    On the Pattern and Meaning of the Identification of Civil Norms

    如果把法治界定为规则之治,那么,从逻辑上讲,法治的实现便可转换为法律规则的实现。而法律规则的实现,从主体心理角度看,仰赖于人们对它的情感体验和价值认同(简称规则认同)。人类对于规则的认同主要通过两种不同的模式,即超验模式与经验模式。前者通过信仰来实现认同,后者则通过主体的参与来实现认同。在这个“脱魅”的时代,借助信仰来实现认同的方式已基本不再适用,或者说,至少不能再像前现代社会那样作为主要的认同模式而存在,因此,强调主体参与的经验模式之价值和意义便凸显出来。民间法的规则认同模式正是经验模式的“活化石”,通过对它的研究,我们也许可以找到解决当今法治领域中规则认同问题的钥匙。Nomocracy can be seen as the implementation of legal norms if nomocracy is defined as rule by law. From the point of view of psychology, the implementation of norms is based on people's identification with it, which includes two basic patterns or ways: one is experimental, and the other is transcendental. In times when "God is dead", the transcendental pattern of identification with norms cannot be universally accepted in legal practice. That is, the experiment pattern is the better way nowadays. So, we may find out the way to improve people's identification with legal norms by studying the identification pattern of civil norms because it is typically experimental

    近一年来,学界围绕邓正来的长文《中国法学向何处去》展开了一场大讨论。冷静分析现有的这些讨论,我们就会发现其更多地似乎只是“照着讲”,即更多关注的是“中国法学向何处去”这个问题本身;而相对地缺乏另一种对待经典的态度——“接着讲”的态度。按照这种态度,我们必须认真地回应、回答“中国法学到底应该向哪儿去”这个问题,而不仅仅是继续开放出这个问题的各个面向和层次。In the past one year, Chinese law educational world has put forward a large-scale discussion on an article of Professor Deng, the topic of which is Where Will Chinese Jurisprudence Go. To be regretful, in existing discussion, there is nearly no one has answered where will jurisprudence go on earth. So, the discussion up to now is not all-sided even it may be busy and ardent. A comprehensive discussion of the topic should answer the question itself at least. This article argues that conceptual analysis and microscopic proves may be a orientation of Chinese jurisprudece in the future

    目的探讨姜黄素对人食管癌EC9706细胞凋亡的诱导作用,热休克蛋白70(HSP70)在肿瘤细胞凋亡过程中在核基质上的变化及其与凋亡调控相关蛋白的关系。方法用细胞计数和流式细胞仪检测姜黄素对人食管癌EC9706细胞的增殖抑制作用,以光学显微镜和透射电镜观察姜黄素诱导人食管癌EC9706细胞凋亡前后的细胞结构变化,琼脂糖凝胶电泳观察人食管癌EC9706细胞凋亡前后的dnA结构变化。双向凝胶电泳和质谱鉴定分析HSP70在核基质中的存在与变化;并以WESTErn blOTTIng进行确证;激光扫描共焦显微镜观察HSP70在EC9706细胞凋亡过程中的定位及其与bAX、bCl-2等基因产物的共定位关系。结果姜黄素能显著抑制人食管癌EC9706细胞增殖并诱导人食管癌EC9706细胞凋亡,双向凝胶电泳、质谱鉴定和结果发现并证实,HSP70在姜黄素处理前后的EC9706细胞核基质蛋白中的存在及其表达下调变化。激光扫描共焦显微镜观察结果显示,HSP70在EC9706细胞凋亡过程中与bAX、bCl-2等基因产物具有共定位关系,且其共定位区域发生了变化。结论姜黄素对人食管癌EC9706细胞具有显著的凋亡诱导作用;HSP70作为一种新发现的核基质蛋白,在姜黄素诱导人食管癌EC9706凋亡过程中的表达与分布发生了显著变化。HSP70与凋亡相关基因的关系对EC9706细胞凋亡具有重要影响。Objective To investigate the effect of curcumin on human esophageal cancer EC9706 cells and explore the role of heat shock protein(HSP70) in cell apoptosis by examining changes in the nuclear matrix and its relationship with apoptosis-related proteins.Methods Cell counting and flow cytometry were performed to probe the inhibitory effect of curcumin on cellular proliferation.Transmission electron microscopy and optical microscopy were used to observe the structural changes in EC9706 cells before and after apoptosis.Agarose gel electrophoresis was conducted to investigate the DNA structure of EC9706 cells before and after apoptosis.Two-dimensional polyacrylamide gel electrophoresis(2-D PAGE) and mass spectrometry(MS) analysis were performed to investigate the presence and changes of HSP70 in the nuclear matrix of EC9706 cells before and after curcumin treatment,which was further corroborated by Western blotting assay.Laser confocal scanning microscopy was used to observe the colocalization of HSP70 with Bax and Bcl-2 during apoptosis.Results The results indicated that curcumin could markedly inhibited EC9706 cell proliferation and finally induced apoptosis.Data from 2-D PAGE,MS,and Western blotting showed that HSP70 was involved in the nuclear matrix proteins and expression of HSP70 was downregulated after curcumin treatment.Laser confocal microscopy showed that HSP70 colocalized with Bax and Bcl-2,and the colocalized regions were altered by the curcumin treatment.Conclusion Our work proves that curcumin could definitely induce EC9706 cells into apoptosis.As a new found nuclear matrix protein,the expression and distribution of HSP70 are altered during the apoptosis of EC9706 cells.The colocalization of HSP70 with apoptosis-related genes evidently affects the apoptosis of EC9706 cells.福建省自然科学基金资助项目(2011J01256); 中央高校基本科研业务费专项资金(2011121061

    Studies on Tetra-substituted Amino Aluminum Phthalocyanine as a New Red-region Substrate for Mimetic Peroxidase

    Tetra substituted amino aluminum phthalocyanine (TAAlPc) has been synthesized and used for the first time as a new red region fluorescent substrate for the determination of hydrogen peroxide catalyzed by peroxidase or mimetic peroxidase. Under optimum conditions, the calibration graph has a linear range of 0.0-3.0×10 -7 mol/L H 2O 2 with a detection limit of 3.7×10 -9 mol/L. The feasibility of TAAlPc as a new promising red region substrate in practical application has been proven in the determination of H2O2 in rainwater. The proposed method can largely minimize the nterference that results from background fluorescence or scattering light and has a high analytical sensitivity.国家自然科学基金(批准号:29775021

    Effect of the trans - theoretical model of behavior based WeChat health education on self - management among patients with maintenance hemodialysis

    目的 探讨基于行为转变的微信干预模式对维持性血液透析患者自我管理的研究效果.方法 选取60例维持性血液透析患者实施微信健康教育,健康教育方案是基于行为转变理论制订,包括血液透析专业知识、自我管理、科学饮食等方面内容.实施干预12周后,对患者的生化指标、自我管理水平及自我效能感得分进行干预前后比较.结果 干预后患者自我管理得分较干预前有显著提升,表现在情绪处理和自我护理方面,差异有统计学意义(P<0.01).干预后患者的生化指标白蛋白、血钾、肌酐、尿素氮的差异有统计学意义(P<0.01).患者的自我效能感提升.结论 基于行为转变理论的微信健康教育可以改善维持性血液透析患者的生化指标,提高自我管理水平,帮助患者了解血液透析知识以及提升自信心,为今后改善血液透析患者自我管理提供一种新的干预模式.Objective To explore the effect of WeChat intervention model based on the trans-theoretical model of behavior(TTMB) on self-management of maintenance hemodialysis patients.Methods Sixty cases of maintenance hemodialysis patients were given WeChat health education,and the health education program was based on TTMB,ineluding hemodialysis expertise,self-management,scientific diet and so on.After 12 weeks'intervention,the biochemical index,the self-management level and the self-efficacy score of patients were compared before and after intervention.Results The scores of self-management of patients after intervention were significantly higher than those before intervention,which were expressed in terms of emotional management and self-care,and the difference was statistically significant (P 〈 0.01).After the intervention,the biochemical indexes diffences of albumin,serum potassium,creatinine and urea nitrogen of patients were statistically significant (P 〈 0.01).The self-efficacy of patients were elevated.Conclusion The TTMB WeChat health education can improve the biochemical indexes and the level of self-management of maintenance hemodialysis patients,and it helps patients to understand hemodialysis knowledge as well as improve self-confident,to provide a new intervention model for improving self-management of hemodialysis patients in the future.国家自然科学基金(71403232
