The institution of the authorised economic operator – facilitating economic activity and minimizing the risk of compromising the security of the trade flow in goods in the international trade
The scale of the international trade, as well as the existing economic and technological conditions,
cause economic operators to expect solutions aimed at facilitating as well as increasing security of
the fl ow of goods in the international trade. Reaching a compromise between the number of solutions
aimed at reducing barriers and administrative workload and the necessity of having effective
customs control, which directly affects the security of trade, is a task of great difficulty but also, as
evidenced by the business practice, a task possible to complete. The aim of the paper is to characterise
the institution of the Authorized Economic Operator and assess its infl uence on the facilitation,
as well as security and safety of economic activity in the international trade. With this regard,
the methods of descriptive and comparative analysis have been employed. The performed analysis
allowed for drawing a conclusion that the Authorised Economic Operator Programme is a proof
that reduction of barriers and implementation of innovative solutions improving economic activity
allow for increased security of the flow of goods in the international trade.Skala wymiany międzynarodowej, a także istniejące uwarunkowania gospodarcze i technologiczne
powodują, że przedsiębiorcy oczekują rozwiązań mających na celu jednocześnie ułatwienie

kompromisu pomiędzy redukcją barier a skuteczną ochroną jest dziś zadaniem bardzo ważnym,

Customs cooperation in the area of security and protection of The EU market
Swoboda obrotu towarowego sprzyja powstawaniu nadużyć w obszarze celno-
-podatkowym, a w stosunku do służb celnych powoduje wzrost wymagań w obszarze bezpieczeństwa
i ochrony rynku. Skuteczne i efektywne wykonywanie zadań celnych w tym zakresie
przez unijne służby nie byłoby możliwe bez wzajemnej współpracy. Wachlarz działań
podejmowanych przez administracje celne państw członkowskich, w ramach współpracy
celnej, jest bardzo szeroki. Są to zarówno działania o charakterze ogólnym, jaki i szczegółowym
– ukierunkowanym na konkretne przestępstwa celne. Celem niniejszej publikacji jest
przedstawienie istniejących, w ramach obowiązujących rozwiązań prawnych, możliwości
i form współdziałania służb celnych w procesie zapewniania bezpieczeństwa i ochrony rynku,
ze szczególnym uwzględnieniem aspektu instytucjonalnego współpracy celnej.The freedom of trade fosters the abuse in the area of customs and taxes, and in
relation to customs services, it necessitates higher expectations in terms of security and market
protection. Effective and efficient performance of tasks by the EU customs in this area would
not be possible without mutual cooperation. The range of actions taken by customs
administrations of the member states within the framework of collaboration is very wide.
These are both general as well as specific actions aimed at particular customs offences. The
main purpose of the paper is to present existing methods and forms of collaboration of customs
services under the current applicable regulations in the area of security and market protection
with particular consideration of the institutional aspect of customs cooperation
The Contemporary Face of the Customs System in the European Union
The EU customs system is currently a complex arrangement of customs
institutions operating within the public and market space of the European Union,
institutions which are strongly interlinked and perform multi-faceted tasks resulting from
present challenges of the customs policy. The aim of the article is to analyze the definition
of the customs system as well as to characterize the legal and organizational dimensions of
the Union customs system against the background of challenges related to globalization,
with a particular focus on customs administrations of Member States. The methodology
employed in the paper consists in a descriptive analysis, preceded by a review of the
subject literature and the EU secondary legislation as well as a comparative analysis.
The research findings allowed a conclusion to be drawn that the customs system of the
European Union efficiently and effectively adapts to new challenges and ever-increasing
demands resulting from the changing conditions of the international trade, both in the
legal aspect, i.e. regulations on trade in goods, as well as in the organizational dimension,
i.e. activities of EU institutions shaping the customs system and customs administrations
of Member States

"Procedury celne to pewien ukształtowany przez prawo sposób postępowania
w obrocie towarowym z zagranicą. Regulacja procedur przebiegła w sposób ewolucyjny.
Prawo celne z 1933 roku regulowało następujące rodzaje procedur celnych:
odprawę ostateczną przywozową i wywozową, odprawę warunkową przywozową
i wywozową, odprawę przekazową, złożenie towaru na skład a także powrotny

Activities of the Customs Service aimed at Combating Crime in Trade as an Element of Securing the Effective and Efficient Collection of Budget Revenue
The Customs Service, carrying out a function of a revenue collector, collects not only customs duties but also other charges and taxes comprising budget revenue. They constitute approximately 30% of the total state budget revenue. The aim of the article is to present the significance of the Customs Service operations in combating crime, thus increasing the effectiveness and efficiency of collecting public duties. Due to the volume and complexity of the problem of customs crime, as well as the scope of fiscal duties of customs authorities, the analysis is focused on trade in goods. With this regard, the method of descriptive and comparative analysis has been employed. The performed analysis has lead to a conclusion that taxes collected by the Customs Service related to trade in goods, constitute a very solid and reliable source of budget revenue, hence, ensuring the effective and efficient collection of the duties is vital from the perspective of state finances
E-usługi w obsłudze celnej − wybrane aspekty z punktu widzenia działań kontrolnych w ruchu granicznym
Kontrola celna, będąca głównym atrybutem obsługi celnej w ruchu granicznym,
jest często negatywnie postrzegana przez kontrolowanych. Służba Celna, mając
na uwadze, że niezwykle istotny jest sposób jej przeprowadzania, unowocześnia
metody i narzędzia wykorzystywane w działaniach kontrolnych. Przykładem innowacyjnych
rozwiązań w tym obszarze są usługi elektroniczne, tzw. e-usługi. Proces
ułatwiania obsługi celnej nie może jednak negatywnie wpływać na efektywność
i skuteczność działań kontrolnych. Uzyskanie kompromisu pomiędzy liczbą
rozwiązań mających na celu zmniejszenie barier w obsłudze celnej, wpływających
bezpośrednio na skrócenie czasu odprawy celnej i obniżenie kosztów ponoszonych
przez przedsiębiorców, a koniecznością skutecznej kontroli, która jest kluczowym
elementem w procesie zapewniania bezpieczeństwa obrotu towarowego,
jest zadaniem trudnym, ale jak pokazuje praktyka możliwym. Katalog ułatwień
stosowanych w obsłudze celnej (w tym także e-ułatwień) jest już dziś znacząco
rozbudowany i nadal ma charakter otwarty. Celem niniejszego artykułu jest przedstawienie
istoty kontroli celnej, ram strategicznych wprowadzania elektronicznych
ułatwień oraz identyfikacja i charakterystyka e-usług usprawniających obsługę celną
w ruchu granicznym.Customs control, which is the characteristic feature of customs services in cross-border
traffc, is frequently perceived negatively by those subjected to it. The Customs Service,
taking into account the importance of how control activities are carried out, modernizes
the methods and tools employed in control processes. One example of innovative solutions are electronic customs services, the so-called e-customs. The process of facilitating
customs processing cannot, however, hinder the effectiveness and effciency of control
activities. Reaching a compromise between the number of solutions reducing barriers in
customs processing, which directly translate into shortening the customs clearance process
as well as decreasing costs incurred by economic operators; and the necessity for effective control, which in turn is a key element in the process of safeguarding of the cross-border
freight traffc; is diffcult, yet feasible a task, as suggested by the evidence from the current practice. The catalogue of customs simplifcations (including e-simplifcations), has
been expanded signifcantly and still has an open character. The aim of the paper is to
present the essence of customs control, the strategic framework for the implementation of
electronic simplifcations as well as to identify and characterize e-customs which facilitate
customs procedures in the cross-border traffc
W obliczu wyzwań – pół wieku funkcjonowania unii celnej w Unii Europejskiej
Unia celna jest jednym z najwcześniejszych i najważniejszych osiągnięć Unii Europejskiej. Jubileusz pięćdziesięciolecia jej istnienia należy uznać za znaczący fakt w historii Unii Europejskiej i dobry moment do refleksji nad jej rolą i znaczeniem. Celem artykułu jest zidentyfikowanie najważniejszych osiągnięć europejskiej unii celnej a zarazem zastanowienie się nad jej przyszłymi zadaniami. Zastosowana metodologia sprowadza się do analizy opisowej, poprzedzonej przeglądem źródeł literaturowych i aktów unijnego prawodawstwa wtórnego. Przeprowadzone rozważania pozwoliły wysunąć wniosek, że ponad pięćdziesięcioletnia historia unii celnej pokazuje, że system celny funkcjonujący w jej ramach, z powodzeniem wypełniał swoje funkcje, szybko dostosowując się do nowych zadań i coraz większych wymagań. Dalszy rozwój unii celnej jest niezwykle ważny i wymaga elastyczności i sprawności w działaniu.The customs union is one of the earliest and most significant achievements of the European Union. The 50th anniversary if its existence must be acknowledged as a crucial moment in the history of the EU as well as a good opportunity to reflect on its role and relevance. The aim of the article is to indicate and assess the most important achievements of the European customs union and, at the same time, to consider its future objectives. The methodology employed in the paper consists in a descriptive analysis, preceded by a review of the subject literature and the EU secondary legislation. The research findings allowed a conclusion to be drawn that the fifty years of the customs union history have shown that the customs system functioning within the EU has successfully performed its roles, quickly adapting to new challenges and everincreasing demands. The further development of the customs union is critical and requires flexibility as well as efficiency
Customs security and risk in the legal environment and the competitiveness of eu enterprises participating in international trade
Legitimate operations of enterprises are subject to particular legal regulations.
These rules are often quite complicated and voluminous and their complexity, as well as
a lack of uniform interpretation, negatively affect the legal certainty and create conditions
for the occurrence of numerous threats and types of risk. A participant in the international
trade in goods should pay special attention to customs threats and risk. The aim of the
present article is to identify the most important threats and sources of risk to customs as
well as to indicate selected instruments enhancing security in the area of the legal environment
of an enterprise that could have a direct impact on the competitiveness of EU companies.
The carried out considerations allowed drawing a conclusion that favorable customs
regulatory environment and minimizing customs threats and risks guarantee a level playing
field for economic operators within the internal market as well as contribute to increasing
the competitiveness of EU entities in external markets
