Payment of the Liquidated Portion of a Debt as Consideration for the Discharge of the Entire Claim

    Get PDF
In a recent Washington case, Paulsen Estate, Inc. v. Naches-Selah Irrigation District, the Supreme Court was called upon to decide whether the payment of the liquidated portion of a debt was a sufficient consideration for the discharge of the remaining part which was disputed by the parties. The court\u27s decision that the debtor was thereby discharged presents a phase of accord and satisfaction which has had a peculiar history in this state

Sewer System Design for Camp Challenge and Determination of Per Capita Wastewater Flows from Vacation Facilities

    Get PDF
A sewer system was designed for Camp Challenge of the Florida Easter Seal Society, in Mount Plymouth, Florida, of polyvinyl chloride piping. Invert elevations were tabulized and necessary fittings determined for the system. Cost estimates were also included. The sewers were designed on a per fixture basis so as not to overdesign using per capita flow rates. A literature and records search was conducted to obtain design and actual wastewater flow quantities in gallons per capita per day (gpcd). Actual flows determined from 4 camps and 11 travel trailer parks gave average values of 39 and 33 gpcd, respectively, and can be used as design parameters for wastewater treatment facilities. However, further investigations and intensive flow monitoring are deemed necessary to provide a wider, more accurate data base with less variability

Invariant means on Abelian groups capture complementability of Banach spaces in their second duals

Let XX be a Banach space. Then XX is complemented in the bidual X∗∗X^{**} if and only if there exists an invariant mean ℓ∞(G,X)→X\ell_\infty(G, X)\to X with respect to a free Abelian group GG of rank equal to the cardinality of X∗∗X^{**}, and this happens if and only if there exists an invariant mean with respect to the additive group of X∗∗X^{**}. This improves upon previous results due to Bustos Domecq =and the second-named author, where certain idempotent semigroups of cardinality equal to the cardinality of X∗∗X^{**} were considered, and answers a question of J.M.F. Castillo (private communication). En route to the proof of the main result, we endow the family of all finite-dimensional subspaces of an infinite-dimensional vector space with a structure of a free commutative monoid with the property that the product of two subspaces contains the respective subspaces, which is possibly of interest in itself.Comment: 12 pp., accepted for publication in Studia Mathematic

The Value of Life: Real Risks and Safety-Related Productivity in the Himalaya

    Get PDF
This paper estimates the value of a statistical life from commercial Himalayan expeditions. Because deaths occur with a fair amount of regularity, fatality rates are calculated for each mountain trail and are, hence, disaggregated measures of risk. Also, since the marginal product of labor in the industry is (in part) the marginal product of safety, our revenue measures may account for unobserved safety-related productivity of guides. Guide safety is explicitly observed by market participants, and is reflected in higher wages for safer guides. Our VSL estimates are about $5 M

The Effect of Music on Mental Deficiency

    Get PDF
In this research we are concerning ourselves with the problem of the validity of tests. What is accomplished in measuring ones intelligence and how does this effect his study of music? Is there a connection between music and the other subjects in his curriculum? If there is a connection and tests are of great value to us then we are justified in saying that a child can study music because he has a high I. Q. But then what of the many children with a low I. Q.? Couldn\u27t music be of benefit to them? Perhaps in many cases music may be the very study that they need to help them in their particular mental disease
