Using a provision's legislative history as an instrument for interpretation - several observations based on judgments of Polish administrative courts
The era of advanced information technologies, allowing free access to the electronic versions of legislative materials, has opened up new opportunities for searching for traces of legislative intent, thus starting a new chapter of reflecting on the admissible or preferable tools for interpretation in various disciplines of law. This kind of discussion appears particularly significant for such areas of the law as fiscal law and administrative
law, both of which interfere with the rights and freedoms of citizens, who may be acutely affected should they base their decisions on an incorrect interpretation of a regulation, and subsequently decide on a solution that will later be rejected by public administration authorities..

Podmioty w dyskursie interpretacyjnym : motywacja, interes a wybór rezultatu
The process of interpretation is not uniform — this obvious statement is multifaceted.
Some of them, although intuitively felt, have not been given any broader analysis
so far. The issue of the subjects/entities giving interpretations: their rights, obligations,
restrictions, legitimised intentions, is what makes up such a facet. Paradoxically, despite
the fact that the lawgiver is not an individual entity, almost exclusively the construct
of its ‘intentions’ and ‘objectives of acting’ is discussed and analysed as a factor that
should / should not influence the interpretative process and its final results. Amazingly
enough, nothing has been said about the role of the interpreter’s intention, motivation
and expected results in the process of interpretation. Thus, it seems to be neglected an important
component of the interpretive activity — a full picture of those who with the help
of law pursue promoting their own interests. This text does not constitute a comprehensive
study, but rather aims to encourage reflection on the circle of entities giving interpretations,
and their division into categories. On this basis, some of the differences and similarities in
the way of interpretation resulting from the difference of the position and interests of each
category of entities will be presented, with a special emphasis on the issues of lying and
honesty

The paper aims to analyse and compare the interpretative function of legislative history in the judicial activity of the European Court of Justice and Polish courts. The authors have analysed judgments of the respective courts, focusing on the role of legislative history in their argumentation. In the Polish and European doctrine, the usefulness of travaux preparatoires has been underestimated. Nevertheless, legislative history may provide arguments important in judicial reasoning both in uni- and multilingual legal systems. However, its importance and functions in Polish and European cases examined herein are different. The research conducted enables a better understanding of the interpretative value of legislative history in legal interpretation and can result in more frequent use of this tool in the judicial activity of national and European courts.Celem pracy jest analiza i porównanie interpretacyjnego znaczenia historii legislacyjnej w działalności orzeczniczej Europejskiego Trybunału Sprawiedliwości i sądów polskich.Autorki analizują orzeczenia sądów, koncentrując się na roli historii legislacyjnej w używanej przez sądy argumentacji. W doktrynie polskiej i europejskiej użyteczność travaux preparatoires nie jest dostatecznie doceniana. Niemniej jednak historia legislacyjna może dostarczyć w procesie wykładni tekstu prawnego istotnych argumentów i to zarówno w jednojęzycznych, jak i wielojęzycznych systemach prawnych. Przeprowadzone badania pozwalają na lepsze zrozumienie wartości interpretacyjnej materiałów legislacyjnych w interpretacji prawniczej i mogą przyczynić się do zwiększenia użyć tego narzędzia w działalności sądowej sądów krajowych i europejskich
Materiały legislacyjne jako głos prawodawcy w dyskursie o zasadach prawa
Przedmiot rozważań podjętych w opracowaniu stanowi kwestia możliwości wykorzystania
materiałów legislacyjnych w procesie określania katalogu zasad prawa oraz ustalania ich treści.
Punktem wyjścia dla zaprezentowanych przez autorów analiz było przekonanie o tym, że ustalenie
katalogu zasad prawa i ich treści jest budowane w drodze dyskursu. Elementem tego dyskursu jest
głos prawodawcy w postaci „śladów” pozostawionych w różnych miejscach. Interpretator może
zarówno sięgać po wypowiedzi prawodawcy znajdujące się w tekstach aktów normatywnych, jak
i wykorzystać wypowiedzi zaczerpnięte z treści materiałów legislacyjnych. Do niedawna – w związku
z brakiem wystarczającej dostępności dokumentów wytworzonych w toku procesu legislacyjnego
– materiały te były bardzo rzadko wykorzystywane w dyskursie o zasadach prawa. Autorzy na
przykładzie analizy materiałów legislacyjnych powstałych w toku dokonanej w 2017 roku nowelizacji
Kodeksu postępowania administracyjnego z 1960 roku, której efektem było wprowadzenie do
prawa administracyjnego procesowego nowych zasad i poddanie pewnym modyfikacjom dotychczas
uznawanych, dowodzą, że materiały te mogą być cennym źródłem informacji o intencji prawodawcy.
Na zakończenie rozważań sformułowano wniosek ogólny, że mimo iż w naszej tradycji
nie dokonywano odtwarzania katalogu i treści zasad prawa w oparciu o materiały legislacyjne, wobec
aktualnych możliwości dostępu jakie dają technologie informatyczne, wzbogacenie kontekstu
decydującego o ustaleniu katalogu i treści poszczególnych zasad przez wykorzystanie materiałów
legislacyjnych wydaje się kierunkiem niezbędnym

Using Legislative History in Interpreting Polish Law Example of Changes in Uderstanding Principles of Law Durig the Transition Period
The article discusses changes in the fundamental legal principles which took place in Central
and Easter European countries during the period of system transformation of the late 1980s
and the early 1990s, presented from the perspective of Polish experience. It encompasses
an analysis of the changes which were made in this period in the Constitution of the Polish
People’s Republic of 1952 and selected acts. The authors have studied legislative materials
of the Sejm of the Republic of Poland of the 10th term (the so-called Contract Sejm elected
in the aftermath of the Round Table Agreement, which paved the way to democratic
changes in Poland) which amended the aforementioned acts. It is the authors’ belief that the
legislative materials are a valuable source of information on the legislative intent as they
make it possible to identify the underlying objectives behind the changes made as well as the
meaning the legislator intended to attribute to the new provisions. The research revealed that
during the period of system transformation, new provisions were introduced to the Polish
law which led to the establishment of new legal principles fundamental for the system (e.g.
the democratic state under the rule of law principle); some provisions were amended and
the terms used therein were reformulated so as to correspond to the goals of the state post-
Communist transformation (e.g. the principle of the people’s rule of law was transformed into
the principle of the rule of law) while the other provisions, although left in their then-current
wording, over the course of time, received a new meaning (e.g. the principle which requires
that civil law relationships should take account of the rules of social coexistence). The
authors believe the paper can be an interesting source of information for readers in the Czech
Republic, which just like Poland, after the dissolution of the Eastern Bloc, was faced with
challenges related to changing the jurisprudence in the aftermath of the system transformation
On why the Court did not want to fight smog, or several comments on the resolution of the Polish Supreme Court on the right to live in a clean environment
The authors analyse the 2021 ruling by the Polish Supreme Court, which refused to acknowledge the right to live in a clean environment as a personal interest. The purpose of the paper is not only to evaluate the quality of the Supreme Court’s argumentation, but also to highlight the implicit premises that were missing from the grounds of the decision. Based on these findings, the authors draw broader conclusions about the circumstances that increase the likelihood of pro-environmental (including pro-climate) court decisions and breakthroughs in interpretation. The authors use the latter term to describe the situation of challenging the previous, widely accepted interpretation of certain legal provisions, favouring a different interpretation that considers societal changes in values and beliefs. The authors evaluate the Supreme Court’s arguments and put forward the thesis that the construction of personal interests was not the primary reason for rejecting the recognition of the right to live in a clean environment as a new personal interest. The authors used two methods to search for the hidden premises of the Supreme Court’s resolution: (i) they examined the discourse supporting the rejection of the right to live in a clean environment as a personal interest, and (ii) they placed the resolution in its socio-political context. The authors identify four conditions that increase the likelihood of pro-environmental (and pro-climate) court judgments: (i) the condition of costs’ expediency, (ii) the condition of individualization of responsibility, (iii) the condition of respect for the judiciary and (iv) the condition of public support. The last two conditions apply to interpretative breakthroughs in general, regardless of the subject matter
Legislative materials as a tool for solving grammatical problems in statutory interpretation
The article begins with a presentation of an interpretative tool in the form of materials from the legislative process (legislative materials, legislative history), including arguments offered in the theory of law in favour and against their use for interpretation purposes. These matters are then discussed with references to a specific type of interpretive problems, namely problems that stem from the grammatical constructions of the provisions of the law. The authors analyse five cases in which Polish courts reach for legislative materials in order to resolve doubts caused by sentence syntax, conjunctions or punctuation. The decisions issued vary – in their use of legislative materials courts deploy various other tools and values (e.g. vocabularies, formal logic, the ratio legis behind a provision or the rules of legislative procedure). The outcomes of such a confrontation are varied. Thus, the judgments presented here are a good illustration of the diversity of issues connected with the theoretical and practical aspects of the use of legislative materials in the process of interpreting the law
