Tien jaar internationaal namenrecht in Nederland
Sinds tien jaar gelden in Nederland verdragsregels aangevuld
met commune regels voor het IPR inzake namen. De wettelijke
regeling is sinds begin vorig jaar gewijzigd. De invoering van
de naamskeuze in het Nederlandse materiële namenrecht (artikel
1:5 leden 2-4 BW) gaf hiertoe aanleiding. In deze bijdrage
worden vooral de nieuwe bepalingen in de Wet conflictenrecht
namen besproken. Verder wordt de vraag gesteld of op het
gebied van het IPR inzake namen niet meer uniformiteit in de
vorm van een Europees internationaal namenrecht nodig en
mogelijk is
The limitation of actions in the international sale of goods
The purpose of this article is to assess whether the arguments advanced by a number of
countries of the European Union at the time of the conclusion of the Limitation Convention in
1974 and at the time of the amendment in 1980 for not becoming a party to this important
instrument of unification are still convincing today. For this purpose it is essential to have a
nodding acquaintance with the Convention. I shall also deal with private international law
aspects of the limitation of actions in the international sale of goods
El avance de la custodia compartida en los paÃses del sur de Europa. Algunas consideraciones crÃticas
En los países europeos se ha generado un proceso de cambio de las familias y de las políticas familiares. Como consecuencia de ello, en los últimos años se han producido un conjunto de importantes reformas en el ámbito del derecho de familia europeo. En este artículo se analizan esas reformas y el alcance práctico de las mismas en España; pero teniendo en cuenta el marco de los países del sur de Europa (Francia, Italia y Portugal). De entrada el análisis de las mismas pondrá en evidencia un claro reforzamiento del principio de autonomía de la voluntad y el principio de co-parentalidad después del divorcio o ruptura. Finalmente se propondrán algunas reflexiones críticas desde una perspectiva de género
Children and Their Parents: A Comparative Study of the Legal Position of Children with Regard to Their Intentional and Biological Parents in English and Dutch Law
This is a book about children and their parents. There are many different kinds of children and at least about as many different kinds of parents. In addition to the many different disciplines that study children and their parents, such as sociology, psychology, child studies and gender studies, to name but a few, this study concerns a legal question with regard to the parent-child relationship, namely how the law assigns parents to children. This subject is approached in a comparative legal perspective and covers England and The Netherlands. The book contains a detailed comparison and analysis of the manner in which the law in the two jurisdictions assigns the status of legal parent and/or attributes parental responsibility to the child’s biological and intentional parents. The concept ‘procreational responsibility’, which is introduced in the concluding chapter of the book, may be used as a tool to assess and reform existing regulations on legal parent-child relationships.
