    Development of Indonesian Free Trade and Port Zone: Analysis of Historical in Batam Island

    Batam Island is one of the areas designated as National Strategic Areas in Indonesia. The development and direction of the Government's policy towards Batam Island underwent several policy changes in each period of government that began in 1973 to the present. Therefore, the author will examine about: What is the history of the development of Batam Island as the Free Trade and Port Zone in Indonesia? It certainly aims to find out the development and direction of the Government's policy towards Batam Island and can be used as a framework in making policies and legislation on Batam Island in the future to improve its function as a national strategic area. The study of normative juridical law with the method of approach which includes: The legal approach, the concept approach, and the historical approach. The history of the development of Batam Island as a Free Trade and Port Zone in Indonesia to date has 5 periods. These periods are: 1) The preparation period; 2) The period of infrastructure development and investment; 3) Development period for infrastructure development and investment; 4) Period of improvement of facilities and infrastructure, investment and environmental quality; and 5) The preparation period for establishing Batam as a Special Economic Zone in the Free Trade and Port Zone.     PENGATURAN JANGKA WAKTU PENDAFTARAN JAMINAN FIDUSIA DI INDONESIA

    Abstract The regulation of registration fiduciary security do not provide legal certainty because of no the periode of registrarion fiduciary securitybesides the period of vehicles. The period of the fiduciary security during the 2000 until March 2015 is not regulated about the period of the registration fiduciary security. Because of that, this research is identify and analyze about urgency the regulation of the period of registration fiduciary security which is done by the authorities and described form a regulation a period to be applied in the fiduciary security. This research is analyzed with normative method. The research concludes that the period of the registration of fiduciary security is very important because it is influence the birth of fiduciary an determine the position of creditors if the debitors breach of the contract. Registration fiduciary security for the period of not later than 7 (seven) days after the signing of the deed of fiduciary security. The period of the fiduciary security should be included in the fiduciary security expected to guarantee legal certainty and provide legal protection against the parties involved. Key words: A period of time, registration, fiduciary security Abstrak Pengaturan pendaftaran jaminan fidusia belum memberikan kepastian hukum karena tidak mengatur pengaturan jangka waktu pendaftaran obyek jaminan selain kendaraan bermotor. Pengaturan pendaftaran jaminan fidusia selama tahun 2000 hingga Maret 2015 masih belum mengatur terkait jangka waktu pendaftaran jaminan fidusia. Oleh karena itu, jurnal ini bertujuan untuk mengetahui dan menganalisis urgensi pengaturan tentang jangka waktu pendaftaran jaminan fidusia yang dilakukan oleh pihak yang berwenang dan mendeskripsian bentuk pengaturan jangka waktu yang tepat untuk diterapkan dalam pendaftaran jaminan fidusia. Jurnal  ini dianalisis menggunakan metode yuridis normatif. Hasil jurnal ini menyimpulkan bahwa pengaturan jangka waktu pendaftaran jaminan fidusia sangat penting dilakukan karena pendaftaran jaminan fidusia menentukan lahirnya jaminan fidusia yang dapat kedudukan kreditur apabila terjadi debitur wanprestasi. Pengaturan jangka waktu pendaftaran jaminan fidusia yaitu paling lambat 7 (tujuh) hari setelah penandatangan akta jaminan fidusia. Pencamtuman pengaturan jangka waktu pendaftaran jaminan fidusia dalam Undang-Undang Jaminan Fidusia diharapkan dapat menjamin kepastian hukum dan memberikan perlindungan hukum terhadap pihak-pihak yang terkait.Kata kunci: jangka waktu, pendaftaran, jaminan fidusi

    Mengembangkan Potensi Desa Bringin Menjadi Desa Wisata

    Kawasan Desa Bringin adalah salah desa wisata yang dimiliki oleh Kabupaten Malang. Desa Bringin ini memiliki bentangan lahan yang luas yang bisa dimanfaatkan sebagai objek wisata alam. Sampai saat ini potensi yang sangat melimpah ini masih belum dimanfaatkan dan dikembangkan oleh masyarakat setempat. Desain ini menggunakan deskriptif kualitatif. Pendekatan ini digunakan untuk mendeskripsikan dan menganalisis konsep pengembangan desa wisata air terjun Sumber Wiwit. Sumber data yang digunakan yaitu sumber data primer dan sekunder. Wilayah desa wisata air terjun Sumber Wiwit terletak dikelilingi tebing tinggi dan tumbuh-tumbuhan hijau yang masih asri sekali udaranya. Potensi wisata ini cukup strategis baik dibidang agrowisata dan potensi lainnya. Dari kondisi di Desa Bringin dapat dijadikan potensi wisata sebagai daya tarik wisatawan yang bisa dimanfaatkan untuk pengembangan kawasan desa wisata. Untuk mengetahui faktor pendukung pengembangan kawasan desa wisata di Desa Bringin dengan menggunakan variabel dengan analisis (1) Mempertahankan keragaman budaya, (2) Usaha tani di desa ini adalah usaha pembibitan sengon, dan (3) Toko souvenir. kesimpulannya bahwa kegiatan sehari-hari yaitu bertani yang adalah ciri khas Desa Bringin sangat berpotensi untuk dikembangkan menjadi kawasan desa wisata yang berbasis agrowisata. Desa Bringin juga memiliki wisata air terjun Sumber Wiwit. Konsep pengembangan yang bisa diterapkan antara lain menyediakan rute perjalanan wisata yang mengelilingi kawasan desa wisata

    ABSTRACT               Not later than 7 (seven) working days from the date of signing the deed in question, the land deed official is obligated to submit the deed he made along with the relevant documents to the Land Office for registration. What if this is not done by the land deed official or it is late due to negligence, then are there special sanctions against the land deed official in question. The problems discussed are (1) How is the implementation of Article 40 section (1) of Government Regulation No. 24 of 1997 concerning Land Registration by land deed official at the Office of the National Land Agency? (2) What are the legal consequences for land deed official if they do not carry out land registration in accordance with Article 40 section (1) of Government Regulation No. 24 of 1997 concerning Land Registration?The research method used in this research is empirical juridical, with a sociological juridical approach, while the data analysis is done descriptive-qualitatively. From the results of the research, it can be concluded that (1) the implementation of Article 40 section (1) of Government Regulation Number 24 of 1997 concerning Land Registration by land deed official at the Land Office (BPN), no one is on time to meet the deadline of 7 (seven) working days, such as which is mandated by Government Regulation Number 24 of 1997. (2) The legal consequence for land deed official if it does not register land in accordance with Article 40 section (1) Government Regulation Number 24 of 1997 concerning Land Registration, is in the form of a warning and an obligation to make a certificate or statement of delay.  Keywords: Implementation, Legal Consequences, Land deed official, Land Registration.  ABSTRAKSelambat-lambatnya 7 (tujuh) hari kerja sejak tanggal ditandatanganinya akta yang bersangkutan, PPAT wajib menyampaikan akta yang dibuatnya berikut dokumen-dokumen yang bersangkutan kepada Kantor Pertanahan untuk didaftar. Bagaimana jika hal tersebut tidak dilakukan oleh PPAT atau terlambat karena kelalaiannya, maka apakah ada sanksi khusus terhadap PPAT yang bersangkutan. Adapun masalah yang dibahas adalah (1) Bagaimana implementasi Pasal 40 ayat (1) Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah oleh PPAT di Kantor Badan Pertanahan Nasional? (2) Apa akibat hukumnya bagi PPAT apabila tidak melakukan pendaftaran tanah sesuai Pasal 40 ayat (1) Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah ? Metode penelitian yang digunakan dalam penelitian ini adalah yuridis empiris dengan pendekatan yuridis sosiologis dan dianalisis secara deskriptif kualitatif. Dari hasil penelitian dapat disimpulkan bahwa (1) Implementasi Pasal 40 Ayat (1) Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah Oleh PPAT di Kantor Pertanahan/BPN, tidak ada yang tepat waktu memenuhi tenggat waktu selama 7 (tujuh) hari kerja, seperti yang diamanatkan oleh Peraturan Pemerintah Nomor 24 Tahun 1997. (2) Akibat hukumnya bagi PPAT apabila tidak melakukan pendaftaran tanah sesuai Pasal 40 Ayat (1) Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah, adalah berupa teguran dan kewajiban membuat surat keterangan atau surat pernyataan keterlambatan. Kata Kunci: Implementasi, Akibat Hukum, PPAT, Pendaftaran Tanah.

    Perlindungan Hukum Terhadap Pelaku Usaha Penanaman Modal Usaha Industri Beralkohol

    The legal vacuum occurred before the enactment of a replacement regulation regarding new investment in the alcoholic industry, until the ratification of Presidential Regulation Number 49 of 2021, especially on the issue of the validity of regulations and legal protection for investment business actors, for this reason it is necessary to analyze how legal protection is for business actors and legality of investment regulations in the alcoholic industry after the amendment of Presidential Regulation Number 10 of 2021 through normative juridical research, legal approaches and concepts. Based on the research results, the legal protection of business actors is based on Law Number 8 of 1999 concerning Consumer Protection. Legality of Investment is legal, based on Law Number 25 of 2007 concerning Investment, but new investment in the alcoholic industry is not reopened based on Presidential Regulation Number 49 of 2021 concerning Amendments to Presidential Regulation Number 10 of 2021 concerning Business Fields Capital investment.Kekosongan hukum terjadi sebelum disahkannya peraturan pengganti mengenai penanaman modal baru pada bidang industri beralkohol, hingga disahkannya Peraturan Presiden Nomor 49 Tahun 2021, khususnya pada permasalahan keabsahan peraturan dan perlindungan hukum bagi pelaku usaha penanaman modal, untuk itu perlu dianalisis bagaimana perlindungan hukum bagi pelaku usaha dan legalitas peraturan penanaman modal dalam bidang industri beralkohol pasca diubahnya Peraturan Presiden Nomor 10 tahun 2021 melalui penelitian yuridis normatif, pendekatan undang-undang dan konsep. Berdasar pada hasil penelitian, perlindungan hukum pelaku usaha didasarkan pada Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Legalitas penanaman modalnya sah, didasarkan pada Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal, tetapi tidak dibuka kembali penanaman modal baru pada bidang industri beralkohol berdasarkan Peraturan Presiden Nomor 49 Tahun 2021 tentang Perubahan Atas Peraturan Presiden Nomor 10 tahun 2021 tentang Bidang Usaha Penanaman Modal.

    Legal Consequences of Divorce in Intermarriage on the Marital Property in the form of Land Proprietary Rights

    Intermarriage brings legal consequences to the assets in the marriage including the mixing of joint assets. Marital property, specifically, regarding land ownership rights in Indonesia causes a problem if there is a divorce. The joint assets in the form of ownership rights to the land must be shared between Indonesian Citizens and Foreign Citizens while Law Number 5 of 1960 concerning Basic Regulations -The Agrarian principle prohibits foreign nationals from owning property rights. This research aims to find out the position of Foreign Citizens regarding land ownership rights in Indonesian laws and regulations and the legal consequences of divorce on land ownership rights in mixed marriages.     PERBANDINGAN PELAKSANAAN PROGRAM NASIONAL AGRARIA DAN PENDAFTARAN TANAH SISTEMATIS LENGKAP DI KOTA BATU

    Pendaftaran Tanah Sistematis Lengkap (PTSL) merupakan salah satu program yang diselenggarakan oleh Pemerintah untuk membantu masyarakat dalam memperoleh sertipikat tanah yang sebelumnya bernama Proyek Operasi Nasional Agraria (1981) dan Program Nasional Agraria (2015). Kota Batu merupakan salah satu kota di Indonesia yang mengikuti PTSL untuk membantu masyarakat yang mayoritas di antara mereka belum mendaftarkan tanahnya ke kantor pertanahan Kota Batu. Tujuan penelitian ini yaitu mengetahui dan menganalisis perbandingan antara pelaksanaan Prona dan PTSL di Kota Batu. Metode analisis yang digunakan dalam penelitian ini yaitu penelitian yuridis-empiris dengan pendekatan yuridis-sosiologis. Prona di Kota Batu merupakan pendaftaran tanah sporadis, aturan terkait biaya yang ditarik dari masyarakat yang belum jelas, dan pengukuran hanya dilakukan terhadap obyek yang dimohonkan saja. Sedangkan PTSL bersifat sistematis, aturan yang jelas terkait penarikan biaya dari masyarakat, dan pengukuran dilakukan kepada seluruh bidang tanah dalam satu wilayah.Kata Kunci: Perbedaan, Persamaan, Pendaftaran Tanah Sistematis Lengkap, Program Nasional Agraria Systematic and Complete Land Registration (PTSL) is a program organized by the Government to assist the public in obtaining the certificate of the land that was formerly the National Agrarian Operation Project (1981) and National Programmes Agrarian (2015). Batu City is one of the cities in Indonesia that follow to help communities that PTSL majority among those yet to register their land to land the Batu City. The purpose of the research is to find out and analyze the comparison between the implementation of Prona and PTSL in Batu City. Methods of analysis used in this study i.e. the juridical research-empirical juridical approach-sociological. Prona in Batu City is the sporadic land register, related costs rules drawn from the communities that are not yet clear, and the measurements are only done to the object that appealed only.
