Título del seminario: "50º aniversario de The Concept of Law"Premessa. Ci sono molte ragioni per dolersi della piega che ha preso il dibattito filosoficogiuridico post-hartiano, specie dopo la pubblicazione del Postscript. Vorrei qui focalizzarmi su una di esse, vale a dire sulla pressoché totale assenza, dall’agenda di questa discussione, del tema della coercizione. Quest’assenza non è casuale ma è il frutto di una precisa opzione metateorica. L’idea è che la coercizione non rappresenta un elemento necessario del diritto o, come anche si usa dire, non è parte della sua natura; essa va perciò affidata alla cura dei sociologi, dato che alla teoria compete dedicarsi ai soli aspetti necessari del diritto, precipuamente alla sua autorità o normatività che dir si vogli

Frente a las opiniones que consideran que la coerción ha ido perdiendo su lugar central en la teoría del Derecho y sitúan el comienzo de esta tendencia en El concepto de derecho, este artículo trata de reivindicar el tratamiento de la coerción por parte de Hart en tres momentos de su obra: 1) el análisis de las reglas y de las obligaciones sociales; 2) la crítica a Austin y Kelsen y la elaboración de la teoría de los legal systems; y 3) el tratamiento del contenido mínimo del derecho natural y del derecho internacional. La conclusión de la autora es que «El concepto de derecho no marca en absoluto una ruptura de la tradición iuspositivista en tema de coerción sino que se coloca en línea de continuidad con ella».Objecting to those who claim that coercion has been losing its central role in Legal Theory and considered that the point of departure of that new tendency is to be found in The concept of Law, this paper vindicates Harts way to address the topic on coercion in three moments of his work: 1) His analyses of rules and social obligation; 2) His objection against Austin and Kelsen and his elaboration of a theory of legal systems; 3) His way to address the minimum content of Natural Law and International Law. The conclusion of this paper is to consider The concept of Law fully align with the iuspositivist tradition on this issue rejecting it to be any departure or turning point

Ultra Luminous X-ray Sources: a deeper insight into their spectral evolution

We select a sample of nearby Ultraluminous X-ray sources with long XMM-Newton observations and analyse all the available XMM-Newton data using both X-ray spectral fitting techniques and hardness-intensity diagrams. The sample includes IC 342 X-1, NGC 5204 X-1, NGC 5408 X-1, Holmberg IX X-1, Holmberg II X-1, NGC 1313 X-1, NGC 1313 X-2 and NGC 253 X-1. We found that, although a common reference model can be used to describe the X-ray spectra, the sources show different spectral evolutions, phenomenologically described in terms of variations in the properties of a soft component and a high energy tail. Variations at low energies are accounted for (mostly) by changes in the normalization of the soft component and/or in the column density to the source, while variations in the high energy tail by changes in the parameters of an optically thick corona. This spectral variability is rather well characterized on a colour-colour and hardness-intensity diagram in terms of suitably defined hardness ratios. We suggest the existence of a variability pattern on the hardness-intensity diagram and we interpret it in terms of the switch between a near-Eddington and a super-Eddington accretion regime. The transition between the two regimes seems to be driven mostly by changes in the contribution of the soft component, which can be explained in terms of the increasing importance of wind emission. The analysis is complemented by an investigation of the short-term time variability of all the sources. In general, no clear correlation between the spectral and temporal properties is found.Comment: 15 pages, 7 figures, 5 tables. Accepted for publication in MNRA

Disuguaglianze e apocalisse

L’autrice evidenzia alcuni nodi problematici del Manifesto per l’uguaglianza di Luigi Ferrajoli. In particolare, sottolinea l’ambigua collocazione tra logica ed etica data al principio di uguaglianza; critica poi la distinzione tra disuguaglianze e differenze, l’uso dei concetti di identità e dignità e il costante scambio operato nel libro tra disuguaglianze economiche e povertà. Critica infine la sottovalutazione da parte di Ferrajoli degli enormi miglioramenti che hanno avuto luogo negli ultimi decenni nelle condizioni di vita dell’intero pianeta. The author focuses on some problematic aspects of Luigi Ferrajoli’s Manifesto per l’uguaglianza. In particular, she highlights the ambiguous place between logic and ethics given to the principle of equality. She also criticizes the distinction between inequalities and differences, the use of the concepts of identity and dignity and the frequent identification between economic inequalities and poverty that can be found in the book. Finally, she stigmatizes Ferrajoli’s underestimation of the enormous improvements of the conditions of life on the planet in recent decades

Tra parole d’odio e odio per le parole. Metamorfosi della censura

Nel mondo moderno la più grande minaccia alla libertà d’espressione proveniva dalla censura di Stato. Benché tale libertà, grazie al pensiero illuminista e liberale, sia ormai stabilmente incorporata in ogni costituzione del mondo occidentale e in ogni dichiarazione dei diritti, il suo futuro appare tutt’altro che roseo. Da un lato, la censura di Stato nonè del tutto tramontata neppure nelle democrazie costituzionali, ed anzi ad essa si è ormai affiancata quella, pervasiva, delle piattaforme digitali, spesso operanti come proxy dei poteri pubblici. Dall’altro lato, vari fattori stanno oggi inducendo a smantellare il privilegio tradizionalmente ascritto alla libertà d’espressione ed a legittimarne compressioni sempre più pervasive. Tra questi giocano un ruolo importante le riflessioni filosofiche che negli ultimi decenni hanno prodotto una vera e propria metamorfosi del concetto tradizionale di ‘censura’, dilatandolo enormemente e depotenziandone alquanto la carica negativa. Vanno poi considerate le sempre più pressanti richieste di protezione dai cosiddetti discorsi d’odio (hate speech), anche con l’ausilio della sanzione penale, delle identità collettive e dei gruppi sociali più vulnerabili. Tra i vari addebiti mossi a tali discorsi c’è quello di produrre un vulnus all’uguaglianza e alla stessa libertà di espressione delle categorie che ne rappresentano il bersaglio. Ma la libertà di parola è uno strumento sia di espressione individuale che di controllo del potere troppo prezioso, da limitare perciò con oculatezza e solo nei casi di comprovata lesione di diritti dei singoli. Le antiche ragioni liberali in suo favore, benché oggi fuori moda, permangono intatte

Il dovere della sfiducia

The author draws inspiration from the book by Tommaso Greco, La legge della fiducia, to formulate some considerations about the variety of meanings of the notion of trust, the relationships between trust and coercion and the role of trust, in its various senses, in relation to the law. In particular, on a descriptive level, she maintains that law and trust should not be seen as antagonists but as complementary; on the normative level, in the wake of the liberal political-juridical tradition she deems necessary to cultivate an attitude of systematic distrust towards the law, including the democratic-constitutional one

Pulsator-like Spectra from Ultraluminous X-Ray Sources and the Search for More Ultraluminous Pulsars

Ultraluminous X-ray sources (ULXs) are a population of extragalactic objects whose luminosity exceeds the Eddington limit for a 10 M ☉ black hole (BH). Their properties have been widely interpreted in terms of accreting stellar-mass or intermediate-mass BHs. However at least three neutron stars (NSs) have been recently identified in ULXs through the discovery of periodic pulsations. Motivated by these findings we studied the spectral properties of a sample of bright ULXs using a simple continuum model which was extensively used to fit the X-ray spectra of accreting magnetic NSs in the Galaxy. We found that such a model, consisting of a power-law with a high-energy exponential cut-off, fits most of the ULX spectra analyzed here very well, at a level comparable to that of models involving an accreting BH. On these grounds alone we suggest that other non-pulsating ULXs may host NSs. We also found that above 2 keV the spectrum of known pulsating ULXs is harder than that of the majority of the other ULXs of the sample, with only IC 342 X-1 and Ho IX X-1 displaying spectra of comparable hardness. We thus suggest that these two ULXs may host an accreting NS and encourage searches for periodic pulsations in the flux

The Orbit of NGC 5907 ULX-1

ULX1 has been the target of a substantial multi-instrument campaign, mainly in the X-ray band, but no clear counterparts are known in other bands. Although ULX1 is highly variable and pulsations can be transient (regardless of the source flux), the timing data collected so far allow us to investigate the orbit of this system. We find an orbital period P orb =+ 5.7 0.1 0.6 days and a projected semi-axis 0.8 1 A 3.1 lt s =+. The most likely ephemeris is Porb = 5.6585(6) days, A1 =3.1(4) lt-s, and the epoch of ascending nodes passage is Tasc = 57751.37(5) MJD. However, there are six similar solutions acceptable within 3σ.Wefind further indications that ULX1 is a high-mass X-ray binary. This implies that we are observing its orbit face on, with an inclination <5°.Peer reviewe
