    Prohibition: The Elusive and Misunderstood Writ

    To many legal practitioners the writ of prohibition remains an enigma. Seldom used and even less often understood, this extraordinary remedy at law has long been recognized in Virginia as a tool with which to restrain an offending court from unwarranted conduct. Used properly, the writ will encourage the due and regular administration of justice by confining each tribunal to the exercise of those powers with which it has been entrusted under the constitution and laws of the state. The writ has been defined by the Virginia Supreme Court as a proceeding between two courts-a superior and an inferior-and is the means whereby the superior exercises its due superintendence over the inferior, and keeps it within the limits and bounds of the jurisdiction prescribed to it by law. Common law provided for this extraordinary remedy and most states, including Virginia, have expressly granted their high courts jurisdiction over proceedings in prohibition

    Transitions in the morphological features, habitat use, and diet of young-of-the-year goosefish (Lophius americanus)

    This study was designed to improve our understanding of transitions in the early life history and the distribution, habitat use, and diets for young-of-the-year (YOY) goosefish (Lophius americanus) and, as a result, their role in northeastern U.S. continental shelf ecosystems. Pelagic juveniles (>12 to ca. 50 mm total length [TL]) were distributed over most portions of the continental shelf in the Middle Atlantic Bight, Georges Bank, and into the Gulf of Maine. Most individuals settled by 50−85 mm TL and reached approximately 60−120 mm TL by one year of age. Pelagic YOY fed on chaetognaths, hyperiid amphipods, calanoid copepods, and ostracods, and benthic YOY had a varied diet of fishes and benthic crustaceans.     The university administrator, preacher and poet Zachary Boyd (1585–1653) relied heavily on epithets and similes borrowed from Josuah Sylvester's poetry when composing his scriptural versifications Zion's Flowers(c. 1640?). The composition of Boyd's adaptation of Daniel 3, Nebuchadnezzars Fierie Furnace, provides an unusually lucid example of the reading and imitation practices of a mid-seventeenth-century Scottish Presbyterian in the years preceding civil war. This article begins by re-considering a manuscript transcription of Fierie Furnace held at the British Library previously described as an anonymous playtext from the early 1610s, then establishes the nature of Boyd's reliance on Sylvester by analyzing holograph manuscripts held at Glasgow University Library, a sermon Boyd wrote on the same theme, and the copy of Sylvester's Devine Weekes, and Workes that Boyd probably used.Arts and Humanities Research Counci

    Stripes in thin ferromagnetic films with out-of-plane anisotropy

    We examine the T=0 phase diagram of a thin ferromagnetic film with a strong out-of-plane anisotropy in the vicinity of the reorientation phase transition (with Co on Pt as an example). The phase diagram in the anisotropy-applied field plane is universal in the limit where the film thickness is the shortest length scale. It contains uniform fully magnetized and canted phases, as well as periodically nonuniform states: a weakly modulated spin-density wave and strongly modulated stripes. We determine the boundaries of metastability of these phases and point out the existence of a critical point at which the difference between the SDW and stripes vanishes. Out-of-plane magnetization curves exhibit a variety of hysteresis loops caused by the coexistence of one or more phases. Additionally, we study the effect of a system edge on the orientation of stripes.     AbstractDeletion mutants of the Ca2+ ATPase of rabbit fast-twitch skeletal muscle sarcoplasmic reticulum (SERCA1a) were constructed and expressed in COS-1 cells. The mutants were expressed at levels 7- to 15-fold lower than the wild-type and were inactive. In vitro transcription-translation-insertion experiments showed that deletion of transmembrane sequences M1 and M2, but not of M8, M9, M10 or the NH2−terminal 30 amino acids inhibited the stable insertion of the enzyme into the membrane. Thus there was no correlation between loss of function and membrane insertion. A signal sequence for membrane insertion may exist in M1 and M2

    Impact of breast cancer subtypes on 3-year survival among adolescent and young adult women.

    IntroductionYoung women have poorer survival after breast cancer than do older women. It is unclear whether this survival difference relates to the unique distribution of hormone receptor (HR) and human epidermal growth factor receptor 2 (HER2)-defined molecular breast cancer subtypes among adolescent and young adult (AYA) women aged 15 to 39 years. The purpose of our study was to examine associations between breast cancer subtypes and short-term survival in AYA women, as well as to determine whether the distinct molecular subtype distribution among AYA women explains the unfavorable overall breast cancer survival statistics reported for AYA women compared with older women.MethodsData for 5,331 AYA breast cancers diagnosed between 2005 and 2009 were obtained from the California Cancer Registry. Survival by subtype (triple-negative; HR+/HER2-; HR+/HER2+; HR-/HER2+) and age-group (AYA versus 40- to 64-year-olds) was analyzed with Cox proportional hazards regression with follow-up through 2010.ResultsWith up to 6 years of follow-up and a mean survival time of 3.1 years (SD = 1.5 years), AYA women diagnosed with HR-/HER + and triple-negative breast cancer experienced a 1.6-fold and 2.7-fold increased risk of death, respectively, from all causes (HR-/HER + hazard ratio: 1.55; 95% confidence interval (CI): 1.10 to 2.18; triple-negative HR: 2.75; 95% CI, 2.06 to 3.66) and breast cancer (HR-/HER + hazard ratio: 1.63; 95% CI, 1.12 to 2.36; triple-negative hazard ratio: 2.71; 95% CI, 1.98 to 3.71) than AYA women with HR+/HER2- breast cancer. AYA women who resided in lower socioeconomic status neighborhoods, had public health insurance, and were of Black, compared with White, race/ethnicity experienced worse survival. This race/ethnicity association was attenuated somewhat after adjusting for breast cancer subtypes (hazard ratio, 1.33; 95% CI, 0.98 to 1.82). AYA women had similar all-cause and breast cancer-specific short-term survival as older women for all breast cancer subtypes and across all stages of disease.ConclusionsAmong AYA women with breast cancer, short-term survival varied by breast cancer subtypes, with the distribution of breast cancer subtypes explaining some of the poorer survival observed among Black, compared with White, AYA women. Future studies should consider whether distribution of breast cancer subtypes and other factors, including differential receipt of treatment regimens, influences long-term survival in young compared with older women

    Next generation software environments : principles, problems, and research directions

    The past decade has seen a burgeoning of research and development in software environments. Conferences have been devoted to the topic of practical environments, journal papers produced, and commercial systems sold. Given all the activity, one might expect a great deal of consensus on issues, approaches, and techniques. This is not the case, however. Indeed, the term "environment" is still used in a variety of conflicting ways. Nevertheless substantial progress has been made and we are at least nearing consensus on many critical issues.The purpose of this paper is to characterize environments, describe several important principles that have emerged in the last decade or so, note current open problems, and describe some approaches to these problems, with particular emphasis on the activities of one large-scale research program, the Arcadia project. Consideration is also given to two related topics: empirical evaluation and technology transition. That is, how can environments and their constituents be evaluated, and how can new developments be moved effectively into the production sector
