International Arbitration Is Not Your Father\u27s Oldsmobile

This article provides a short prospectus for the unwary lawyer who must venture into unfamiliar territory abroad. Although there are numerous arbitral forums available in countries all over the world, this article will focus primarily on the LCIA and the ICC. Following a brief history of international arbitration and the history of these two international arbitral forums, the article will discuss some of the major issues in international arbitration such as forum selection, issue preclusion and procedural matters. This article also includes sections on appealing awards and enforcement of awards under existing international treaties. The article is brought to a close with a discussion of potential problems for American lawyers representing clients in foreign arbitral forums. This paper traces the history of American arbitration from the common law to the FAA. It discusses the FAA as a procedural act prior to Southland v. Keating and as a substantive law act following Southland. It discusses the Erie doctrine as applicable to federal courts and state law preemption. The article concludes that Southland by-passed Erie using the Commerce Clause and the Supremacy Clause to create a federal common law of arbitration

Investigation of high efficiency GaAs solar cells

Investigations of basic mechanisms which limit the performance of high efficiency GaAs solar cells are discussed. P/N heteroface structures have been fabricated from MOCVD epiwafers. Typical AM1 efficiencies are in the 21 to 22 percent range, with a SERI measurement for one cell being 21.5 percent. The cells are nominally 1.5 x 1.5 cm in size. Studies have involved photoresponse, T-I-V analyses, and interpretation of data in terms of appropriate models to determine key cell parameters. Results of these studies are utilized to determine future approaches for increasing GaAs solar cell efficiencies

Electro-optical characterization of GaAs solar cells

The electro-optical characterization of gallium arsenide p/n solar cells is discussed. The objective is to identify and understand basic mechanisms which limit the performance of high efficiency gallium arsenide solar cells. The approach involves conducting photoresponse and temperature dependent current-voltage measurements, and interpretation of the data in terms of theory to determine key device parameters. Depth concentration profiles are also utilized in formulating a model to explain device performance

Civil RICO Suits Against Harm-Causing Marijuana Operations: Momtazi Family, LLC v. Wagner as a Case Study

Hemp was legalized as a matter of federal law in the 2018 Farm Bill, but the use of cannabis for recreational and medicinal purposes remains a federal crime. This has not stopped an increasing number of states from legalizing recreational and medicinal cannabis as a matter of state law. Unless and until cannabis is legalized on a federal level, coordinated activity to produce and distribute it for recreational and medicinal use can constitute racketeering activity under the federal Racketeer Influenced and Corrupt Organizations Act ( RICO\u27) and give rise to civil RICO lawsuits by private plaintiffs. This article examines one particular civil RICO lawsuit, Momtazi Family, LLC v. Wagner. In this case, owners of a vineyard claimed business injury from a neighboring cannabis operation. Using Momtazi as a focal point, this note reviews what RICO is, the current case law around civil RICO claims involving cannabis, and how the determination of standing for a civil RICO claim in the Ninth Circuit is developing. It also explores the legal landscape for civil RICO claims brought by South Dakota property owners against nearby marijuana operations, which would be brought in the Eighth Circuit
