OXIDATIVE DEGRADATION OF 2-CHLOROPHENOL BY PERSULFATE
The degradation of 2-chlorophenol (2-CP) by persulfate was investigated. The kinetics of persulfate oxidation of 2-chlorophenol in aqueous solutions at various pH, oxidant concentration, temperature, Fe2+ and Cu2+ ions content was studied. Maximum of 2-CP degradation occurred at pH 8. The oxidation rate of 2-CP increased with increasing the persulfate molar excess. The degradation process was significantly influenced by temperature – the higher temperature results in a faster degradation of 2-CP. The activation of persulfate by ferrous and copper ions was also studied. Results showed that persulfate is activated more effectively by iron(II) than copper(II) ions. A comparison of different persulfate activation methods revealed that heat-activation was the most effective. Under optimal conditions, in the presence of ferrous ions at 50 °C, complete degradation of 2-chlorophenol was achieved after about 30 minutes
Council of Europe overall strategy to fight against poverty
The poverty level in European Member States is far too high and the measures taken to
remedy this issue were insufficient. The goal of Article 30 of the Revised European Social
Charter (RESC) of 1996 is to obligate Member States to organise cohesive social policy
concepts to fight poverty and social marginalisation. The European Committee of Social
Rights (ECSR) concluded that the situation of some European countries is not in the
conformity with the Article 30 of the Charter on the ground that there is no adequate
overall and coordinated approach to combating poverty and social exclusion. The Parties
which ratified the RESC must undertake measures within the framework of an overall
and co-ordinated approach to promote the effective access of persons who live or risk
living in situation of social exclusion or poverty, as well as their families, to, in particular,
employment, housing, training, education, culture and social and medical assistance. European
Member States and European international organisations (Council of Europe and
European Union) must adopt the necessary legal, financial and administrative devices of
ensuring steady progress towards achieving the goals laid down by the RESC. In his paper,
the author presents the level of involvement of the authorities of some Member States of
the Council of Europe in an ambitious, difficult and indispensable policy of achieving the
above-mentioned task

Prawo pracy II RP: symbioza zatrudnienia pracowniczego i cywilnoprawnego (prolegomena do współczesnego podziału zatrudnienia)
Obecne trudności związane z odgraniczeniem pracy wykonywanej w ramach umowy
o pracę od zatrudnienia na podstawie umów cywilnoprawnych mają źródło w prawie
rzymskim, którego zasady leżą u podstaw systemów prawa prywatnego państw europejskich.
Zmiana nastąpiła pod koniec XIX wieku, kiedy zaczął rozwijać się jeden z dwóch
najważniejszych działów prawa pracy – zbiorowe prawo pracy. Presja związków zawodowych
reprezentujących interesy pracowników sprawiła, iż organizacje związkowe zostały
uznane przez władze poszczególnych państw za wyłącznego reprezentanta interesów
i praw pracowniczych. Wymuszenie na pracodawcach i władzach państw zagwarantowania
bezpieczeństwa prawnego i socjalnego pracownikom w drastyczny sposób zróżnicowało
status prawny osób zatrudnionych na podstawie umów o pracę oraz tych świadczących
pracę na podstawie umów cywilno-prawnych. Tym samym podważona została idea wolności
umów, na podstawie których oraz w ramach stosunków prawnych zainicjowanych
dwoma zasadniczo różnymi typami umów (umowy o pracę lub jednej z umów cywilno-
-prawnych), może być wykonywania praca: w ramach zatrudnienia pracowniczego lub
nie-pracowniczego.
Regulacje prawne wprowadzone do prawa pracy po zakończeniu I wojny światowej
wywarły istotny wpływ na ograniczenie swobody stron kształtowania podstaw i ram prawnych
zatrudnienia. Początkowo powszechnie obowiązująca, niemal absolutna wolność
wybierania podstaw prawnych i ram zatrudnienia doznawała coraz częstszych wyłomów.
Zmiana ustrojowa w 1989 r. sprawiła, że przedsiębiorcy uznali, iż wymagania konkurencji
ograniczają możliwość zatrudniania pracowników na podstawie umów o pracę. Reakcją
władz państwowych na te tendencje w polityce zatrudnienia i w stosunkach pracy
było wprowadzenie prawnego domniemania zatrudnienia pracowniczego, nie pozbawiającego
stron stosunków pracy prawa do swobodnego wyboru podstawy i ram prawnych
zatrudniania: pracowniczego lub cywilno-prawnego.Traditionally (as it was regulated in the Roman law) employees sell their labour while
the workers and self-employed sell a product which they manufactured. Th erefore an employees
has been qualifi ed by labour lawyers as those who perform their subordinated type
work under the contract of employment while independent work performed personally by
producers of any work or services and self-employed is qualifi ed as carried under the contract
for services. Between the Great Wars Polish entrepreneurs and workers enjoy a freedom
to chose between employment which was categorized by the state legislator as “subordinated”
or “independent” . Presidential regulations, two of 1928 on white collar- and blue
collar type of employment contracts were used on equal footing with the third regulation
entitled Th e Code of obligations introduced into the national civil law system in 1933. Th e
stage of legal symbiosis of employment- and civil-type of work existed until new amendments
to the Labour Code of 1974 were gradually introduced in 1996 and 2002. Th at stage
of full freedom of choice of a legal source for legal relationship within it boundaries any
kind of depend work might be carried on was compromised by the both, the state legislator
and the judiciary, which looked for a single factor instead taking into consideration the
principle of mutuality commitment and promises of future performance which provides
the most distinguished arrangement of employment relationship – to maintain legal ties
for longer period of time, not just for singular act of service in return for wages. Th e current
policy of trade unions advocating an idea of end up with work performed on the legal
bases of civil type of contracts for services and guarantee all employees stable contracts of
open end employment is contradicting the UE concept fl exicurity based on both fl exible
and reliable contractual arrangements
EU Employment Law and Social Policy and the Need to Develop Unitary Electronic Technology of Work by Central and Eastern Member States
This chapter presents the current situation on the common market caused by the use of electronic employment
technologies by entrepreneurs on digital platforms. Its aim is to inspire the Member States of Central and
Eastern Europe to take steps to standardize the status of self-employed people on digital platforms. Occasional
attempts by the EU institutions to develop a definition of the status of people employed on digital platforms
may be treated as a continuation of the practice of multiplying precedents in the jurisprudence of the CJEU.
They do not guarantee stable working standards for self-employed people on digital platforms

The shortcomings discovered by the European Committee of Social Rights in case CGIL v. Italy which exist in the provision of abortion services as a result of decrease in the number of hospitals or nursing homes where abortions are carried out nation-wide, significant number of hospitals where there are no non-objecting gynecologists are employed create disproportionate relationship between the legal request to terminate pregnancy and the number of available non-objecting competent health personnel remain unremedied and women seeking access to abortion services continue to face substantial difficulties in obtaining access to such services in practice. The aforementioned health facilities do not adopt the necessary measure in order to compensate for the deficiencies in services caused by health personnel who decide to invoke their right to conscientious objection. These situations may invoke considerable risks for the health and well-being of the women concerned which contrary to the right to protection of health guaranteed by the Revised European Social Charter.Uchybienia ustalone przez Europejski Komitet Praw Społecznych rozpatrujący skargę zbiorową w sprawie CGIL przeciwko Republice Włoch, związane z pogorszeniem usług medycznych w sprawach dotyczących przerwania ciąży z powodu odmowy wykonywania tego zabiegu przez część lekarzy i pozostałego personelu medycznego (pielęgniarek i położnych), nie zostały przez władze publiczne załatwione bez straty dla pacjentek zdecydowanych na dokonanie zgodnej z prawem aborcji. EKPS rozpoznający powyższą skargę zbiorową orzekł, że władze państwowe nie podjęły skutecznych działań zabezpieczających prawo do ochrony zdrowia kobiet oraz klauzuli sumienia lekarzy i pozostałego personelu medycznego. Z uwagi na ryzyko zagrożenia zdrowia pacjentek EKPS orzekł, że zostały naruszone przepisy Zrewidowanej Europejskiej Karty Społecznej
Prawo wyboru podstawy zatrudnienia
This paper is concerned with Polish labour law governing the formation of the individual employment relationship. After the changes made by national legislative authority (Sejm) in 1999 and 2002 the right to choose a legal source (employment or civil contract) provisions of regulation – civil law mentioned by the author in article as well as in Polish language summary – was more limited in relation to the contents of the employment relationship. Since 2002 the existence of the legal relationship of employment is based not on the presupposition of the both parties but more on acceptance their choice of civil law type of contract by the judicial (labour court) and administrative authority (labour inspection).Przemiany w prawie pracy, które miały miejsce w latach 1996 i 2002, sprawiły, iż obowiązujące w polskim systemie prawa pracy i prawa cywilnego zasady wolności umów i prawa stron stosunków prawnych, w ramach których świadczona jest praca, sformułowane w art. 55 k.z., art. 3531 k.c. w związku z art. 300 k.p. oraz art. 10 § 1 k.p., zostały w stosunkach pracy poważnie ograniczone. Zainteresowane strony stosunku prawnego mają prawo wyboru podstawy prawnej zatrudnienia pod warunkiem, że będzie to podstawa, która zostanie zaakceptowana – jako zgodna z obowiązującym prawem pracy – przez organy sprawujące merytoryczny nadzór nad przestrzeganiem przepisów prawa pracy przez przedsiębiorców (sądy pracy oraz Państwową Inspekcję Pracy)
