    Interdisciplinarity and Clinical Legal Education: how synergies can improve access to rights in prison

    This article discusses the resistance experienced by the clinical legal education movement in Italy due to a widespread legal positivist approach which views law as a self-contained technical subject, and excludes interdisciplinarity from the law school curriculum.The choice that the newly-born Italian CLE movement now faces is the option to either become a new socio-legal epistemology of law in action and a social change-maker, or to ascribe to a simple restyling of legal education to include certain practical activities aimed at introducing students to the profession. The future of the movement will depend on whether the rapid increase in the number of clinics will be matched by appropriate reflection on "how clinics might be consciously designed around exposing students to gaps between the law in books and the law in action"

    There is consensus in disapproving the journalistic articles written by Foucaultabout the Iranian revolution. They are considered clear mistakes. Some say that this is so because the enthusiasm of Foucault towards the Islamic revolution moved him away from his true theoretical interests; others say that what those texts reveal is a totalitarian, naïve, and even misogynistic background of his philosophy. By doing this, commentators spear themselves a hermeneutical work on the incorporation of those texts into a work whose general bet remains the subject of academic discussion. In this paper, we propose an alternative approach to the issue; one in which the texts are not considered a mistake but rather they are seen as part of a diagnosis that can get some light from the ideas of travel, radical journalism and heterotopology. These considered as fundamental elements of a philosophical bet on alterity.Existe un consenso general en torno a la condena de los textos de Foucault sobrela revolución iraní, a los que se considera un error manifiesto, ya sea debido a que el entusiasmo por la revolución islámica lo habría alejado imprudentemente de sus verdaderos intereses teóricos, ya sea debido a que ellos revelan un trasfondo totalitario, ingenuo y hasta misógino de su filosofía, lo cual, por supuesto, ahorra a los comentadores un trabajo hermenéutico sobre la inserción de tales escritos en una obra cuya apuesta general aún es objeto de disputa académica. En este trabajo proponemos una vía alternativa de comprensión que no toma estos textos como un error, sino como parte de un diagnóstico al que se busca echar luz a través de la dimensión del viaje, el periodismo radical y la heterotopología como elementos fundamentales de una apuesta filosófica por la alteridad

    “As richly described in the various chapters of this book, we see that clinics can act as a window to the functioning of law and the legal system. Clinics allow students and faculty to see how laws and the legal system are functioning for groups of people who otherwise likely would not be a part of the common experience of professors and their students: poor people generally, migrants and refugees, women and children exploited by trafficking, people with disabilities, ethnic minorities, prisoners, and so on. Legal systems the world over tend to give less care and attention to the problems of the poor and other disempowered groups, and such people usually lack access to well-educated legal advocates to help them fight to make the legal system work for them. Through clinic cases, students and faculty see the day-today lives of people marginalized by the society, see how the law affects and influences their lives, and see how it serves or fails to serve them. For law professors involved in clinical education, such as the authors of this book, heightened awareness of the law’s operation for poor people adds another important perspective to the subjects of their research and work as commentators on the law. Students can also be inspired to select topics for research papers, master or PhD theses by exposure to problems in the law and legal system as it functions for their clients.” (Dall’introduzione

    This paper proposes an analysis of a corpus of texts from Italian travelers in Argentina during the late nineteenth and early twentieth centuries. Compared with other European travelers texts (French, English), which shows an already developed sentiment of national community, the case of Italians is paradoxical: they belong to one of the youngest nations which, at the same time, is considered the richest in history and traditions among all other Europeans countries.El presente ensayo propone el análisis de un corpus de textos de viajeros italianos en la Argentina de finales del siglo XIX y principios del XX. En comparación con otros viajeros europeos (france-ses, ingleses), en cuya visión se percibe la presencia de un “nosotros” nacional ya desarrollado, en el caso de los italianos se evidencia una situación paradójica: pertenecen a una de las naciones europeas más jóvenes que, al mismo tiempo, es considerada como la más rica en historia y tradiciones entre las del resto del continente

    En este artículo se abordarán críticamente las hipótesis de lectura que Bidet y Collier proponen sobre el segundo Foucault con el objetivo de determinar en qué aspecto son pertinentes y bajo qué condiciones se pueden articular entre sí. Ello nos permitirá delinear una estrategia de interpretación que no sólo tome a los cursos como una serie, sino que también explique el tipo de la relación que guardan entre sí soberanía, disciplina y seguridad, pues de ello depende la posibilidad de comprensión del proyecto de una historia política de la gubernamentalidad.
