FORMULATIF POLICY REMEDIES INDEPENDENT DECISION OF PUBLIC PROSECUTOR FOR PERSPECTIVE IN THE CRIMINAL JUSTICE SYSTEM OF INDONESIA

ABSTRACTThis dissertation is a research of acquital (vrijspraak)in some criminal cases that were made by the judge, and related with the law effort of appellate and cassation. Due process of law in criminal justice of Indonesia tends to be notgiving satisfaction for the justice seekers. The many amount of criminal casesthat get acquital (vrijspraak) such as the cases of corruption, narcotic, murder, and others got opinion and contra from broad society. The practitioners andtheoreticians of law and so does the justice seekers often spotlight the judge’sverdict which is judged as the engineering of justice, full of mafia andfraudulence. The Procedure of Criminal of Indonesia based on the Criminal Code stills seem to contain disharmony of law norms such as not to give the authority to general prosecutor to submit law effort of appellate and cassation upon the acquital (vrijspraak) as written in the Article 67 and Article 244 of Criminal Code, so it creates the disharmony or injustice in the existing law norms about the acquital (vrijspraak) arrangement, it seems that there is an empty norm, even there is a blur norm in the procedure of criminal with Criminal Code as the basis. This research has purpose to give solution upon disharmony that happen in the acquital (vrijspraak) and its law effort for the general prosecutor. Beside that, it also gives a scientifically input for the theoreticians and practitioners. In studying of this acquital (vrijspraak), it uses some approaches, such as the statute approach, the analytical and conceptual approach, the case approach, the comparative approach, and the philosophical approach. The source of the researched law materials related with the primary, secondary, and tertiary law material. The future perspective of acquital (vrijspraak) arrangement construction related to appellate is: “To criminal case verdict given in the first stage court, the defendant or the general prosecutor is able and or has authority to submit the appellate request to the high court including for free verdictâ€. And the construction of article for acquital (vrijspraak) for cassation is: “To the criminal case verdict given in the last stage by other court except the Supreme Court, the defendant or general prosecutor is able and or has authority to submit the request for cassation to the Supreme Court including the acquital (vrijspraak)â€.Key words: formulation policy, acquital, procecutor, criminal justice system

TEACHER’S EXPERIENCES OF ONLINE ASSESSMENT IMPLEMENTATION IN TEACHING ENGLISH

This study aimed to identify the experience of teachers in implementing online assessments in the process of teaching and learning English at SMK TI Bali Global Singaraja. This study was designed using a descriptive qualitative research method. The data were collected by interview documentation and also observation. This study used the technique of analyzing the data Miles and Huberman Data Analysis which has three phases; (1) data condensation or data reduction, (2) data display (3) drawing and conclusion verification. The results of this study indicated that the English teacher has implemented online assessment through several platforms such as Google Classroom, Instagram, and also lmssmkti.com as the main platform for assessing all skills in English. There were advantages, disadvantages, and difficulties faced by the teacher in implementing online assessment. The difficulties that could be obtained consist of technical and non-technical difficulties both from students and teachers such as internet constraints and teachers who had difficulty using the online assessment platform for the first time, besides many students complained about difficulties using platforms for online assessments. This research was expected to be useful for future researchers in carrying out similar research with different method, instruments and also samples

PENGARUH HUKUM DIKELUARKANNYA KEPUTUSAN PESAMUHAN AGUNG III MUDP BALI TAHUN 2010 TERKAIT PEREMPUAN HINDU BERHAK MEWARIS TERHADAP PERKEMBANGAN HUKUM ADAT BALI

Keputusan Pesamuhan Agung III MUDP Bali Tahun 2010 memberikan harapan bagi perempuan hindu terhadap kedudukan dalam mewaris di dalam keluarganya, akan tetapi perlu dikaji lebih dalam mengenai Keputusan Pesamuhan Agung III MUDP Bali Tahun 2010 tersebut berpengaruh atau tidak terhadap perkembangan hukum adat di Bali. Metode penelitian yang digunakan adalah yuridis normatif. Hasil penelitian bahwa tidak ada pengaruh hukum yang ditimbulkan dari Keputusan Pesamuhan Agung III MUDP Bali Tahun 2010 tentang perempuan hindu berhak mewaris, hal ini terlihat pada penelitian-penelitian sebelumnya. Terbukti tidak adanya desa adat yang mengkodifikasikannya dalam awig-awig desa adat di Bali. Isi awig-awig desa adat merupakan suatu kebiasaan- kebiasan yang turun-temurun dilakukan oleh desa adat. Kebiasaan yang dilakukan desa adat di Bali mengenai perempuan hindu berhak atas warisan saat ini belum ada, karena Keputusan Pesamuhan Agung III MUDP Bali terkait perempuan hindu berhak mewaris merupakan didasarkan atas suatu terobosan hukum. Namun sebelum aturan hukum dibuat, melainkan harus melihat perilaku sesuai dengan kenyataan yang ada di masyarakat atau hukum yang hidup di dalam masyarakat

PENGENDALIAN PEREDARAN GELAP NARKOTIKA OLEH NARAPIDANA DARI DALAM LEMBAGA PEMASYARAKATAN (LAPAS)

Drug smuggling by high and sophisticated operation mode recently was able reach the prisoner which is as society prison status. Law enforcement officer especially the police in conducted their function as law enforcement to the prisoner that involved in drug smuggling, in disclosure and sttlement their case (investigation step) did not easy because the prisoner was a society in prison encironment. There are two problem in this research : 1. why the conected and correlated of the legal system for drug ? 2. Why the drug smuggling is high operation by the prisoner which is as society prison status and to up from in the prison ? The result of this research show that the law enforcement to the doer drug smuggling by the law enforcer. Should faced ethic code profesion society, there for it was impossible for the law the optimize of law enforcement by law enforcer to the doer of drug smuggling in prisoner society such as intern and extern efforts, where the intern effort include increase the coordination function and cooperation between the law enforcement especially with the prison officers

Rekonstruksi Belanja Bantuan Sosial

Pemerintah memberikan bantuan sosial secara selektif kepada para penerima bantuan yang memenuhi kriteria risiko sosial. Dalam implementasinya, ternyata penerima bantuan tersebut dinilai tidak tepat sasaran.  Penerima bantuan yang sebenarnya (de facto) ditujukan kepada orang miskin atau tidak mampu, tetapi karena kendala dalam pelaksanaan, maka penyalurannya diserahkan melalui kelompok atau lembaga pemerintah maupun non-pemerintah. Mengingat lembaga ini tidak memenuhi kriteria risiko sosial, maka penyaluran bantuan sosial ini menjadi temuan aparat pemeriksa. Selanjutnya atas rekomendasi hasil pemeriksaan, maka bantuan sosial yang diberikan kepada penerima bantuan yang tidak memenuhi kriteria risiko sosial dialihkan ke dalam belanja barang yang diserahkan kepada pemerintah daerah/masyarakat. Pemisahan pemberian bantuan berdasarkan jenis belanja terkadang menyulitkan bagi para pelaksana pemberian bantuan pada Kementerian/Lembaga. Program pemberian bantuan terkadang tidak terlalu tegas membedakan kelompok miskin/tidak mampu, karena pada beberapa kegiatan bantuan lebih berorientasi pada pencapaian output dan outcome suatu program. Seharusnya, pemberian bantuan lebih memperhatikan penerima manfaat (beneficiary), dan bukan penerima bantuan. Selanjutnya atas hal tersebut, barulah ditentukan jenis belanja untuk menampung program bantuan tersebut. 

SISTEM PENGENDALIAN INTERNAL UNTUK NON-PERFORMING LOAN PADA LEMBAGA PERKREDITAN DESA (LPD) X

The study was conducted to improve the internal control system of LPD X in the credit process. The development of the LPD X increases the manager's responsibility and the increased risk of the LPD X. One of the risks in LPD X is the credit risk. With the credit process carried out at present the non-performing loan (NPL) value of LPD X in the last 3 years are 10.69%, 24.38%, and 26.64% (LPD X, 2017a). This study refers to research conducted by M. D. K. Dewi & Suryanawa (2015); Sarifah (2017) about the internal control system in LPDs. The theory used in this study is the accountability theory to look at LPD X accountability in credit procedures. The methodology used in the study is a case study to be able to examine the NPL phenomenon in LPD X more deeply and can provide an evaluation for LPD X management. Data collection is done by observation, document study, and interview. The results of this study indicate that the efforts made in handling credit collection conducted by LPD X have not been effective as stated in the comparison theory and company.Penelitian dilakukan untuk memperbaiki sistem pengendalian internal LPD X dalam proses kredit. Berkembangnya LPD X membuat meningkatnya tanggung jawab pengelola dan meningkatnya risiko yang dimiliki LPD X. Salah satu risiko di LPD X adalah risiko kredit. Dengan proses kredit yang dijalankan saat ini nilai non-performing loan (NPL) LPD X pada 3 tahun terakhir adalah 10,69%, 24,38%, dan 26.64% (LPD X, 2017a). Penelitian ini merujuk penelitian yang dilakukan oleh M. D. K. Dewi & Suryanawa (2015); Sarifah (2017) dan Sarifah (2017) tentang sistem pengendalian internal pada LPD. Teori yang digunakan dalam penelitian ini adalah accountability theory untuk melihat pertanggungjawaban LPD X dalam prosedur kredit. Metodelogi yang digunakan dalam penelitian adalah studi kasus untuk dapat meneliti fenomena NPL pada LPD X secara lebih dalam dan dapat memberikan evaluasi untuk manajemen LPD X. Pengumpulan data dilakukan dengan metode observasi, studi dokumen, dan interview. Hasil penelitian ini menunjukkan bahwa upaya yang dilakukan dalam penanganan penagihan kredit yang dilakukan LPD X belum efektif seperti yang dikemukakan pada teori dan perusahaan pembanding

Embracing the Evaporative System in Air Conditioning Technology for Efficient Cooling Solutions

The use of an air conditioning system requires large amounts of electrical energy to carry out repeated vapor compression cycles. The use of an evaporative cooling system in this research is by spraying condensate water on the condenser, which is one solution to absorb condenser heat. Another thing that can be done is to reset the fan speed on the condenser to cool it. Resetting the fan speed on the condenser can also help improve AC performance and reduce electrical energy use. The test was carried out by modifying the 1 Pk R-410a AC split condenser by installing 6 nozzles, 2 rows of 3 columns and a DC pump to spray water on the condenser. The independent variables of this research are spraying position and fan speed. The result obtained from the research is an increase in COP by 35% and a reduction in electrical power usage by 15% by using additional water spray with a nozzle behind the condenser both when blowing the full blower and when the blower blowing speed is reduced by 75%. "BERGOLO UYAK CORONA"

Covid -19 adalah sebuah virus yang menyerang sistem pernafasan yang mengakibatkan pneumonia akut bahkan sampai kematian. Corona virus atau Covid-19 pada awalnya ditemukan di kota Wuhan negara Cina pada akhir tahun 2019, dan menyebar ke seluruh dunia pada awal tahun 2020, dan dinyatakan sebagai pandemi oleh badan kesehatan dunia (WHO). Di Indonesia sendiri corona virus masuk pada pertengahan bulan februari 2020, dan sampai sekarang jumlah pasien positif terus bertambah. Sejauh ini pemerintah melalui Kemenkes R.I sudah mengeluarkan perarturan untuk menjaga jarak atau sosial distancing, selalu menggunakan masker jika berpergian ataupun sakit, dan selalu mencuci tangan dengan sabun atau hand sanitizer sehabis melakukan kontak dengan orang lain. Pemerintah juga menyuruh masyarakat untuk tetap tinggal di rumah begitu pula dengan murid, mahasiswa, pekerja kantoran, untuk tinggal dirumah. Sebagai penekun Desain Komunikasi Visual fenomena ini menjadi bahan untuk berkarya dalam masa pandemi, dimana Desain Komunikasi Visual juga memberikan informasi dan hiburan kepada masyarakat, dalam bentuk karya kartun. Karya kartun selalu membawa senyum bagi pembacanya, karena dalam kartun, humor selalu melekat didalamnya. PENGARUH PELATIHAN CALL THE NUMBER DRILL DAN THREE CHAIR DRILL TERHADAP KETERAMPILAN DRIBBLING BOLA BASKET

           The study aimed to determine (1) the effect of Made Or Run Drill training on shooting skills, (2) the effect of ten free throwing a row drill training on shooting skills, (3) differences in shooting skills between treatment groups made or run drill and ten free throws in a row drill. The sample of the study was 30 students of the SMAK TI Bali Global Singaraja basketball extracurricular students. This study uses a quasi-experimental method with the design of the modified pre-test-post-test group design. Data collection tests use the free throw shooting skill test. Data analysis uses t-test (t-test) statistical calculations at a significance level of 5%.            The results of data analysis (1) training made or run drill have an effect on Basketball shooting skills, with the results of thit = 5.850> ttab = 2.145, (2) ten free throws in row drill training affects Basketball shooting skills, with results thit = 4,610> ttab = 2,145, (3) there is no difference in effect between training made or run drill and ten free throws in a row drill on shooting skills, with the results of thit = 0,000 <ttab = 2,048. Training of made or run drill and ten free throws in a row drill both have an influence on shooting skills, judging from the theoretical foundation that says both training together improve shooting skills.            It was concluded that (1) there was the effect of training made or run drill on shooting skills, (2) there was the effect of ten free throws in a row drill training on shooting skills (3) there was no difference in effect between training made or run drill and ten free throws in a row drill for shooting skills.Penelitian bertujuan untuk mengetahui (1) pengaruh pelatihan Made Or Run Drill terhadap keterampilan shooting, (2) pengaruh pelatihan ten free throws in a row drill terhadap keterampilan shooting, (3) perbedaan keterampilan shooting antara kelompok perlakuan made or run drill dan ten free throws in a row drill. sampel penelitian adalah siswa ekstrakurikuler bola basket SMAK TI Bali Global Singaraja Singaraja berjumlah 30 orang. Penelitian ini menggunakan metode eksperimen semu dengan rancangan the modified pre-test – post-test group design. tes pengumpulan data menggunakan tes keterampilan shooting free throw. analisis data menggunakan perhitungan statistik uji-t (t-test) pada taraf signifikansi 5%. Hasil analisis data (1) pelatihan made or run drill berpengaruh terhadap keterampilan shooting Bola Basket, dengan hasil thit = 5,850 > ttab = 2,145, (2) pelatihan ten free throws in a row drill berpengaruh terhadap keterampilan shooting Bola Basket, dengan hasil thit = 4,610 > ttab = 2,145, (3) tidak terdapat perbedaan pengaruh antara pelatihan made or run drill dan ten free throws in a row drill terhadap keterampilan shooting, dengan hasil thit = 0,000 < ttab = 2,048. Pelatihan made or run drill dan ten free throws in a row drill sama-sama memberikan pengaruh terhadap keterampilan shooting, dilihat dari landasan teori yang mengatakan pelatihan keduanya sama-sama meningkatkan keterampilan shooting Disimpulkan bahwa (1) ada pengaruh pengaruh pelatihan made or run drill terhadap keterampilan shooting, (2) ada pengaruh pelatihan ten free throws in a row drill terhadap keterampilan shooting (3) tidak terdapat perbedaan pengaruh antara pelatihan made or run drill dan ten free throws in a row drill terhadap keterampilan shooting
