Pozycja ustrojowa wojewodów i starostów jako przedstawicieli rządu w latach 1919–1928
The article presents an important aspect in the history of the evolution of legal status of voivode’s and starost’s as the off ices representing local government administration in the interwar period. Although they were responsible for the whole administration in the province, they had under their control only some branches of administration. At the begining neither voivodes in the voivodeships nor starosts in the counties did not have any legal impact on the off ices which were not placed under their supervision. This article presents how this situation was gradually changing equipping government representatives with the tools to enable them to infl uence on the independent local authorities. The fi nal turning point of publication is the moment of coming into force the presidental decree of 19 January 19 1928 concerning the organization and operation of general administration, which ended the fi rst phase of work on the construction of the administration system of the Republic of Poland in the interwar period. This publication has been prepared based on the sources of universally binding law and the the government acts. The Position of the Ministry of the Interior in the Administration of the Duchy of WarsawThe article presents basic issues that arose in the Duchy of Warsaw after the implementation of departmental division of tasks between different offices of central administration, including ministries and structures subject to them. The author investigates the origins of departmental division introduced in the Duchy of Warsaw by Napoleon, its primary shape, later modifications and the degree of its endurance after it fell. A great emphasis has been placed on the issue of general importance and position of the Ministry of the Interior functioning as a kind of a meta-ministry. In addition to the analysis of normative solutions the paper also looks at the actual determinants of the departmental division and at how it was influenced by Polish tradition. In this context the author investigates how normative solutions have been put into practice
Rada Stanu Królestwa Polskiego wobec niekonstytucyjności Organizacji Komisji Rządowej Wojny
Artykuł poświęcony jest projektowi Organizacji Komisji Rządowej Wojny, przygotowanemu
na początku 1816 r. i usankcjonowanemu przez cesarza po przeróbkach 17 października
1816 r. Skupiono się na rekonstrukcji przebiegu wypadków związanych z tym
projektem, powstałym na zlecenie wielkiego księcia Konstantego i według jego wizji organizacji
ministerialnej sprzecznej z koncepcją uregulowaną w konstytucji. Następnie dokonano
analizy treści projektu oraz przedstawiono stosunek do niego członków Rady Stanu.
Problem miał zarówno wymiar polityczny, jak i konstytucyjny. Stawiał zabierających głos
w dyskusji w trudnym położeniu, ponieważ z jednej strony projekt był w ich przekonaniu
niezgodny z Ustawą konstytucyjną, uprzywilejowując ministra w stopniu niweczącym zasadę
kolegialności w komisjach rządowych zagwarantowaną jej postanowieniami. Z drugiej
strony wobec nieprzejednanej postawy Wielkiego Księcia Konstantego narażał rząd
polski na poważny konflikt z bratem cesarskim.The article is devoted to issues related to the project of the Organization of the Government
Commission of War prepared at the beginning of 1816 and sanctioned by the
Emperor aft er the alterations on October 17, 1816. It focuses on the reconstruction of
the course of events related to this project prepared on the order of Grand Duke Konstantin
and according to his vision of a ministerial organization contrary to the concept
regulated in the constitution. Then it analyzes the content of the project and presents the attitude of members of the Council of State to it. The problem had both its political and
constitutional dimension. It put the members of the Council in a difficult position because,
on the one hand, it were inconsistent with the Constitutional Act, privileging the
minister to an extent that undermined the principle of collegiality in government commissions
guaranteed by its provisions. On the other hand, due to the uncompromising
attitude of the Grand Duke Konstantin, it exposed the Polish government to a serious
confl ict with the imperial brother
A Controversial Transplant? Debate over the Adaptation of the Napoleonic Code on the Polish Territories in the Early 19th Century
This article focuses on the attitude of the Polish legal elite regarding the adaptation of French civil law introduced on the Polish territories in the Duchy of Warsaw, established by Napoleon in 1807. While addressing the Polish example, it underscores the universal nature of problems engendered by legal transfer and by the social reactions to foreign solutions. It sheds light on the state of mind of Polish enlightened elites, on their approach toward new legal instruments and on the challenges of adapting them to the socioeconomic conditions of a semi-peripheral country. The Polish situation in the early 19th century provides evidence that some representatives of the late-Enlightenment generation remained attached to the universalist, all human vision of civilizational progress and shared natural law instruments for its accomplishment. On the other hand, in reaction to this attitude, the opposite view had already started to crystallize. It pointed to the uniqueness of conditions of development in any given country and nation. According to this view, civil law should account for this specificity and be adjusted to the national character

Stosunek polskich elit do prawa francuskiego po upadku Napoleona - zarys problemu
Przedstawione w artykule badania obejmowały argumentację, jaką posługiwała się
część polskiej elity intelektualnej i prawniczej, podejmująca się w najtrudniejszym momencie
- bezpośrednio po upadku Księstwa Warszawskiego - obrony obowiązywania
francuskiego prawa na ziemiach polskich. U progu powstania Królestwa Polskiego dalszy
byt Kodeksu Napoleona oraz towarzyszących mu kodeksów francuskich wydawał się
przesądzony. Nowa elita rządząca, na czele z ks. Adamem Jerzym Czartoryskim, uzyskała
akceptację cesarza Aleksandra I na możliwie jak najszybsze uchylenie obowiązujących
praw. Panująca atmosfera niechęci do wszystkiego, co francuskie i rewolucyjne, również
nie pozostawiała złudzeń odnośnie do dalszych losów napoleońskich kodeksów i co więcej
- utrudniała zajmowanie otwartego stanowiska w obronie kodyfikacji słusznie uznawanej
za obcą polskim zwyczajom i tradycjom. Hasło jej utrzymania nie wytrzymywało
konfrontacji z nośną ideą zastąpienia jej kodyfikacją narodową. Jak w tej sytuacji radzili
sobie tacy wybitni prawnicy jak Antoni Bieńkowski, Jan Wincenty Bandtkie czy Antoni
Wyczechowski, którzy z jednej strony doceniali jakość, nowoczesność i uniwersalizm francuskich
kodeksów oraz fakt, że proces ich adaptacji na ziemiach postępował już nie bez
efektów od kilku lat, a z drugiej - dostrzegali brak rozsądnej alternatywy wobec trudności,
jakie wiązałyby się ze stworzeniem podobnego dzieła odwołującego się do dziedzictwa
polskiej kultury prawnej?The focus of our research is on the argumentation applied by this part of the Polish
intellectual and legal elites, which took it upon itself to defend the French law in force
on Polish territories in the most difficult moment, immediately following the collapse of
the Duchy of Warsaw. On the eve of establishment of the Kingdom of Poland, the further
fate of Napoleonic Code and of its accompanying French codes seemed set in stone. The
new ruling elites, headed by Prince Adam Jerzy Czartoryski, secured the approval of tsar
Alexander to abrogate the laws in place as quickly as possible. The prevailing atmosphere
of hostility toward all things French and revolutionary left no illusions as to the further
fate of Napoleonic codes and, moreover, made it difficult for anyone to defend this codification
openly, as it was deemed foreign to Polish customs and traditions. The proposal
to retain it could not withstand the confrontation with the catchy idea of replacing it with
a national codification. How was this situation faced by such outstanding lawyers as Antoni
Bieńkowski, Jan Wincenty Bandtkie or Antoni Wyczechowski, who on the one hand
appreciated the quality, modernity and universality o f French codes, as well as the fact that
the process of their adaptation on the Polish territories had been bringing some effects
over the recent years, and who on the other hand noticed the lack of alternatives to the
difficulties posed by creating a similar work referring to the heritage of Polish legal culture
Prawne i polityczne uwarunkowania statusu ministra Księstwa Warszawskiego
The work describes the status of the minister in the capacity of an organ of central sectoral
administration in the Duchy of Warsaw. The work aims at confronting the normative material
defining the constitutional position of a minister with the source material informing about the
minister’s actual role. An objective of the article is to verify the opinion about the poorly functioning
central administration of the Duchy caused by the excessive concentration of power in
the hands of individual ministers and the lack of an actual system of control and coordination of
their activity that can be found in literature. This opinion finds corroboration in the article with
the provision, however, that the excessive independence of sectoral organs contrasted with their
internal weakness resulting from the difficult internal situation of the Duchy of Warsaw, whose
administrative powers were in fact incapable of normal state organising activity.Der Autor stellt die Charakteristik eines Ministers als Ressortorgans der zentralen Verwaltung
im Herzogtum Warschau. Ziel der Arbeit war die Zusammenstellung des normativen Materials,
welches die Stellung eines Ministers im politischen System beschreibt, mit dem Quellenmaterial,
nach dem seine eigentliche Rolle eingeschätzt werden kann.
Geprüft wird vor allem die oft in der Fachliteratur ausgedrückte Meinung über die fehlerhafte
Arbeitsweise der zentralen Verwaltung im Herzogtum Warschau, was auf die Überhäufung von
Machtkompetenzen in Händen einzelner Minister und das Fehlen eines effektiven Kontroll-und
Koordinierungsmechanismus für ihre Handlungen zurückgeführt wird. Diese Stellung wird auch
in diesem Beitrag bekräftigt, wohl mit einem Vorbehalt: Die übermäßige Selbstständigkeit der
Ressortorgane stand im Kontrast mit deren interner Schwäche, die mit der schwierigen Innensituation
im Herzogtum Warschau erklärt werden könnte - die Verwaltungsspitze war eigentlich
nicht imstande, die normale Organisationsarbeit in dem Staat zu führen
Uwagi o metodologii badań prawno-porównawczych w kontekście historii prawa w Polsce
Is there anything outstanding about the history of law in Poland? Is it particularly conducive to comparative research? In my attempt to answer these questions, I focussed on presenting two distinct comparative law methods: historical legal comparison and comparative legal history.The paper is divided into two parts. The first part elaborates on the characteristics of the respective methods and on the challenges of comparative legal history in a temporally diachronic perspective and why they are not so pronounced in historical legal comparison. In this part, I tried to document the claim that the existence of a comparative platform of similarities is a condition to obtain more reliable and better-documented results of comparative research.In the second part, I focussed on three cases visualising the possibilities for comparative legal research on the history of law in Poland. Regarding the pre-partition times, I analysed the comparative possibilities related to an analysis of the impact of the Roman law on the Old Polish legal culture. The other two examples concerned the history of law in post-partition Poland. First, I explored the potential triggered by the adoption of foreign laws in Poland in terms of comparative research. I used French commercial law to exemplify the problem. Then, I undertook to show the dormant potential of the particular situation of Poland divided into different legal areas for the development of the country’s own codes of law.Czy dzieje prawa w Polsce wyróżniają się czymś szczególnym? Czy historia prawa w Polsce stwarza wyjątkowo korzystne warunki dla prowadzenia badań komparatystycznych? Podejmując się odpowiedzi na te pytania, skoncentrowałem się na prezentacji dwóch różnych ujęć prawno-porównawczych – na tzw. historycznym porównywaniu praw oraz porównawczej historii prawa.Artykuł został podzielony na dwie części. W pierwszej z nich zawarłem rozbudowane uwagi wstępne charakteryzujące oba podejścia i wyjaśniające, na czym polegają problemy związane z zastosowaniem porównawczej historii prawa w ujęciu temporalnie diachronicznym oraz dlaczego one nie występują w takim stopniu przy stosowaniu historycznego porównywania prawa. W tej części starałem się udokumentować twierdzenie, iż istnienie tzw. porównawczej platformy podobieństw stanowi warunek osiągnięcia pewniejszych i lepiej udokumentowanych wyników badań komparatystycznych.W drugiej części skupiłem się na trzech egzemplifikacjach obrazujących możliwości prowadzenia badań prawno-porównawczych nad dziejami prawa w Polsce. W odniesieniu do czasów przedrozbiorowych koncentruję się na możliwościach komparatystycznych związanych z analizą wpływu prawa rzymskiego na staropolską kulturę prawną. Pozostałe dwa przykłady dotyczą historii prawa na ziemiach polskich w czasach porozbiorowych. Najpierw skupiam swoją uwagę na potencjale, jaki dla badań komparatystycznych stworzyła sytuacja przeszczepienia na grunt polski obcych praw. Analizuję ten problem na przykładzie francuskiego prawa handlowego. Następnie staram się wskazać na potencjał, jaki drzemie w szczególnej sytuacji, w jakiej znalazły się ziemie polskie podzielone na różne obszary prawne i wykorzystania tego faktu w pracach nad stworzeniem własnej kodyfikacji
Recruitment of Skilled Officials in the Constitutional Kingdom of Poland (1850-1830)
The aim of the article is to explain the legal terms of the recruitment for administrative
offices introduced in the Kingdom of Poland. The implementation of this system
was a basic condition to organize a fully professional administrative staff professionally
prepared to perform its duties. Based on formal and dogmatic method the publication
analyses the regulations of the namestnik’s (governor’s) Decree of November 12, 1816,
concerning examination boards in the Kingdom of Poland. The author generally omitted
issues associated with its implementation. Thus the article presented the ideas of
Polish governmental elites at the beginning of the 19th century. Any observations were
confronted with the contents of the earlier Decree of April 29, 1808, which established
examination boards in the Duchy of Warsaw. The author tries to prove that this system
of recruitment was the prototype and the main point of reference for the system of the

Wpływ wojen napoleońskich na wzrost niechęci wobec biurokracji w polskiej myśli administracyjnej w latach 1813–1815
Autor artykułu skupił się na zagadnieniu reorientacji poglądów na administrację
w polskiej myśli politycznej w ciągu zaledwie kilku lat istnienia Księstwa Warszawskiego,
zwłaszcza w jego końcowym stadium (1813–1815). Utworzony przez Napoleona Bonapartego
organizm państwowy powstał na fali entuzjazmu i wiary Polaków w odrodzenie
narodowe i urzeczywistnienie oświeceniowej wiary w sprawczą siłę rządu, zdolnego do
podźwignięcia kraju z upadku i wprowadzenia na drogę cywilizacyjnego postępu. Wkrótce
jednak okazało się, że Księstwo Warszawskie stanie się państwem, którego kilkuletnie istnienie
naznaczone będzie ciągłymi wojnami i pogarszającą się sytuacją gospodarczą, wpływającą
na wzrost negatywnych ocen struktury państwowej oraz tęsknotę za dawną tradycją
ustrojowo-prawną. O zmianie stosunku do biurokracji świadczą obszernie cytowane
w tekście wypowiedzi zarówno ziemianina z Lubelszczyzny Joachima Owidzkiego, osoby
powszechnie znanej i szanowanej w tym regionie, jak i byłego jakobina Józefa Kalasantego
Szaniawskiego, wyrazistego przedstawiciela elity intelektualnej i politycznej. Natomiast za
podsumowanie zmiany stosunku do urzędników, jaki dokonał się w tych czasach, może
służyć tekst profesora Szkoły Prawa Franciszka Ksawerego Szaniawskiego, który zauważa,
że totalna krytyka „stanu urzędniczego” wynika ze skłonności do przesady.The author of the article focused on the issue of reorientation in views about administration,
which occurred in the Polish political thought over a mere few years of existence
of the Duchy of Warsaw, especially at the last stage of its existence in 1813–1815. Th is state
entity created by Napoleon came into being on the wave of enthusiasm and faith in the
national rebirth of Poles and in the Enlightenment belief about the agency of the government,
capable of lift ing the country from collapse and of setting it on a path of civilizational
progress. Soon, however, it turned out that at the same time it became a state whose
short-lived existence of only a few years would be marked by constant wars and a declining economic situation, negatively aff ecting the society’s assessments of the state structures, as
well as kindling a yearning for the old political traditions. Extensively quoted statements of
both a landowner from the Lublin region, Joachim Owidzki (a person widely known and
respected in this region) as well as the former Jacobin Józef Kalasanty Szaniawski (an expressive
representative of Polish intellectual and political elites) documented the change in
the attitude to the bureaucracy; whereas the text of the School of Law professor Franciszek
Ksawery Szaniawski could serve as a summary of this change. He noted that the total criticism
of the “clerical state” resulted from a tendency to exaggeration
