    Penelitian ini dilakukan bertujuan untuk mengetahui bagaimana keabsahan perjanjian jual-beli melalui internet dan bagaimana akibat hukum apabila terjadi wanprestasi dalam jual-beli melalui internet. Dengan menggunakan metode penelitian yuridis normatif, maka dapat disimpulkan: 1. Perjanjian jual-beli melalui internet telah memenuhi syarat sahnya suatu perjanjian Pasal 1320 KUHPerdata yaitu kesepakatan, kecakapan, suatu hal tertentu, dan suatu sebab yang halal. Meskipun ada salah satu syarat perjanjian yang tidak terpenuhi yaitu mengenai syarat kecakapan para pihak, perjanjian jual-beli melalui internet tetap berlaku dan mengikat serta menjadi Undang-Undang bagi para pihak karena syarat kecakapan termasuk dalam syarat-syarat subjektif dimana suatu syarat meskipun tidak terpenuhi dalam perjanjian tidak menyebabkan perjanjian menjadi tidak sah, namun perjanjian tersebut dapat dimintakan pembatalan. Sedangkan jika syarat objektif yang tidak dipenuhi, maka perjanjian tersebut batal demi hukum. 2. Akibat wanprestasi yang dilakukan debitur atau pihak yang mempunyai kewajiban melaksanakan prestasi dalam perjanjian, dapat menimbulkan kerugian bagi kreditur atau pihak yang mempunyai hak menerima prestasi. Untuk itu bagi debitur atau pihak yang mempunyai kewajiban melaksanakan prestasi dalam perjanjian jual-beli melalui internet tetapi melakukan wanprestasi dapat menerima akibat hukum berupa membayar ganti kerugian yang diderita oleh kreditur, menerima putusan perjanjian disertai dengan pembayaran ganti kerugian, menerima peralihan resiko sejak saat terjadinya wanprestasi dan membayar biaya perkara jika diperkarakan di Pengadilan

    Prediction of toxicity of Ionic Liquids based on GC-COSMO method

    In order to evaluate the toxicity of several different ionic liquids (ILs) towards the leukemia rat cell line (ICP-81), an efficient and reliable quantitative structure-activity relationships (QSAR) model is developed based on descriptors from COSMO-SAC (conductor-like screening model for segment activity coefficient) model. The distribution of screen charge density (σ-profile) of 127 ILs is calculated by GC-COSMO (group contribution based COSMO) method. Two segmentation methods toward σ-profile are used to find out the appropriate descriptors for the QSAR model. The optimal subset of descriptors is obtained by enhanced replacement method (ERM). A multiple linear regression (MLR) and multilayer perceptron technique (MLP) are used to build the linear and nonlinear models, respectively, and the applicability domain of the models is assessed by the Williams plot. It turns out that the nonlinear model based the second segmentation method (MLP-2) is the best QSAR model with an R2=0.975, MSE=0.019 for the training set and R2=0.938, MSE=0.037 for the test set. The reliability and robustness of the presented QSAR models are confirmed by Leave-One-Out (LOO) cross and external validations

By collecting data and SPSS data analysis, this paper built a logistic regression model, verified the main factors influencing the network-lending platform collapse, and found out that all these elements including on-line time, term of loan, whether the platform has advanced the money, whether there are financing security companies to guarantee, as well as the management team’s academic background, had some influence on the collapse of the platform. This has positive significance for investors to identify the network-lending platform

    As one of the numerous merits brought by global financial integration, foreign direct investment (FDI) plays an indispensable role in fostering economic growth in the developing world. Different from previous literatures which concentrate on discussing the FDI productivity spillover effect, the paper provides evidence of the impact from FDI on the entry of new-born private firms by employing an exhaustive Chinese firm-level dataset. The paper confirms the vintage positive productivity spillover from FDI. It further suggests that larger share of foreign owned enterprises correlates significantly with less entry of new private firms in a given industry. Considering the vital role of new-born firms in facilitating private sector development, which in turn is crucial to sustainable economic growth, the paper recommends relevant authority carefully assessing the trade-off between positive productivity spillover effect and negative entry inhibition effect, before introducing more favored policies to attract foreign investor

    Computer-Aided Ionic Liquid Design and Experimental Validation for Benzene-Cyclohexane Separation

    For the purpose of designing ionic liquid (IL) solvents for the extractive separation of benzene/cyclohexane at 298.15 K, a computer-aided ionic liquid design (CAILD) method is developed. The UNIFAC-IL model is used to calculate the thermodynamic properties, while the group contribution (GC)-based methods are employed to estimate the physical properties and toxicity. A mixed-integer nonlinear programming (MINLP) problem is formulated, and the top five IL solvents are obtained by the BONMIN algorithm. One of the designed ILs [COC2MIM][Tf2N] (1-(2-methoxyethyl)-3-methylimidazolium bis(trifluoromethylsulfonyl)imide) is selected to perform the liquid-liquid extraction (LLE) experiment, and the distribution ratio and selectivity at 0.1 molar concentration of benzene in the raffinate phase are 1.20 and 17.10, respectively. The comparison with other solvents shows that the designed IL not only has an excellent separation performance but also favorable physical and environmental properties. After regressing the parameters for the NRTL model, the process simulation using the designed IL is developed by Aspen Plus, and the results are compared with that of the benchmark organic solvent sulfolane. The IL-based process needs 32475.1 kg/h of solvent and 1283 kW of heat duty, while the sulfolane-based process uses 43998.5 kg/h of solvent and 6296 kW of heat duty. These results demonstrating [COC2MIM][Tf2N] is a promising alternative to conventional solvents for the extractive separation of benzene/cyclohexane

    Melhoria da Atenção à Saúde da Pessoa com Hipertensão e/ou Diabetes na Unidade Básica de Saúde Vila Lizabel, Cruz Alta/RS

Trabalho de Conclusão de Curso (Curso de Especialização em Saúde da Família) - Departamento de Medicina Social, Faculdade de Medicina, Universidade Federal de Pelotas, Pelotas, 2015. A Hipertensão Arterial e Diabetes Mellitus são doenças muito frequentes na atenção primária e estão associadas à morbidade e mortalidade sendo responsáveis por complicações cardiovasculares, encefálicas, coronarianas, renais e vasculares periféricas. Com o propósito de reduzir a morbi-mortalidade associada à hipertensão arterial e diabetes mellitus realizou-se este estudo de intervenção na comunidade. Para guiar o cuidado foi adotado o protocolo do Ministério da Saúde Atenção a Hipertensão e Diabetes do Ministério da Saúde, Brasil, 2013. Para a coleta de dados foram utilizadas ficha espelho específica, bem como planilhas eletrônicas. A intervenção teve a duração de três meses com início em fevereiro e término em junho de 2015. Desta forma foi possível obter os seguintes resultados ao longo desta intervenção. No eixo monitoramento e avaliação foi possível monitorar a situação de saúde de 269 hipertensos (59,8%) e 83 diabéticos (74,1%) cadastrados, bem como avaliar o risco em 100% deles. Na organização e gestão do serviço, pode-se melhorar a qualidade dos registros, para isto foi adotado uma ficha específica para cadastramento e acompanhamento dos hipertensos e diabéticos, foi possível realizar exame clínico apropriado, solicitação de exames em dia conforme protocolo, prescrição de medicamentos da farmácia popular, avaliação da necessidade de atendimento odontológico, registro na ficha espelho, estratificação do risco cardiovascular por exame clínico em dia, que receberam orientações nutricionais para hábitos saudáveis e prática de atividade física, orientações ao tabagismo e orientações de saúde bucal em 100% dos hipertensos e diabéticos cadastrados. Foi realizado a organização por meio de uma agenda para os atendimentos, aliados aos atendimentos de demanda espontânea, todos os hipertensos e diabéticos que faltavam foram buscados pela equipe de saúde. No eixo engajamento público foi possível trabalhar a sensibilização da comunidade, bem como os familiares sobre a importância da equipe estar desenvolvendo este trabalho de priorização no cuidado para os idosos, através dos grupos de educação em saúde na comunidade. No eixo da qualificação da prática clínica foi possível capacitar todos os profissionais da equipe como base o protocolo de Saúde do Hipertenso e Diabético do Ministério da Saúde. Conclui-se que a intervenção foi avaliada como positiva pois conseguimos uma ótima meta de cobertura da atenção à saúde do hipertensos e diabéticos, assim como a intervenção será integrada à rotina diária do trabalho, visando nos próximos meses atingir os 100% preconizados. Desta forma, contribuiu para melhorar a atenção à saúde dos hipertensos e diabéticos, estabelecer vínculos entre a equipe e a comunidade assim como sensibilizou para a importância da saúde bucal no cuidado integral a este grupo.     Magnetically-accelerated photo-thermal conversion and energy storage based on bionic porous nanoparticles

    Recently, the technology of mixing phase change materials with high thermal conductivity fillers was developed, which has allowed thermal energy storage to be implemented in a wide range of industrial technologies and processes. In the present study, a hierarchical bionic porous nano-composite was prepared, which efficiently merged the nanomaterial characteristics of magnetism and high thermal conductivity in order to form a magnetically-accelerated solar-thermal energy storage method. The morphology and thermo-physical properties of materials were analysed. The experimental outcomes of phase change heat transfer demonstrated that the maximum storage efficiency increases by 102.7% when the hierarchical bionic porous structure is used, and a further 27.1% improvement can be achieved with the magnetic field. At the same time, the heat transfer process of energy storage in hierarchical porous composites under external physical fields is explained by simulation. Therefore, this magnetically-accelerated method demonstrated the superior solar-thermal energy storage characteristics within a hierarchical bionic porous structure which is particularly beneficial for the utilisation of solar direct absorption collectors and energy storage technology
