISLAM DAN HUKUM PIDANA INDONESIA
This research raises the problem; (1). How is the determination of the sanction of the law that is applied in the Government Regulation Substitute Law (PERPPU) No. 1 of 2016 according to the perspective of Islamic Law, (2). How is the determination of the sanction of the law that is stipulated in the Government Regulation in Lieu of Law (PERPPU) No. 1 of 2016 according to the perspective of Indonesian Criminal Law. This research is a normative legal research with normative juridical approach to trace the legal basis, be it in Islamic law or Criminal Law of Indonesia especially related to sanction of kebiri, method of collecting data using library method, after data collected and then analyzed and interpreted by using deduc- tive method that is to draw general facts to make facts or conclusions gained previously into something special. The results of this study conclude that; (1). In the perspective of Islamic Law, chemical punishment is categorized as a punishment that has a minimum and maximum restriction determined by the judge, so it can be classified as a ta’zir punishment. (2). According to the Indonesian Criminal Law perspective, the determination of the sanction of kebiri aims to safeguard the welfare of the Indonesian people from the pedophile actors, to give a deterrent effect and as a form of responsibility towards the law of the perpetrators
Kewenangan Pemerintah Daerah dalam Penyelesaian Sengketa Tanah
ABSTRAK. Tulisan ini dimaksudkan untuk mengidentifikasi, menjelaskan dan menganalisis ketentuan perundang-undangan yang mengatur kewenangan pemerintah daerah dalam penyelesaian sengketa tanah. Untuk mendapatkan data bagi kepentingan penulisan ini dilakukan penelitian kepustakaan, dengan cara menelaah ketentuan perundang-undangan dan literatur yang relevan. Hasil penelitian menunjukkan bahwa ketentuan yang secara khusus menentukan kewenangan pemerintah daerah dalam bidang penyelesaian sengketa tanah terdapat dalam Keppres Nomor 34 Tahun 2003 tentang Kebijakan Nasional Dibidang Pertanahan dan dalam Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah. Berdasarkan ketentuan tersebut pemerintah daerah berwenang; (a) penyelesaian sengketa tanah garapan; (b) penyelesaian masalah ganti kerugian dan santunan tanah untuk pembangunan; (c) penyelesaian masalah tanah ulayat; dan (d) penyelesaian masalah tanah kosong.
The Authority of Legal Government in Solving Land Dispute
ABSTRACT. This research aims to identify, explain and analyse the rules regulating the authority of local government in settling land dispute. In order obtain data library research is conducted by exploring relevant rules and literatures. The research shows that the special rule regulating the authority of local government in settling land dispute ruled in the Presidential Decree Number 34, 2003 on National Policy on Land and the Act Number 23, 2014 on Local Government. Based on these, the local government is eligible to: (a) settling the cultivating land, (b) reparation and remedy for land used for the development, (c) customary land dispute, and (d) unoccupted land

REKONSEPTUALISASI HAK ATAS TANAH DALAM KERANGKA PEMBAHARUAN HUKUM TANAH NASIONAL
This paper is going to discuss the sorts of land rights recognized by laws and the implementation of such rights and recopceptualisation related to the land reform program. Library and field researches are conducted to obtain the data. Library research is conducted by exploring the relevant laws and literatures while field research is conducted by interviewing relevant informants. The research shows that there are about 13 rights of the land that can be found in the regulations. Most of the rights on land is based on customary law which has communal concept. However, amongst such rights in the implementation still faces unjust in dividing its benefit, there is a tendency to increase the gap in owning the land and to disobey the need of housing that more complex in the limited number of it; hence the reconceptualisation is required for the rights. Untuk mendapatkan data bagi kepentingan penulisan ini dilakukan penelitian kepustakaan dan penelitian lapangan. Penelitian kepustakaan dilakukan dengan cara menelaah ketentuan perundang-undangan dan literatur yang relevan, sedangkan penelitian lapangan dilakukan dengan cara mewawancarai para nara sumber yang terkait. Hasil penelitian menunjukkan bahwa paling tidak terdapat 13 (tiga belas) macam hak atas tanah yang terdapat pengaturannya dalam ketentuan perundang-undangan. Sebagian besar hak-hak atas tanah tersebut bersumberkan pada hukum adat yang berkonsepsi kumunalistik. Namun diantara hak-hak atas tanah tersebut dalam pelaksanaannya ada yang masih mengandung unsur pemerasan, cenderung semakin meningkatkan ketimpangan dalam penguasaan tanah dan cenderung tidak dapat mengakomodir kebutuhan tanah yang semakin komplek dalam keterbatasan ketersediaannya, karena itu diperlukan rekonseptualisasi hak-hak atas tanah.Kata kunci: Rekonseptualisasi; Hak Atas Tanah; Pembaharuan Huku
