The TFEU is not defining competition. The definition we propose is: A policy bound to: detect and deter cartels; avoid mergers leading to abuse of dominant position, control and prohibit State aid, promote liberalisations. This definitions contains the mail elements of the liberal theory of competition. The paper explores them: entry freedom, competition order, state aids and cartels. Liberalizations are strictly linked to Einaudi’s concept of “juridical possibility of having competition”. The third Gas Directive represents an example of this “juridical possibility”. Progresses in its application have been small. Furthermore the crisis has produced a sort of euro-sclerosis of the liberalization process. The revitalization of liberalisations is essential to regain growth in Europe.Traktat o funkcjonowaniu Unii Europejskiej nie zawiera definicji konkurencji. Zaproponowana w pracy definicja mówi, że jest to polityka zmierzająca do wykrywania i zapobiegania powstawaniu karteli, unikania fuzji, które mogą prowadzić do nadużywania pozycji dominującej, kontroli i ograniczania pomocy publicznej i promowania liberalizacji. W dalszej części pracy poszczególne elementy tej definicji są poddane szerszej analizie: swoboda wchodzenia na rynek, zasady konkurencji, pomoc państwowa oraz kartele. Liberalizacja jest ściśle powiązana z koncepcją Finaudiego dotyczącą możliwości zapewnienia konkurencji na rynku. Trzecia Dyrektywa Gazowa jest przykładem takiego podejścia. Jednak postępy w jej implementacji są niewielkie. Co więcej, kryzys spowodował pojawienie się swoistej eurosklerozy w procesie liberalizacji. Dynamizacja tego procesu jest niezbędna do odbudowania wzrostu gospodarczego w Europie

European Citizens' Initiative: Legal Options for Implementation Below the Constitutional Level

The EU has long been criticized for its democratic deficit. Several proposals for overcoming or reducing this deficit have been made. Some of them mention the role of more citizen participation and direct democracy. It was in this spirit that the ECI found its way into the Constitutional Treaty, creating the first tool of transnational participatory/direct democracy. It is aimed to give the Uniom's citizens more influence on EU politics while maintaining the institutional balance - especially the initiative monopoly of the European Commission - of the Union

Subjektive Theorien von Musikerinnen und Musikern zum Üben. Ein Beitrag an der Schnittstelle von Kognitionspsychologie, Popmusikforschung und empirischer Musikpädagogik

This article reports on the findings of a qualitative interview study that investigated the individual ideas about practicing of nine musicians of different musical backgrounds, music genres, instruments, and learning biography. The findings reveal a variety of different aspects that are embedded in argumentative reasoning, and thus are analysed as subjective theories. According to differences in complexity with regards to content and argumentative structure we propose the following typification: 1) physical-technical constriction, 2) technique and interpretation centered type, and 3) creative-congnitive focus. A strict affiliation between these types and musical genre was not found

A lack of consent about legal terms and concepts is not just a communication problem, but may also be viewed as a problem of the definition of legal terms and concepts.This paper starts by discussing several reader text models, and goes on to introducing the concept of the open text. This concept helps to analyse contexts in which, apart from texts, the definitions of legal concepts and terms (for example “legal text”, “ legal lan-guage” or “legal comprehensibility”) are generated during complex, dynamic and ideally democratic interactions. A unilateral act of definition does not only assign certain mean-ings, rules of interpretation, or authorisation of executive action to legal terms, but also ademocratic assumptions about political participation. In this constellation, individuals will always be subjected to the intentions of others, namely those who exert all power, influence and control over the very definition of legal key terms and concepts

Unequal Participation - Reflections On The Normativity Of The Concept Of Media Competence

Anhand von Ergebnissen aus eigenen und anderen empirischen Studien zur Internetnutzung Jugendlicher wird die Bedeutung der Habitustheorie von Bourdieu für die Erklärung von Mediennutzung und Aneignungsweisen in der Mediensozialisation expliziert. Vor diesem Hintergrund erfolgt eine Auseinandersetzung mit dem Begriff der «Medienkompetenz» unter Aspekten milieuspezifischer Medienaneignung und damit verbunden bestimmte (medien-)pädagogische Denkmuster und Handlungsformen als Faktor sozialer Benachteiligung.On the basis of results from our own and other empirical studies on the internet use of young people, the significance of Bourdieu's habitus theory for the explanation of media use and modes of appropriation in media socialisation is explicated. Against this backdrop, the concept of "media competence" is discussed under aspects of milieu-specific media appropriation and, connected to this, certain (media) pedagogical thought patterns and forms of action as a factor of social disadvantage

Literarisch lesen lernen : zum Erwerb einer Kulturtechnik

Innerhalb der Reihe "GrenzBereiche des Lesens" gehaltener Vortrag. "GrenzBereiche des Lesens" ist eine kulturwissenschaftliche Vortragsreihe, die 2003 und 2004 an der Universität Frankfurt stattfand. Irene Pieper beschäftigt sich aus literaturdidaktischer und lesesoziologischer Perspektive mit der kulturellen Praxis des Lesens. Ihr Beitrag entwickelt systematisch, worin die "Kunst" des literarischen Lesens im Einzelnen besteht und wie diese Kompetenz methodisch in der Auseinandersetzung mit dem Gegenstand Literatur zu erwerben bzw. zu vermitteln ist. Ein kompetenter Leser zu werden heißt, ein breites Spektrum von Fähigkeiten zu erwerben, das vom Realisieren der poetischen Funktion der Literatur über die Empathiefähigkeit bis hin zur Lust am Text reicht. Der Beitrag lotet aus, in welcher Weise vor allem die Schule, die außerhalb der Familie Begegnungen mit und Kommunikationen über Literatur herbeiführt und anregt, an der Bildung solcher Leser und Leserinnen mitwirken kann
