Initial remarks on artificial intelligence and axiological foundations of labour law
Progressive technological development forces a new look at the basic constructs of labour law. The science of labour law has so far paid little attention to the legal analysis of the risks associated with the ever-increasing interaction between people and technological tools, both in the form of advanced machinery as well as software used to manage enterprises and production processes. At the same time, questions about the future of labour law have long been posed in the science of labour law, primarily raising the need to realize the principle of social justice when work is not performed within the framework of the traditionally understood employment relationship (under employee subordination). The present study is a voice in this discussion, focusing on the issue of artificial intelligence in relation to the axiological foundations of labour law. The article analyzes the humanisation of work and human interaction in the world of new technologies primarily from the perspective of the central value of labour law, which is the inherent and inalienable dignity of the employee as a human being. There is also a consideration of the concept of autonomisation of the employee in the work process using artificial intelligence
Ochrona dóbr osobistych sprawcy mobbingu w kontekście wyroku Europejskiego Trybunału Praw Człowieka z dnia 6 listopada 2018 r. (Vicent Del Campo przeciwko Hiszpanii, skarga nr 25527/13)
The employer is not always the perpetrator of mobbing. The employer’s responsibility
for the actions of other people results from the employer’s breach of the obligation
to counter mobbing (Article 943 § 1 of the Labour Code). Certainly, mobbing is
a negative, undesirable phenomenon, and the interpretation of regulations shaping
the employer’s responsibility for the effects of mobbing should take into account the
aim of completely eliminating this phenomenon from the work environment. Precisely
because of this aim, it is vital to discuss in broader terms, from the perspective of
art. 943 of the Labor Code, the position expressed by the European Court of Human
Rights in the justification of the judgment of November 6, 2018 (Vicent Del Campo v.
Spain, no. 25527/13), which emphasized that the personal data of an employee who was
not a party to court proceedings, with the indication that this employee committed acts
of psychological harassment of another employee, constitutes a violation of the right
of the perpetrator of these acts to respect his private life
Self-Employment and Protection from Mobbing and Discrimination
Work under civil law contracts has become increasingly popular in recent years. Primarily young people (entering the labour market) are employed based on civil law contracts. A similar phenomenon is a gainful activity within the so-called self-employment under conditions of economic dependence on one’s contractor. Awareness of the dissemination of non-employment forms of employment has led the authors to consider possible forms of protection against mobbing and discrimination in the case of self-employment. These phenomena (mobbing and discrimination) are generally associated with the relationship between employer and employee. However, the mere fact of a different type of employment does not exclude the risk of ‘mobbing’ or discrimination. In such circumstances, it is almost natural to explore possible forms of protection. The authors have analysed the existing legal regulations in search of available solutions that can provide adequate protection for the self-employed.Na przestrzeni ostatnich lat zatrudnienie niepracownicze zyskuje coraz większą popularność. Szczególnie osoby młode (wchodzące na rynek pracy) zatrudnianie są na podstawie umów cywilnoprawnych. Podobnym zjawiskiem jest aktywność zarobkowa w ramach tzw. samozatrudnienia w warunkach zależności ekonomicznej od swojego kontrahenta. Świadomość upowszechniania niepracowniczych form zatrudnienia skłoniła autorów do podjęcia rozważań nad możliwymi formami ochrony przed mobbingiem i dyskryminacją w przypadku pracy na własny rachunek. Oba te zjawiska (mobbing i dyskryminacja) generalnie kojarzone są z relacjami zachodzącymi na linii pracodawca–pracownik. Sam fakt innego rodzaju zatrudnienia nie wyłącza jednak ryzyka mobbingu lub dyskryminacji. W takich okolicznościach badanie możliwych form ochrony jest niemal naturalne. Autorzy przeprowadzili analizę obowiązujących regulacji prawnych w poszukiwaniu dostępnych rozwiązań, które mogą stanowić skuteczną ochronę pracujących na własny rachunek

The reason for writing this article was the generation (by an algorithm called “Quakebot” written
in programming language by the “Los Angeles Times” journalist, Ken Schwencke) of a press
release about the earthquake that was registered five miles from Westwood (California, USA) on
23 December 2013. This information was prepared on the basis of the USGS Earthquake Notification
Service message posted on the government website. The article formulates the view that the
personal nature of employment does not exclude the possibility of creating a work with the use of
artificial intelligence. In addition, it was found that the piece of work does not lose its legal character
even if it was created with the use of public sector information, as well as that it is acceptable to
re-use public sector information for commercial purposes, obtained through Artificial Intelligence
Hypoglycaemic episodes in patients with diabetes in course of liver cirrhosis
WSTĘP. Celem pracy była ocena liczby zdarzeń i czasu
trwania hipoglikemii, w tym nieuświadomionych,
zarejestrowanych systemem ciągłego monitorowania
glikemii (CGMS, continuous glucose monitoring
system) u chorych na cukrzycę rozpoznaną w przebiegu
marskości wątroby.
MATERIAŁ I METODY. Do badania włączono 18 chorych
z cukrzycą zdiagnozowaną w przebiegu marskości
wątroby. Grupę kontrolną stanowiło 18 chorych
na cukrzycę typu 2. Badanie przeprowadzono
w warunkach ambulatoryjnych w Poradni Diabetologicznej
Kliniki Kardiologii Interwencyjnej, Kardiodiabetologii
i Rehabilitacji Kardiologicznej w Łodzi.
Czas rejestracji epizodów niedocukrzeń za pomocą
CGMS wynosił 72 godziny dla jednego chorego. Niedocukrzenie
rozpoznawano przy wartości glikemii
poniżej 60 mg/dl.
WYNIKI. Liczba klinicznie jawnych hipoglikemii była
prawie 2-krotnie większa w grupie chorych na cukrzycę
z marskością wątroby niż w grupie kontrolnej
(p = 0,02). Liczba hipoglikemii o niemym klinicznie
przebiegu nie różniła istotnie badanych grup (NS).
Analizując średni czas trwania hipoglikemii, w tym
nieuświadomionych, nie zaobserwowano istotnych
różnic między badanymi grupami (NS).
WNIOSKI. Chorzy na cukrzycę w przebiegu marskości
wątroby są narażeni na częstsze epizody jawnych
klinicznie niedocukrzeń niż chorzy na cukrzycę typu 2
bez marskości wątroby. System CGMS jest przydatny
w diagnostyce niedocukrzeń u chorych na cukrzycę
w przebiegu marskości wątroby.INTRODUCTION. The aim of the study was to evaluate
hypoglycaemic episodes, including symptomfree
events detected with continuous glucose monitoring
system (CGMS) in patients with diabetes
mellitus in course of liver cirrhosis.
MATERIAL AND METHODS. 18 patients with diabetes
in course of liver cirrhosis and 18 type 2 diabetic
patients (control group) were enrolled into the study.
All patients were treated with insulin. During
72 hours glucose values with CGMS was measured,
insulin treatment was not modified. The state of hypoglycemia
assumed as glucose value < 60 mg/dl.
Duration and number of hypoglycaemic events, including
symptom-free hypoglycaemic episodes were
analyzed in both groups.
RESULTS. Mean number of hypoglycaemic events
detected with CGMS for three days was higher for
patients with hepatogenous diabetes than for type 2
patients (p = 0.02). Mean number of symptom-free
hypoglycaemic events detected with CGMS was statistically
similar in both groups (NS). Mean duration of hypoglycaemic episodes, including symptom-free
hypoglycaemic episodes was similar in both groups
(NS).
CONCLUSIONS. It was concluded, that hepatogenic
diabetes is associated with essentially higher number
of hypoglycaemic events than type 2 diabetes.
CGMS is useful in diabetic patients with liver cirrhosis
for hypoglycaemic episodes detection
Evaluation of selected biochemical glycemic and lipid parameters in type 2 diabetic patients with
WSTĘP. Celem pracy było porównanie wybranych parametrów
biochemicznych, będących elementami zespołu metabolicznego
u chorych na cukrzycę typu 2 z "nadciśnieniem białego fartucha"
oraz z prawidłowymi wartościami ciśnienia tętniczego.
MATERIAŁ I METODY. Do badania włączono 85 chorych na cukrzycę
typu 2 bez stwierdzonego dotychczas nadciśnienia tętniczego, u których
oznaczano ciśnienie tętnicze metodą Korotkowa w warunkach
gabinetu lekarskiego. U wszystkich chorych przeprowadzono 24-godzinne
ambulatoryjne monitorowanie ciśnienia tętniczego (ABPM,
ambulatory blood pressure monitoring). Z dalszego udziału w badaniu
wykluczono chorych (n = 28), u których stwierdzono nadciśnienie tętnicze
(ciśnienie tętnicze w ABPM w ciągu dnia > 135/85 mm Hg).
W celu zdiagnozowania "nadciśnienia białego fartucha" porównywano
wartości ciśnienia tętniczego z ABPM w ciągu dnia z wartościami "gabinetowego ciśnienia tętniczego". Rozpoznawano "nadciśnienie białego
fartucha", stwierdzając średnie ciśnienie tętnicze z ABPM w ciągu
dnia 140/90
mm Hg. Ostatecznie do badania zakwalifikowano 57 chorych, których
podzielono na dwie grupy. Grupę 1 (n = 23) stanowiły osoby
z rozpoznaniem "nadciśnienia białego fartucha", a grupę 2 (n = 34)
- osoby z prawidłowymi wartościami ciśnienia tętniczego (ciśnienie
tętnicze z ABPM w ciągu dnia < 135/85 mm Hg, a gabinetowe < 140/
90 mm Hg). Chorym oznaczono glukozę na czczo, hemoglobinę glikowaną,
fibrynogen, kwas moczowy, cholesterol całkowity, triglicerydy
oraz cholesterol frakcji LDL w surowicy krwi.
WYNIKI. Wartości oznaczonych parametrów biochemicznych nie
różniły się istotnie między badanymi grupami (p > 0,05).
WNIOSKI. Chorzy na cukrzycę typu 2 z "nadciśnieniem białego
fartucha" oraz chorzy, u których nie występuje ten typ nadciśnienia,
nie różnią się istotnie stężeniem kwasu moczowego, fibrynogenu,
cholesterolu całkowitego, triglicerydów, cholesterolu frakcji
LDL, hemoglobiny glikowanej i glukozy na czczo w surowicy krwi.INTRODUCTION. The aim of the study was to compare serum level
of selected biochemical parameters - elements of metabolic
syndrome in type 2 diabetic patients with "white coat hypertension"
and with normal blood pressure.
MATERIAL AND METHODS. The study comprised 85 type 2 diabetic
patients without hitherto arterial hypertension diagnosis. In
all patients blood pressure with use of mercurial sphygmomanometer
and 24 h ambulatory blood pressure monitoring (ABPM) were
performed. The patients (n = 28) with diagnosed sustained arterial
hypertension (blood pressure values > 135/85 mm Hg) were
excluded. "White coat hypertension" was detected in case of mean
blood pressure values in ABPM during the day were < 135/85 mm Hg
and "office blood pressure" > 140/90 mm Hg. Normal blood pressure
was when ABPM values were < 135/85 mm Hg and "office
blood pressure" were < 140/90 mm Hg. 57 patients were devided
into two groups. The group 1 (n = 23) comprised patients with
"white coat hypertension" and group 2 (n = 34) consisted of normotensive
patients. In all patients total cholesterol, triglicerydes,
LDL-cholesterol, urine acide, fibrynogen, glycated hemoglobin and
fasting glycemia were estimated.
RESULTS. The values of studied serum biochemical parameters
didn’t differ both studied groups (p > 0.05).
CONCLUSIONS. It were not significant differences in biochemical
parameters: total cholesterol, triglicerydes, LDL-cholesterol, urine
acide, fibrynogen, glycated hemoglobin and fasting glycemia between
type 2 diabetic patients with "white coat hypertension" and
with normal blood pressure
Całodobowy profil ciśnienia tętniczego a czynność nerek u chorych na cukrzycę typu 1
Background and aims. Dipping profile in ambulatory blood pressure monitoring (ABPM) may be a good predictor of target organ damage in patients with type 1 diabetes. The aim of the study was to analyze the correlation between the blood pressure profile in ABPM and other predictors of early kidney damage in type 1 diabetes.
Material and methods. We examined 132 type 1 diabetes patients with normal blood pressure and 22 type 1 diabetes patients treated with antihypertensive drugs. ABPM was performed in each patient. Urine albumin to creatinine ratio (UACR) was assessed and estimated glomerular filtration rate (eGFR) was estimated based on serum cystatin C concentration. The association between blood pressure profile in ABPM and renal function was analyzed.
Results. In normotensive patients dipper status did not have any impact on renal function. Non-dippers had lower day systolic and diastolic blood pressure and higher night systolic and diastolic blood pressure than dippers. Day systolic blood pressure was negatively correlated with eGRF estimated with cystatin C. In hypertensive patients non-dippers had higher urine albumine to creatinine ratio than dippers.
Conclusions. In normotensive type 1 diabetic patients non-dipping status does not seem to be good predictor of early renal complications. However, in type 1 diabetics treated for hypertension, non-dipping could reflect probable kidney damage. GFR estimated with cystatin C could be more sensitive than albuminuria predictor of early kidney damage in type 1 diabetes.Wstęp i cel. Nocny spadek ciśnienia tętniczego stwierdzany w czasie ambulatoryjnego pomiaru ciśnienia tętniczego (ABPM) uznaje się za potencjalny wskaźnik uszkodzenia narządów w cukrzycy typu 1. Celem pracy była analiza związku między profilem ciśnienia tętniczego w ABPM a innymi wskaźnikami uszkodzenia nerek u chorych na cukrzycę typu 1.
Materiał i metody. U 132 chorych na cukrzycę typu 1 z prawidłowym ciśnieniem tętniczym oraz u 22 pacjentów z rozpoznanym i leczonym nadciśnieniem tętniczym wykonano ABPM, zbadano wydalanie albumin z moczem i oszacowano wskaźnik filtracji kłębuszkowej (GFR) za pomocą cystatyny C. Poddano analizie zależności między profilem ciśnienia tętniczego w ABPM a wskaźnikami czynności nerek.
Wyniki. U normotensyjnych chorych na cukrzycę typu 1 nocny spadek ciśnienia tętniczego nie wykazywał związku z czynnością nerek. Pacjenci non-dippers charakteryzowali się niższym skurczowym i rozkurczowym ciśnieniem w ciągu dnia oraz wyższym skurczowym i rozkurczowym ciśnieniem w ciągu nocy w porównaniu z pacjentami dippers. Skurczowe ciśnienie tętnicze w ciągu dnia wiązało się z niższymi wartościami GFR oszacowanymi na podstawie wartości cystatyny C. Wśród pacjentów z leczonym nadciśnieniem tętniczym w grupie non-dippers stwierdzono większe wydalanie albumin z moczem w porównaniu z chorymi z zachowanym nocnym spadkiem ciśnienia tętniczego.
Wnioski. Brak nocnego spadku ciśnienia tętniczego nie wydaje się czułym wskaźnikiem wczesnego uszkodzenia nerek u normotensyjnych chorych na cukrzycę typu 1. Jednak profil non-dippers może odzwierciedlać uszkodzenie nerek u chorych na cukrzycę typu 1 z leczonym nadciśnieniem tętniczym. Oszacowany za pomocą cystatyny C GFR mógłby posłużyć za bardziej czuły niż albuminuria wskaźnik wczesnego uszkodzenia nerek w przebiegu cukrzycy typu 1
Postępowanie grupowe – zagadnienia wybrane
Z wprowadzenia: "Ustawa z 17 grudnia 2009 r. o dochodzeniu roszczeń w postępowaniu grupowym
wprowadziła do polskiego postępowania cywilnego nową, wcześniej w nim niewystępującą
instytucję. Postępowanie grupowe nie ma w polskim systemie prawnym
żadnej tradycji. Twórcy projektu ustawy, zdając sobie sprawę z powyższej
okoliczności i uzasadniając celowość uregulowania postępowania grupowego
poza k.p.c., podnieśli, że „ta nowa instytucja postępowania cywilnego wymaga
sprawdzenia w praktyce”, a „zdobyte w ten sposób doświadczenia mogą doprowadzić
do zmian w jej regulacji”. Oceniając regulacje ustawy jeszcze przed jej
wejściem w życie, nie można – z oczywistych względów – odnosić się do praktyki.
Jednak już na tym etapie nie ulega wątpliwości, że zmiana niektórych przepisów
ustawy będzie w przyszłości niezbędna.

Inhibition of carotenoid biosynthesis by CRISPR/Cas9triggers cell wall remodelling in carrot
Recent data indicate that modifications to carotenoid biosynthesis pathway in plants alter
the expression of genes affecting chemical composition of the cell wall. Phytoene synthase (PSY) is a
rate limiting factor of carotenoid biosynthesis and it may exhibit species-specific and organ-specific
roles determined by the presence of psy paralogous genes, the importance of which often remains
unrevealed. Thus, the aim of this work was to elaborate the roles of two psy paralogs in a model
system and to reveal biochemical changes in the cell wall of psy knockout mutants. For this purpose,
Clustered Regularly Interspaced Short Palindromic Repeats (CRISPR) and CRISPR associated (Cas9)
proteins (CRISPR/Cas9) vectors were introduced to carotenoid-rich carrot (Daucus carota) callus
cells in order to induce mutations in the psy1 and psy2 genes. Gene sequencing, expression analysis,
and carotenoid content analysis revealed that the psy2 gene is critical for carotenoid biosynthesis
in this model and its knockout blocks carotenogenesis. The psy2 knockout also decreased the
expression of the psy1 paralog. Immunohistochemical staining of the psy2 mutant cells showed
altered composition of arabinogalactan proteins, pectins, and extensins in the mutant cell walls.
In particular, low-methylesterified pectins were abundantly present in the cell walls of carotenoidrich
callus in contrast to the carotenoid-free psy2 mutant. Transmission electron microscopy revealed
altered plastid transition to amyloplasts instead of chromoplasts. The results demonstrate for the
