    Annual Survey of Virginia Law: Criminal Law and Procedure

    Because a large amount of the docket for the Court of Appeals of Virginia is comprised of criminal cases, and since the General Assembly regularly turns its attention to the questions of crime and punishment, in almost any year there are a great number of substantial developments in the criminal law. This past year was no exception. This article surveys developments in criminal law and procedure in Virginia from July 2000 to July 2001. Although this article is intended to survey significant developments over the past year, the reader is cautioned to bear in mind several important caveats

    Understanding and overcoming the barriers to structural steel reuse, a UK perspective

    To meet greenhouse gas emission targets, at global, national and sector level, reduction opportunities should be explored in both the embodied and operational carbon of the built environment. One underexploited option to reduce embodied carbon is the reuse of structural steel. However, in the UK, work by Sansom and Avery (2014) suggests a picture of declining levels of reuse. This paper explores why this is the case by identifying the practical barriers to structural steel reuse through a series of semi-structured interviews with UK construction industry members. Whilst there were many identified barriers, five practical barriers were prioritised as being most significant: cost, availability/storage, no client demand, traceability and supply chain gaps/lack of integration. These contrast with those most commonly identified in global literature: cost, supply chain gaps/integration, risk, jointing technique, composite construction and time for deconstruction; with only two overlaps: cost and supply chain gaps/integration. Many of the barriers from literature have a technical focus (reducing salvage yield rather than completely preventing reuse) differing from the largely systemic barriers that the interviews prioritised. These systemic barriers will need to be dealt with first to increase reuse rates. This will require a coordinated approach across the UK construction supply chain. Building on interview insights, this paper proposes four mechanisms to overcome these systemic barriers: (1) the creation of a database of suppliers/reused section availability, (2) a demonstration of client demand (3) technical guidance and education for the construction industry and (4) government leadership. Together these mechanisms would improve reuse rates in the UK, reduce the embodied emissions of the built environment and play a crucial role in meeting greenhouse gas emissions reduction targets

    A case of a 70 year old man who was found to have an extrahepatic portal vein aneurysm during an evaluation for hematuria is reported. Extrahepatic portal vein aneurysms are rare with only twenty cases reported in the literature. Typically, patients present with hemorrhage requiring surgical exploration or the aneurysm is discovered during evaluation of another abdominal process. Management includes careful follow-up in the asymptomatic patient without underlying liver disease or portal hypertension

    Solutions of the fully compressible semi-geostrophic system

    The fully compressible semi-geostrophic system is widely used in the modelling of large-scale atmospheric flows. In this paper, we prove rigorously the existence of weak Lagrangian solutions of this system, formulated in the original physical coordinates. In addition, we provide an alternative proof of the earlier result on the existence of weak solutions of this system expressed in the so-called geostrophic, or dual, coordinates. The proofs are based on the optimal transport formulation of the problem and on recent general results concerning transport problems posed in the Wasserstein space of probability measures

    NLO corrections to h → bb¯ decay in SMEFT

    We calculate the full set of next-to-leading order (NLO) corrections to h → b b¯¯ decay in the dimension-6 Standard Model Effective Field Theory (SMEFT). Our calculation forms the basis for precision studies of this decay mode in effective field theory, providing analytic and numerical results for contributions of the 45 dimension-6 operators appearing at NLO. On the technical side, we discuss several complications in NLO SMEFT computations which have not yet been addressed in the literature. These include subtleties in Higgs-Z mixing, electric charge renormalization, and especially the treatment of tadpoles in SMEFT. In particular, we highlight the role of decoupling relations in eliminating potentially large tadpole corrections to the decay rate in hybrid renormalization schemes which employ the MS¯¯¯¯¯¯¯ scheme for some Standard Model parameters (such as the b-quark mass and electric charge) and the on-shell scheme for others

    In vivo Conditions Induce Faithful Encoding of Stimuli by Reducing Nonlinear Synchronization in Vestibular Sensory Neurons

    Previous studies have shown that neurons within the vestibular nuclei (VN) can faithfully encode the time course of sensory input through changes in firing rate in vivo. However, studies performed in vitro have shown that these same VN neurons often display nonlinear synchronization (i.e. phase locking) in their spiking activity to the local maxima of sensory input, thereby severely limiting their capacity for faithful encoding of said input through changes in firing rate. We investigated this apparent discrepancy by studying the effects of in vivo conditions on VN neuron activity in vitro using a simple, physiologically based, model of cellular dynamics. We found that membrane potential oscillations were evoked both in response to step and zap current injection for a wide range of channel conductance values. These oscillations gave rise to a resonance in the spiking activity that causes synchronization to sinusoidal current injection at frequencies below 25 Hz. We hypothesized that the apparent discrepancy between VN response dynamics measured in in vitro conditions (i.e., consistent with our modeling results) and the dynamics measured in vivo conditions could be explained by an increase in trial-to-trial variability under in vivo vs. in vitro conditions. Accordingly, we mimicked more physiologically realistic conditions in our model by introducing a noise current to match the levels of resting discharge variability seen in vivo as quantified by the coefficient of variation (CV). While low noise intensities corresponding to CV values in the range 0.04–0.24 only eliminated synchronization for low (<8 Hz) frequency stimulation but not high (>12 Hz) frequency stimulation, higher noise intensities corresponding to CV values in the range 0.5–0.7 almost completely eliminated synchronization for all frequencies. Our results thus predict that, under natural (i.e. in vivo) conditions, the vestibular system uses increased variability to promote fidelity of encoding by single neurons. This prediction can be tested experimentally in vitro

    Compton Scattering of Fe K alpha Lines in Magnetic Cataclysmic Variables

    Compton scattering of X-rays in the bulk flow of the accretion column in magnetic cataclysmic variables (mCVs) can significantly shift photon energies. We present Monte Carlo simulations based on a nonlinear algorithm demonstrating the effects of Compton scattering on the H-like, He-like and neutral Fe K alpha lines produced in the post-shock region of the accretion column. The peak line emissivities of the photons in the post-shock flow are taken into consideration and frequency shifts due to Doppler effects are also included. We find that line profiles are most distorted by Compton scattering effects in strongly magnetized mCVs with a low white dwarf mass and high mass accretion rate and which are viewed at an oblique angle with respect to the accretion column. The resulting line profiles are most sensitive to the inclination angle. We have also explored the effects of modifying the accretion column width and using a realistic emissivity profile. We find that these do not have a significant overall effect on the resulting line profiles. A comparison of our simulated line spectra with high resolution Chandra/HETGS observations of the mCV GK Per indicates that a wing feature redward of the 6.4 keV line may result from Compton recoil near the base of the accretion column.Comment: Accepted for publication in MNRAS, 10 pages with 8 figure

    Education in the working-class home: modes of learning as revealed by nineteenth-century criminal records

    The transmission of knowledge and skills within the working-class household greatly troubled social commentators and social policy experts during the first half of the nineteenth century. To prove theories which related criminality to failures in working-class up-bringing, experts and officials embarked upon an ambitious collection of data on incarcerated criminals at various penal institutions. One such institution was the County Gaol at Ipswich. The exceptionally detailed information that survives on families, literacy, education and apprenticeships of the men, women and children imprisoned there has the potential to transform our understanding of the nature of home schooling (broadly interpreted) amongst the working classes in nineteenth-century England. This article uses data sets from prison registers to chart both the incidence and ‘success’ of instruction in reading and writing within the domestic environment. In the process, it highlights the importance of schooling in working-class families, but also the potentially growing significance of the family in occupational training
