    A National ID for all citizens and residents of India has long being considered a critical necessity, albeit the related projects have been in pilot mode for the past several years and no distinct road ahead seems to be coming out. The government has been focusing on inclusive growth and has launched several schemes at different levels to facilitate the same. However, monitoring the execution of these schemes and understanding clearly if the targeted citizens actually have got benefited, would demand for substantial granularity of information and doing away with information bottlenecks. Interestingly, proper execution of the National ID project by the government can prove to be useful for execution of various schemes and projects as well as in accessing multiple government and private sector services. This paper focuses on the need for a single national identity system in India and its proposed execution which may actually be linked to citizen life cycle. The other aspects covered and analyzed include current Indian scenario, challenges, existing identification systems and loopholes in the existing systems. Major challenges seem to be coming from enrolments, technology platform choice and strategic design, corresponding policy and legal frameworks. The paper also discusses about international scenario of single national id projects undertaken in 27 countries across the globe to understand current status, adoption and usage. To reinforce the need for national ID, the existing IDs were analysed based on a scoring model considering various dimensions. Primary research was conducted, based on which it was found none of the existing IDs was able to satisfy as a National ID based on the scoring model. The proposed road map has been discussed in length i.e technology platform, smart card technology, legal and administrative framework, business model based on Private-Public Partnership (PPP) considering the mammoth and diverse population. A ranking matrix may be created to come up with a composite score for all districts based on various dimensions. The execution may be planned to be executed without asking Indians to stand in queue for one more ID and accelerating towards a more secured society and more importantly ensuring better delivery of Government services to citizens.

    Although many official documents and forms of identification contain a sex or gender identifier, gender, as a category on these documents, is not very helpful in confirming a person\u27s identity. If the purpose of the inclusion of gender on official documents is to accurately identify an individual, technological advances have given us more accurate methods of ensuring a person\u27s identity. Technologies such as fingerprinting, facial recognition and retinal scans are far superior methods of determining whether a person is who they claim to be. The use of gender or sex on identification cards does little to positively identify individuals, and instead, creates problems for people who do not fall neatly into either of the two currently accepted categories of sex or gender. As a weak identifier, gender should not appear as a category on a state issued driver\u27s license or official identification card, yet states no longer have the authority to decide whether to require its inclusion. The REAL ID Act of 2005 recently went into effect, establishing requirements for state issued identification cards and driver\u27s licenses. The REAL ID Act requires states to issue driver\u27s licenses and identification cards that meet certain requirements to ensure more accurate identification in the post 9/11 world. The nine minimum requirements for information that states must provide on these cards include a person\u27s gender. Although critics have attacked the REAL ID Act on many grounds as an affront to civil liberties, as an unwelcome federal intrusion to a state\u27s police powers, or as the dreaded creation of a national identification card, I argue that the government should remove gender as a required identifier for two additional reasons. First, by barring any state from removing gender or sex from identification cards, the REAL ID Act prevents any state from removing these categories in an effort to reduce the complications of inclusion that a gender identifier inflicts on its gender variant citizens. Second, including a description of gender or sex is not an accurate method of identification, in no small part because gender and sex are not fixed and may later change, so should not be required under a federal law that ostensibly seeks to improve the accuracy of identity cards. This Article first examines the limits of legal classifications that view human traits as dichotomous. Next, it reviews the medical, scientific, and legal problems created by imposing a binary of sex or gender and the resulting problems this creates for many sexual minorities. Finally, this Article examines the REAL ID Act\u27s requirement to include gender, critiquing its inclusion as a poor identifier in light of current identification technology, and a problematic or discriminatory identifier for certain sexual minorities

    Credit Card Fraud: A New Perspective On Tackling An Intransigent Problem

    This article offers a new perspective on battling credit card fraud. It departs from a focus on post factum liability, which characterizes most legal scholarship and federal legislation on credit card fraud and applies corrective mechanisms only after the damage is done. Instead, this article focuses on preempting credit card fraud by tackling the root causes of the problem: the built-in incentives that keep the credit card industry from fighting fraud on a system-wide basis. This article examines how credit card companies and banks have created a self-interested infrastructure that insulates them from the liabilities and costs of credit card fraud. Contrary to widespread belief, retailers, not card companies or banks, absorb much of the loss caused by thieves who shop with stolen credit cards. Also, credit card companies and banks earn fees from every credit card transaction, including those that are fraudulent. In addressing these problems, this article advocates broad reforms, including legislation that would mandate data security standards for the industry, empower multiple stakeholders to create the new standards, and offer companies incentives to comply by capping bank fees for those that are compliant, while deregulating fees for those that are not compliant
