El principio de oportunidad en el derecho comparado

La presente monografía tiene por objeto realizar una descripción del principio de oportunidad en el derecho comparado y llegar a dilucidar si el principio de oportunidad consagrada en el artículo 250 de la constitución es compatible con los estándares internacionales de justicia. Para alcanzar dicha meta, se realiza un estudio cualitativo de los ordenamientos jurídicos de Colombia, Alemania, Argentina y Perú, de la naturaleza jurídica del principio, los límites y la facultad discrecional del Fiscal en la aplicación del principio de oportunidad, para finalmente determinar que nuestro país cumple con los estándares internacionales en cuanto al principio de oportunidad.The purpose of this paper is to provide a description of the principle of opportunity based on the comparative law and come to question whether the principle of opportunity enshrined in Article 250 of the constitution is compatible with international standards of justice. To achieve this goal, a qualitative study of the laws of Colombia, Germany, Argentina and Perú, related to the legal nature of the opportunity principle, the limits and the Prosecutor's discretion in applying this principle, to finally, determine that our country meets the international standards on the important principle of oportunity

Apoyo técnico - administrativo al diseño y divulgación del sistema de gestión ambiental NTC - ISO 14001:2004 en la Industria Colombiana de Confecciones Incoco S.A.

La organización Almacenes Alberto Vallejo es una empresa manufacturera que pertenece al sector de la confección, ésta comenzó su actividad económica en 1965 posteriormente en 1974 abrió la planta de pantalones y se consolidó La Industria Colombiana de Confecciones INCOCO, con su nueva marca para ropa masculina ALBERTO VO5. Finalmente en 1992 la organización se traslada a la zona industrial de Pereira, donde opera actualmente. El proceso productivo de La Industria Colombiana de Confecciones INCOCO S.A., consiste en la transformación de materiales procesados en prendas de vestir masculina y femenina, proceso que genera consumo de recursos naturales, producción de residuos sólidos peligrosos y no peligrosos y emisiones atmosféricas. Por tal motivo INCOCO S.A., inicia un compromiso con el Medio Ambiente fundamentado en prácticas amigables con el entorno. Inicialmente se diseñó el sistema de gestión ambiental como base para una futura aplicación y se implementó un programa de manejo integral de residuos sólidos por ser uno de los impactos más significativos dentro del proceso productivo. El proceso iniciado requería de un apoyo técnico administrativo para que dentro de una dinámica de mejoramiento continuo se logre la sostenibilidad ambiental de la empresa y se mantengan los niveles de producción actuales

Selección adversa en el régimen contributivo de salud: el caso de la EPS de Susalud

El mercado de seguro de salud presenta fallas derivadas de la existencia de información asimétrica. En el caso particular de selección adversa, los individuos tienen mayor información para predecir mejor que el asegurador su estado de salud futuro de modo que se autoseleccionan en el plan que mejor se ajuste a su probabilidad esperada de uso de servicios, generándose una mala distribución del riesgo. De acuerdo a lo anterior, esta investigación centra su análisis en identificar la existencia de selección adversa asociada a la compra del seguro de salud en el régimen contributivo colombiano y se analiza si dicho fenómeno es impulsado por la calidad de los servicios ofrecidos por las empresas aseguradoras. Para esto, se construyó el panorama general del régimen contributivo de salud y la posible selección adversa existente en él a través de la lectura y análisis de 2 encuestas nacionales sobre calidad de los servicios de salud y la caracterización del 80% de la población afiliada. También se realizó un análisis de caso, la EPS de Susalud, donde por métodos cualitativos y cuantitativos se construyeron indicadores de medidas estructurales de calidad y la valoración que hacen los usuarios de la calidad del seguro comprado a Susalud. Los resultados parecen indicar que las señales de calidad enviadas por la EPS de Susalud están siendo captadas, en buena medida, por los usuarios potenciales de selección adversa, por lo tanto, hacen una elección racional ya que utilizan la mayor parte de la información disponible para formar su evaluación de calidad al afiliarse a la EPSeconomía de la información

However, English language does not have a very important role in some institutions because it is not an important area for the population and the students do not like that kind of subjects. There are many opinions about the learning and teaching English language, but is concerned that teachers start from the positive assessment of learning a new language arousing the interest of the students, and giving to them the motivation to improve the opportunities and quality of life and to ensure the coexistence and cultural exchange since the short time increase your knowledge about another cultures

Importancia de la auditoría de seguridad vial (ASV) en las concesiones viales de Colombia

Práctica SocialPara el desarrollo del documento se tuvo en cuenta las Concesiones que se encuentran bajo la supervisión de la Agencia Nacional de Infraestructura – ANI, dado que es la entidad estatal que tiene a su cargo la mayoría de estas; se planteó una serie de actividades para alcanzar los objetivos plasmados en el documento, tales como: búsqueda teoría sobre el tema, antecedentes en países pioneros de las ASV, lectura de los contratos de las Concesiones e Interventorías que tienen a su cargo los proyectos viales, se realizó una encuesta la cual fue enviada a los 49 concesionarios que se encuentran actualmente bajo la supervisión de la ANI, se realizó la búsqueda de información mediante oficios dirigidos a las entidades del país que tienen a su cargo responsabilidades con el área de transito como: Ministerio de Transporte, Agencia Nacional de Seguridad Vial – ANSV, Instituto Nacional de Vías – INVIAS, Superintendencia de Puertos y Transporte, Agencia Nacional de Infraestructura – ANI, Dirección de Tránsito y Transporte – Policía Nacional - DITRA, se realizó un estudio de caso en un tramo de vía en el cual se aplicó una lista de chequeo para la realización de una Inspección de Seguridad Vial - ISV con el fin de identificar aspectos peligrosos, deficiencias o carencias en el tramo de vía objeto de la inspección susceptibles de desencadenar un siniestro, para que se adopten medidas adecuadas con el fin de eliminar o mitigar estos problemas.This Project is born from the increasing concern given the high accident rate found in the streets of the country. The main problem starts with the necessity of all human beings of doing different activities within a certain territory; reason for which a determined movement in a given area is needed in order to do all kind of different activities. Efectos de la ecualización ciega de canal utilizando el algoritmo acelerador regresivo versión ɣ

We present a blind channel equalization scheme, applied to ɣ version regressive acceleration algorithm, which uses self-taught equalization techniques to study the characteristics of both, the second and the higher order moments for the transmitted signal, used to calculate the signal of error and thus, to make an optimal estimation of the transmitted symbols. This way, simulations of the obtained results are done in comparison with the algorithms based on the stochastic gradient and with the Bussgang algorithms. The results of that simulations show how, using the regressive acceleration algorithm version ɣ, a better detection of transmitted bits and higher convergence speeds are obtained, with a minimum mean square error.Se presenta un esquema de ecualización ciega de canal, donde se aplica el algoritmo acelerador regresivo versión ɣ, el cual utiliza las técnicas de ecualización autodidacta que estudian las características de los momentos de segundo orden y de orden superior de la señal transmitida, usados para calcular la señal de error, con el fin de realizar una óptima estimación de los símbolos transmitidos. Con ello se simulan los resultados obtenidos en comparación con los algoritmos basados en el gradiente estocástico y en los algoritmos de Bussgang. Los resultados de las simulaciones muestran que, utilizando el algoritmo acelerador regresivo versión ɣ, se obtiene una mejor detección de los bits trasmitidos y mayores velocidades de convergencia, con un error cuadrático medio mínimo

Improving basic reading skills in transition grade students through Genre Based Pedagogy

This study proposes a reflection on the methods on how elementary students are taught to read in a second language and consequently proposes the implementation of Genre-based approach (GBA) designed to teach students to write texts successfully (Martin, 2000) and the literacy program Learning to Read: Reading to Learn, which uses genre as a framework for training teachers in strategies for scaffolding reading and writing across curricula and education sectors (Rose 2004, 2005ab, 2006b). The aim of this intervention was to expose preschoolers to a scaffold step by step process where they were guided to develop their decoding skills, identify word formation, identify simple sentence and text structure, as well as to recognize the lexicon-grammatical aspects in short stories. At the end of the process, students were helped to start their process of writing basic words and sentences in English, by reproducing the type of sentences within the texts that they were guided to read. This study was carried out as a qualitative research, under the structure of an action research in which the teachers-researchers collected the data using various techniques, at different moments of the research (before, during and after the intervention). Before, interviews and observations, during, observations and a think aloud protocol and after, a reading test. The results showed that the implementation of the genre- based approach pedagogy was very effective to teach students to develop basic reading skills in elementary level. Besides, students learned to take control their process, participated actively, recognized some language patterns and showed engagement in the reading process
