    Contested Cases of Statutory Interpretation

    This paper proposes an argumentation based procedure for legal interpretation, by reinterpreting the traditional canons of textual interpretation in terms of argumentation schemes,which are then classified, formalized, and represented through argument visualization and evaluation tools. The problem of statutory interpretation is framed as one of weighing contested interpretations as pro and con arguments. The paper builds an interpretation procedure by formulating a set of argumentation schemes that can be used to comparatively evaluate the types of arguments used in cases of contested statutory interpretation in law. A simplified version of the Carneades Argumentation System is applied in a case analysis showing how the procedure works. A logical model for statutory interpretation is finally presented , covering protanto and all things considered interpretive conclusions

    Methodological shortcomings of wrist-worn heart rate monitors validations

    Wearable sensor technology could have an important role for clinical research and in delivering health care. Accordingly, such technology should undergo rigorous evaluation prior to market launch, and its performance should be supported by evidence-based marketing claims. Many studies have been published attempting to validate wrist-worn photoplethysmography (PPG)-based heart rate monitoring devices, but their contrasting results question the utility of this technology. The reason why many validations did not provide conclusive evidence of the validity of wrist-worn PPG-based heart rate monitoring devices is mostly methodological. The validation strategy should consider the nature of data provided by both the investigational and reference devices. There should be uniformity in the statistical approach to the analyses employed in these validation studies. The investigators should test the technology in the population of interest and in a setting appropriate for intended use. Device industries and the scientific community require robust standards for the validation of new wearable sensor technology

    none4siOnline market players are gradually gaining the capacity to adapt prices dynamically based on knowledge generated through vast amounts of data, so that, theoretically, every individual consumer can be charged the maximum price he or she is willing to pay. This has downsides for markets and society. European Union law insufficiently addresses these issues. Consumer-empowering technologies may help counter algortihmic price discruimination.     Analysis of demersal assemblages off the Tuscany and Latium coasts (north-western Mediterranean)

    A four-year time series (1994-1997) of groundfish trawl surveys performed within the European Union Project "MEDITS" (Mediterranean International Trawl Surveys), was analysed to identify and describe the fish assemblages along the continental shelf and slope of Tuscany and Latium (Italy), in the north-western Mediterranean. Cluster analysis was used to group samples with similar species composition in terms of abundance, biomass and frequency of occurrence. Results allowed the identification of four to five broad assemblages along the depth gradient: a strictly coastal group (< 50 m depth), two groups in the upper and lower part of the continental shelf (essentially 50-200 m), an epibathyal group (200450 m) and a group derived from hauls made at depths greater than 450 in. Each assemblage corresponded to a faunistic association with relatively homogeneous and persistent species composition, biomass and density indices

    Hemodynamic evaluation of the right portal vein in healthy dogs of different body weights

    <p>Abstract</p> <p>Background</p> <p>Doppler ultrasonography is an important tool for evaluating hepatic portal hemodynamics. However, no study in dogs of different body weights, in the range encountered in routine clinical veterinary practice, has been reported. It can be difficult to obtain an ideal insonation angle when evaluating the main portal vein, so evaluation of the right portal vein branch has been described in humans as an alternative. The aim of this study was to analyze, through Doppler ultrasonography, the hemodynamics in the right portal vein branch in dogs of different body weights.</p> <p>Methods</p> <p>Thirty normal dogs were divided in three groups by weight, in order to establish normal values for mean velocity, flow volume and portal congestion index of the right portal vein branch by means of Doppler ultrasonography.</p> <p>Results</p> <p>In all dogs ideal insonation angles were obtained for the right portal vein branch. The average velocity was similar in the three groups, but the portal congestion index and the flow volume differed, showing that the weight of the dog can influence these values.</p> <p>Conclusion</p> <p>Doppler ultrasonography for the evaluation of flow in the right branch of the portal vein could be a viable alternative, or complement, to examining the main vessel segment. This is especially so in those animals in which an ideal insonation angle for examination of the main portal vein is hard to obtain. In addition, the weight of the dog must be considered for the correct evaluation of the portal system hemodynamics, particularly for portal blood flow and the congestion index.</p

    Mach Number Effects on Buffeting Flow on a Half Wing-body Configuration

    Purpose The purpose of this paper is to discuss a numerical study of the flow over a wing representative of a large civil aircraft at cruise condition. For each Mach number considered, the numerical simulations indicate that critical angle of attack exists where the separated region increases in size and begins to oscillate. This phenomenon, known as transonic shock buffet, is reproduced by the unsteady simulation and much information can be extracted analysing location, amplitude and frequency content of the unsteadiness. Design/methodology/approach Reynolds-averaged Navier-Stokes simulations are conducted on a half wing-body configuration, at different Mach numbers and angles of attack. Different turbulence models are considered, and both steady-state results and time-accurate simulations are discussed. Findings The high number of cases presented in this study allows the creation of a database which, to the authors’ knowledge, has not been documented in literature before. The results indicate that, while high-fidelity approaches can improve the quality of the results, the URANS approach is capable of describing the main features of the buffet phenomenon. Research limitations/implications The presence of a turbulence model, despite allowing the description of the main unsteady phenomenon, might be insufficient to fully characterise the unsteadiness present in a transonic flow over a half wing-body configuration. Therefore, researchers are encouraged to verify by means of experimental investigation or high-fidelity approach the results issued from a Reynolds-averaged Navier-Stokes equations. Practical implications The results presented clearly indicate that, despite what proposed in recent research papers, transonic buffet can be described by means of time-accurate Reynolds-averaged Navier-Stokes equations. Such an approach is popular in the aeronautical industry because of its reduced costs, and could be used for wing design. Originality/value In this paper, the authors used a classical approach to tackle the known problem of transonic buffet in three-dimensional configurations. The large number of results presented can be used as a database for future numerical simulations and experiments, and allow to describe the flow-physics of the buffet unsteadiness on a half wing-body configuration

    Deep learning for detecting and explaining unfairness in consumer contracts

    Consumer contracts often contain unfair clauses, in apparent violation of the relevant legislation. In this paper we present a new methodology for evaluating such clauses in online Terms of Services. We expand a set of tagged documents (terms of service), with a structured corpus where unfair clauses are liked to a knowledge base of rationales for unfairness, and experiment with machine learning methods on this expanded training set. Our experimental study is based on deep neural networks that aim to combine learning and reasoning tasks, one major example being Memory Networks. Preliminary results show that this approach may not only provide reasons and explanations to the user, but also enhance the automated detection of unfair clauses

    We present a study aimed at testing the CLAUDETTE system's ability to generalise the concept of unfairness in consumer contracts across diverse market sectors. The data set includes 142 terms of services grouped in five sub-sets: travel and accommodation, games and entertainment, finance and payments, health and well-being, and the more general others. Preliminary results show that the classifier has satisfying performance on all the sectors
