    The Sentencing of White-Collar Criminals in Federal Courts: A Socio-Legal Exploration of Disparity

    This Article addresses that question by examining judicial sentencing philosophy as applied to white-collar criminality and reporting data that illuminate the operation of that philosophy. Part I of the Article argues that the traditional purposes and limits of criminal sentencing may plausibly justify either disparate or comparable sentences in cases of white-collar and common criminality. Part II describes the obstacles to an accurate empirical inquiry into how judges resolve these uncertainties in the theory of punishment. Part III presents a study designed to overcome as many of these obstacles as possible. What is most dramatic is that the resulting data do not appear to support the oft-presumed hypothesis that judges impose lighter sentences on high-status individuals convicted of white-collar crimes than they impose on lower-status individuals convicted of common crimes.4 The data, however, suggest that a significantly increased emphasis on the prosecution of white-collar crimes may encourage sentencing disparities in favor of those convicted as a result. These findings form the Article\u27s conclusion and a foundation for further research

    MAT-758: CONSTRUCTABILITY BENEFITS OF THE USE OF LIGHTWEIGHT FOAMED CONCRETE FILL (LFCF) IN PAVEMENT APPLICATIONS

    Lightweight Foamed Concrete Fill (LFCF), also known as cellular concrete, has been growing in use in transportation infrastructure projects over recent years. LFCF is a versatile construction material that has now been in use for over 30 years. A number of recent road rehabilitation projects have demonstrated some of the benefits of use. With a greater emphasis on sustainability on all provincial and municipal road projects, new solutions are being sought to minimize the generation of waste and deliver better performing pavements that require less maintenance interventions. Roads over peat and organic deposits pose challenges for road agencies. They are subject to continual and long term settlements that necessitate frequent patch repairs. The downside of such repairs is that the additional weight of the new asphalt, triggers further settlement. Traditionally, permanent solutions have necessitated the total reconstruction of the road section and removal of the underlying organic layers. This is expensive, creates huge traffic disruptions, generates waste and consumes large volumes of aggregate for the reinstatement. The use of lightweight fill offers an alternative as it allows the pavement to be ‘floated’ above the organic layer. However, the traditional lightweight materials, such as polystyrene, have been prohibitively expensive for such applications. In recent years, LFCF has been successfully used as a cost effective solution in road works. LFCF is a foamed, pumpable, cementitious fill with a density of only 475 kg/m3, about a quarter of that of conventional granular fill. With a compressive strength of at least 0.5 MPa, it has sufficient strength to support pavement loads. However, the real advantages relate to constructability, since the material can be installed very quickly, minimizes excavation time, can be placed in winter and does not require conventional compaction or associated testing. This paper will provide an overview of the use of LFCF for road works, including typical specifications, quality control/assurance requirements, and performance based on a number of case study applications

    The Effect of Manipulating Subject Mass on Lower Extremity Torque Patterns During Locomotion

    During locomotion, humans adapt their motor patterns to maintain coordination despite changing conditions (Reisman et al., 2005). Bernstein (1967) proposed that in addition to the present state of a given joint, other factors, including limb inertia and velocity, must be taken into account to allow proper motion to occur. During locomotion with added mass counterbalanced using vertical suspension to maintain body weight, vertical ground reaction forces (GRF's) increase during walking but decrease during running, suggesting that adaptation may be velocity-specific (De Witt et al., 2006). It is not known, however, how lower extremity joint torques adapt to changes in inertial forces. The purpose of this investigation was to examine the effects of increasing body mass while maintaining body weight upon lower-limb joint torque during walking and running. We hypothesized that adaptations in joint torque patterns would occur with the addition of body mass

    The Effect of Increasing Inertia upon Vertical Ground Reaction Forces during Locomotion

    The addition of inertia to exercising astronauts could increase ground reaction forces and potentially provide a greater health benefit. However, conflicting results have been reported regarding the adaptations to additional mass (inertia) without additional net weight (gravitational force) during locomotion. We examined the effect of increasing inertia while maintaining net gravitational force on vertical ground reaction forces and kinematics during walking and running. Vertical ground reaction force was measured for ten healthy adults (5 male/5 female) during walking (1.34 m/s) and running (3.13 m/s) using a force-measuring treadmill. Subjects completed locomotion at normal weight and mass, and at 10, 20, 30, and 40% of added inertial force. The added gravitational force was relieved with overhead suspension, so that the net force between the subject and treadmill at rest remained equal to 100% body weight. Peak vertical impact forces and loading rates increased with increased inertia during walking, and decreased during running. As inertia increased, peak vertical propulsive forces decreased during walking and did not change during running. Stride time increased during walking and running, and contact time increased during running. Vertical ground reaction force production and adaptations in gait kinematics were different between walking and running. The increased inertial forces were utilized independently from gravitational forces by the motor control system when determining coordination strategies

    Akt substrate TBC1D1 regulates GLUT1 expression through the mTOR pathway in 3T3-L1 adipocytes

    Multiple studies have suggested that the protein kinase Akt/PKB (protein kinase B) is required for insulin-stimulated glucose transport in skeletal muscle and adipose cells. In an attempt to understand links between Akt activation and glucose transport regulation, we applied mass spectrometry-based proteomics and bioinformatics approaches to identify potential Akt substrates containing the phospho-Akt substrate motif RXRXXpS/T. The present study describes the identification of the Rab GAP (GTPase-activating protein)-domain containing protein TBC1D1 [TBC (Tre-2/Bub2/Cdc16) domain family, member 1], which is closely related to TBC1D4 [TBC domain family, member 4, also denoted AS160 (Akt substrate of 160 kDa)], as an Akt substrate that is phosphorylated at Thr(590). RNAi (RNA interference)-mediated silencing of TBC1D1 elevated basal deoxyglucose uptake by approx. 61% in 3T3-L1 mouse embryo adipocytes, while the suppression of TBC1D4 and RapGAP220 under the same conditions had little effect on basal and insulin-stimulated deoxyglucose uptake. Silencing of TBC1D1 strongly increased expression of the GLUT1 glucose transporter but not GLUT4 in cultured adipocytes, whereas the decrease in TBC1D4 had no effect. Remarkably, loss of TBC1D1 in 3T3-L1 adipocytes activated the mTOR (mammalian target of rapamycin)-p70 S6 protein kinase pathway, and the increase in GLUT1 expression in the cells treated with TBC1D1 siRNA (small interfering RNA) was blocked by the mTOR inhibitor rapamycin. Furthermore, overexpression of the mutant TBC1D1-T590A, lacking the putative Akt/PKB phosphorylation site, inhibited insulin stimulation of p70 S6 kinase phosphorylation at Thr(389), a phosphorylation induced by mTOR. Taken together, our data suggest that TBC1D1 may be involved in controlling GLUT1 glucose transporter expression through the mTOR-p70 S6 kinase pathway

    Seeing Crime and Punishment Through a Sociological Lens: Contributions, Practices, and the Future

    There is a rich intellectual history to the sociological study of crime and punishment that encompasses multiple and interrelated traditions. Some of these traditions trace their roots to the European social theorists of the nineteenth century, particularly Emile Durkheim, Max Weber, and Karl Marx. Although only Durkheim and Weber systematically studied law (and only Durkheim actually studied punishment), all three social theorists facilitated the development of sociological research and theory on crime and punishment. Durkheim\u27s Suicide: A Study in Sociology, for example, investigated the relationship between social integration and suicide rates, which, in turn, provided a model of inquiry for multiple generations of sociologists investigating the social causes of crime, delinquency, and social deviance. Similarly, Durkheim\u27s The Division of Labor in Society inspired sociologists to examine the relationship between social structure and the organization of law and punishment. Weber\u27s ideas concerning the rationalization of society and the legitimate bases of legal authority compelled sociologists to think comparatively and brought a historical dimension to sociological inquiry on law and punishment. Marxist sensibilities begat a small, but vibrant, industry of radical criminologists and sociologists of law and punishment who located both the causes and control of crime in the exploitation, injustice, and class conflict inherent in capitalist society

    A Single-Molecule Nanopore Device Detects DNA Polymerase Activity with Single-Nucleotide Resolution

    The ability to monitor DNA polymerase activity with single-nucleotide resolution has been the cornerstone of a number of advanced single-molecule DNA sequencing concepts. Toward this goal, we report the first spatially-resolved observation of DNA polymerase activity with single-base resolution at the single-molecule level. We describe the design and characterization of a single-species supramolecular nanopore device capable of detecting up to nine consecutive DNA polymerase-catalyzed single nucleotide primer extensions with high sensitivity and spatial resolution (≤ 2.4 Å). The device is assembled in a suspended lipid membrane by threading and mechanically capturing a single strand of DNA-PEG copolymer inside an α-hemolysin protein pore. Single nucleotide primer extensions result in successive displacements of the template DNA strand within the protein pore, which can be monitored by the corresponding stepped changes in the ion current flowing through the pore under an applied transmembrane potential. The system described thus represents a promising advance toward nanopore-mediated single-molecule DNA sequencing concept, and in addition might be applicable to studying a number of other biopolymer-protein interactions and dynamics

    Inequality and violent crime: evidence from data on robbery and violent theft

    This article argues that the link between income inequality and violent property crime might be spurious, complementing a similar argument in prior analysis by the author on the determinants of homicide. In contrast, Fajnzylber, Lederman & Loayza (1998; 2002a, b) provide seemingly strong and robust evidence that inequality causes a higher rate of both homicide and robbery/violent theft even after controlling for country-specific fixed effects. Our results suggest that inequality is not a statistically significant determinant, unless either country-specific effects are not controlled for or the sample is artificially restricted to a small number of countries. The reason why the link between inequality and violent property crime might be spurious is that income inequality is likely to be strongly correlated with country-specific fixed effects such as cultural differences. A high degree of inequality might be socially undesirable for any number of reasons, but that it causes violent crime is far from proven
