    Ancillary Agreements in Real Estate Transactions

    This article discusses certain ancillary but important documents in the context of two common real estate transactions: mortgage loan financings and acquisitions of income-producing real estate. In particular, the article analyzes current case law and drafting considerations relating to estoppel certificates, certified rent rolls and subordination, non-disturbance agreements (SNDAs). In addition, the article examines due diligence issues for the lender and buyer.     A Rare Presentation of Plasmablastic Lymphoma in a HIV-negative Male Status-post Liver Transplantation

    Introduction: Plasmablastic lymphoma, a rare and aggressive form of Non-Hodgkins lymphoma, rarely presents as a retroperitoneal mass.  There are no case reports in the literature of plasmablastic lymphoma presenting in living, HIV-negative patient status post liver transplantation.Presentation of Case: We report the case of a 63 year-old HIV-negative male status post liver transplant who presented with weakness and obstructive uropathy. Imaging showed a large mass in the retroperitonium. Biopsy revealed plasmablastic lymphoma. CHOP therapy was initiated and after six cycles, the retroperitoneal mass regressed in size; however, cytology from pleural fluid revealed that the disease remained. It has been 9 months since initial diagnosis and he was started on salvage chemotherapy with ESHAP however he subsequently developed a treatment related myelodysplastic syndrome with trisomy 12.Conclusions: The present case is used to explore the presentation and treatment of plasmablastic lymphoma, and to review the literature concerning the rarity of this disease in the setting of a HIV-negative patient status post solid organ transplantation

    Beam-spin asymmetry Σ\boldsymbol{\Sigma} for Σ\Sigma^- hyperon photoproduction off the neutron

    We report a new measurement of the beam-spin asymmetry Σ\boldsymbol{\Sigma} for the γnK+Σ\vec{\gamma} n \rightarrow K^+\Sigma^- reaction using quasi-free neutrons in a liquid-deuterium target. The new dataset includes data at previously unmeasured photon energy and angular ranges, thereby providing new constraints on partial wave analyses used to extract properties of the excited nucleon states. The experimental data were obtained using the CEBAF Large Acceptance Spectrometer (CLAS), housed in Hall B of the Thomas Jefferson National Accelerator Facility (JLab). The CLAS detector measured reaction products from a liquid-deuterium target produced by an energy-tagged, linearly polarised photon beam with energies in the range 1.1 to 2.3 GeV. Predictions from an isobar model indicate strong sensitivity to N(1720)3/2+N(1720)3/2^+, Δ(1900)1/2\Delta(1900)1/2^-, and N(1895)1/2N(1895)1/2^-, with the latter being a state not considered in previous photoproduction analyses. When our data are incorporated in the fits of partial-wave analyses, one observes significant changes in γ\gamma-nn couplings of the resonances which have small branching ratios to the πN\pi N channel.Comment: 9 pages, 4 figures, Hadron Spectroscop

    Incommensurable worldviews? Is public use of complementary and alternative medicines incompatible with support for science and conventional medicine?

    Proponents of controversial Complementary and Alternative Medicines, such as homeopathy, argue that these treatments can be used with great effect in addition to, and sometimes instead of, ?conventional? medicine. In doing so, they accept the idea that the scientific approach to the evaluation of treatment does not undermine use of and support for some of the more controversial CAM treatments. For those adhering to the scientific canon, however, such efficacy claims lack the requisite evidential basis from randomised controlled trials. It is not clear, however, whether such opposition characterises the views of the general public. In this paper we use data from the 2009 Wellcome Monitor survey to investigate public use of and beliefs about the efficacy of a prominent and controversial CAM within the United Kingdom, homeopathy. We proceed by using Latent Class Analysis to assess whether it is possible to identify a sub-group of the population who are at ease in combining support for science and conventional medicine with use of CAM treatments, and belief in the efficacy of homeopathy. Our results suggest that over 40% of the British public maintain positive evaluations of both homeopathy and conventional medicine simultaneously. Explanatory analyses reveal that simultaneous support for a controversial CAM treatment and conventional medicine is, in part, explained by a lack of scientific knowledge as well as concerns about the regulation of medical research

    Flow through a circular tube with a permeable Navier slip boundary

    For Newtonian fluid flow in a right circular tube, with a linear Navier slip boundary, we show that a second flow field arises which is different to conventional Poiseuille flow in the sense that the corresponding pressure is quadratic in its dependence on the length along the tube, rather than a linear dependence which applies for conventional Poiseuille flow. However, assuming that the quadratic pressure is determined, say from known experimental data, then the new solution only exists for a precisely prescribed permeability along the boundary. While this cannot occur for conventional pipe flow, for fluid flow through carbon nanotubes embedded in a porous matrix, it may well be an entirely realistic possibility, and could well explain some of the high flow rates which have been reported in the literature. Alternatively, if the radial boundary flow is prescribed, then the new flow field exists only for a given quadratic pressure. Our primary purpose here is to demonstrate the existence of a new pipe flow field for a permeable Navier slip boundary and to present a numerical solution and two approximate analytical solutions. The maximum flow rate possible for the new solution is precisely twice that for the conventional Poiseuille flow, which occurs for constant inward directed flow across the boundary

    The Distinct Conformational Dynamics of K-Ras and H-Ras A59G

    Ras proteins regulate signaling cascades crucial for cell proliferation and differentiation by switching between GTP- and GDP-bound conformations. Distinct Ras isoforms have unique physiological functions with individual isoforms associated with different cancers and developmental diseases. Given the small structural differences among isoforms and mutants, it is currently unclear how these functional differences and aberrant properties arise. Here we investigate whether the subtle differences among isoforms and mutants are associated with detectable dynamical differences. Extensive molecular dynamics simulations reveal that wild-type K-Ras and mutant H-Ras A59G are intrinsically more dynamic than wild-type H-Ras. The crucial switch 1 and switch 2 regions along with loop 3, helix 3, and loop 7 contribute to this enhanced flexibility. Removing the gamma-phosphate of the bound GTP from the structure of A59G led to a spontaneous GTP-to-GDP conformational transition in a 20-ns unbiased simulation. The switch 1 and 2 regions exhibit enhanced flexibility and correlated motion when compared to non-transitioning wild-type H-Ras over a similar timeframe. Correlated motions between loop 3 and helix 5 of wild-type H-Ras are absent in the mutant A59G reflecting the enhanced dynamics of the loop 3 region. Taken together with earlier findings, these results suggest the existence of a lower energetic barrier between GTP and GDP states of the mutant. Molecular dynamics simulations combined with principal component analysis of available Ras crystallographic structures can be used to discriminate ligand- and sequence-based dynamic perturbations with potential functional implications. Furthermore, the identification of specific conformations associated with distinct Ras isoforms and mutants provides useful information for efforts that attempt to selectively interfere with the aberrant functions of these species
