    Civilizing Nonjury Trials

    This article is intended to make people think about American procedure, yet it is devoted largely to a description of Austrian and Israeli civil procedure and perhaps that calls for some disclaiming and confessing and avoiding. I have spent only a few months in the two countries and have no doubt that I am open to the charge, made against far more seasoned American comparatists, that I tend to look at foreign systems through American conceptual spectacles. By way of avoidance let me offer, first, the usual defense of the popularizer. There never will be many serious students of comparative law in the United States. If foreign ideas are to play any part in thinking about American law, it is essential to get some general information out to the grass roots. Secondly, as indicated above, this article is intended as a consideration, largely by implication it is true, of American procedure and it is aimed at the reader who, whatever the level of his information and interest in foreign systems, knows a good deal about American procedure. I believe that such a person\u27s thinking about his own system is likely to be enriched by even somewhat oversimplified ideas about a foreign system

    Mid-infrared selection of quasar-2s in Spitzer's First Look Survey

    We present early results from the spectroscopic follow-up of a sample of candidate obscured AGN selected in the mid-infrared from the Spitzer First Look Survey. Our selection allows a direct comparison of the numbers of obscured and unobscured AGN at a given luminosity for the first time, and shows that the ratio of obscured to unobscured AGN at infrared luminosities corresponding to low luminosity quasars is ~1:1 at z~0.5. Most of our optically-faint candidate obscured AGN have the high-ionization, narrow-line spectra expected from type-2 AGN. A composite spectrum shows evidence for Balmer absorption lines, indicating recent star-formation activity in the host galaxies.     Mapping Global Star Formation in the Interacting Galaxy Pair Arp32

    A multi-wavelength set of photometric data including UV (GALEX), optical, near-IR, infrared (Spitzer) and radio (VLA 20cm) images and spectroscopic observations are used to map the dust-obscured and unobscured star formation in the galaxy pair Arp 32. The system consists of an actively starforming galaxy and another one with depressed star formation. The most active galaxy has disrupted morphology and different sites of star formation. Spectroscopic data show hints of nuclear activity in its core, intense star formation in limited regions of the galaxy as well as an underlying population of stars witnessing a past episode of star formation. Current star formation rates are estimated from UV and bolometric IR luminosities

    Structural properties of a calcium aluminosilicate glass from molecular-dynamics simulations: A finite size effects study

    We study a calcium aluminosilicate glass of composition (SiO2_2)0.67_{0.67}-(Al2_2O3_3)0.12_{0.12}-(CaO)0.21_{0.21} by means of molecular-dynamics (MD) simulations, using a potential made of two-body and three-body interactions. In order to prepare small samples that can subsequently be studied by first-principles, the finite size effects on the liquid dynamics and on the glass structural properties are investigated. We find that finite size effects affect the Si-O-Si and Si-O-Al angular distributions, the first peaks of the Si-O, Al-O and Ca-O pair correlation functions, the Ca coordination and the oxygen atoms environment in the smallest system (100 atoms).     The abundances of ethane to acetylene in the atmospheres of Jupiter and Saturn

    The present determination of the stratospheric abundances of ethane and acetylene on Jupiter and Saturn on the basis of IR spectra near 780/cm uses atmospheric models whose thermal and density profiles have constant mixing ratios. The ratio of ethane to acetylene is noted to be insensitive to model atmosphere assumptions; it is 55 + or - 31 for Jupiter and 23 + or - 12 where model mixing ratios are uniform. Atmospheric model density profiles adapted from theoretical photochemical models are noted to also yield a higher ethane/acetylene ratios for Jupiter

    A nova origin of the gas cloud at the Galactic Center ?

    The recent discovery by Gillessen and collaborators of a cloud of gas falling towards the Galactic Center on a highly eccentric orbit, diving nearly straight into the immediate neighborhood of the central supermassive black hole, raises the important question of its origin. Several models have already been proposed. Here we suggest that a recent nova outburst has ejected a ring-like shell of gas. Viewed at high inclination, that could account for the mass, head and tail structure, and the unusually high eccentricity of the observed cloud in a natural way, even as the nova moves on an orbit quite normal for the young stars in the close neighborhood of the Galactic Center. We illustrate this by calculating orbits for the head and tail parts of the ejecta and the nova that has produced it. We briefly discuss some of the questions that this model, if true, raises about the stellar environment close to the Galactic Center.Comment: 4 pages, 1 figure, Journal reference, correction of a minor erro

    Effect of Soil Treatment on the Dynamic Response of Machine Foundations

    Improvement of foundation soils using existing treatment techniques such as chemical, compaction and jet grouting can significantly enhance the general load bearing capacity of foundations. This paper describes the effect of soil treatment on the dynamic response of a rigid foundation subjected to steady-state, lCM-amplitude high-frequency vibrations, such as those encountered in machine foundation problems. Dynamic finite element analysis were performed to evaluate the effect of soil treatment as a function of treatment type and geometry. The treatment of foundation soil significantly reduced the amplitude of vibration of the foundation with the reduction being highly dependent on the type and geometry (i.e., width and depth) of the treated zone
