The paradox of dissent: judicial dissent and the projects of international criminal justice

Additional opinions — dissenting opinions, separate opinions, declarations, and permutations thereof — are a familiar, if sometimes controversial, aspect of the international jurisprudential landscape. Given that the controversy provoked by additional opinions focuses on their perceived impact on the authority of judgments and decisions of international tribunals, and even the authority of the institutions themselves, additional opinions go to the heart of the manner in, and effectiveness by, which international tribunals discharge their functions. Yet, particularly in the context of international criminal justice, additional opinions have often been overlooked as a subject of critical engagement in their own right. Therefore, the purpose of this article is bring into focus the practice of judicial dissent, that is, the expression of strongly held and fundamental disagreement by judges through the vehicle of the additional opinion, and to stimulate a wider critical engagement with dissentient judicial practice. Rather than providing a review of the orthodox and doctrinal arguments in favour and against the publication of additional opinions, this article offers a reading of five prominent examples of judicial dissent in international criminal law and suggests how this practice could be conceived from the perspective of the functions that international criminal adjudication is expected to serve

Act Number 4 of 2009 about Mineral and Coal Mining allows latitude in exploiting natural resources. However, the act tends to claim ‘resource used oriented law’. The purpose of this research is to devise whether Act Number 4 of 2009 about Mineral and Coal has accommodated the aspect of environmental’s protection and the principles of environmental’s management following Act Number 32 of 2009 about Environmental’s Protection and Management as known as UUPPLH, especially over licensing of mineral and coal as preventive juridical. This research is based on prescriptive analysis by descriptive and juridical normative approaches. A principle that is implemented in this research is the Principle of State Responsibility and Principle of Sustainable Development and Environmental Concept. The result of this research concludes that Act Number 4 of 2009 about Mineral and Coal Mining has not accommodated optimally yet regarding environmental’s protection over mineral and coal mining business. Based on this fact, mineral and coal mining projects cause pollution and environmental damages sustainably. Whereas, based on a substantial law system, the rule of the law normatively has autonomous force as an idea that determines public interest in economic and environmental aspects. The contribution of this research will be recommended to the development of environmental law and environmental sustainability

Landmine Impact Survey: Measurement and Display of Suspected Areas

The purpose of a Landmine Impact Survey (LIS) is to facilitate the prioritisation of human, material and financial resources supporting humanitarian mine action at the national, regional and global level. The LIS process provides a different approach by measuring the socioeconomic impact of landmines on affected communities. The global application of the LIS has successfully refocused attention away from a purely quantitative measurement of a mine and UXO threat to a qualitative assessment of impact on mine-affected communities

Preeclampsia is the second highest cause of maternal death in Indonesia. The incidence of preeclampsia in Indonesia is very high at 24%. West Java is a province in Indonesia with a high preeclampsia rate of 25%. Predisposing factors include preeclampsia including age. Health Research Data (2010) shows that the percentage of early marriage aged <20 years is still high at 46.7% and marriage age> 35 years at 0.6%. Objectives This study aims to determine the relationship between age and the incidence of preeclampsia at Dustira Hospital in Cimahi City. This study was conducted using the correlation with the case control approach. The population in this study was 130 postpartum mothers treated at Dustira Level II Hospital. The sampling technique used purposive sampling with a total of 24 for the preeclampsia group and 24 for the non-preeclampsia group. The data collected is secondary data collected by observing the medical record book. The research instrument uses a checklist sheet. The study was conducted in June 2019 at Dustira City II Kindergarten Hospital Cimahi. Univariate analysis uses frequency distribution and bivariate uses chi-square. Univariate test results showed that the incidence of preeclampsia was mostly experienced by pregnant women with age at risk of 58.3%. Bivariate test results showed a p value of 0.007 (α <0.05) and OR 7 (95% CI: 1.822-26.887) meaning that there was a relationship between age and the incidence of preeclampsia, and mothers with age at risk had 7 times greater occurrence of preeclampsia compared to age is not at risk. Pregnant women aged less than 20 years or more than 35 years are at high risk of experiencing preeclampsia. One of the efforts to prevent the occurrence of preeclampsia is through health promotion about the age of mothers who are safe to reproduce. It is expected that health workers, especially maternity nurses, can provide health services to the public regarding the ideal age for pregnancy or childbirth as well as the age at risk of preeclampsia.   Keywords: Indonesia, Maternal age pregnancies, Preeclampsi
