    Transcendental Pragmatics and Hermeneutics

    Abstract: In which sense could transcendental pragmatics combined with a hermeneutical approach provide the social sciences with a critical oriented approach? This essay aims at giving an answer to that question by elaborating the critical intent of Apel"s approach to transcendental pragmatics and hermeneutics. Hermeneutics itself is considered to have critical potentials by its explicit focus upon the normative presuppositions of the social sciences. Hermeneutics does not, however, provide the sciences with any clear-cut criterions of critique. Nor does hermeneutics escape from a certain relativistic strain, due to the contextual, i.e.; socio-historically relative basis of the normative presuppositions of any hermeneutic approach. The meta-normative conditions of transcendental pragmatics are counterpoising the relativism as well as lack of normative criterions inherent in hermeneutical thinking. The meta-normative conditions of symmetry and reciprocity are meant to be a meta-normative standard for critique as well as functioning as conditions of a valid consensus within a community of scientists. Thereby, Apel is giving a solution to the validation-problem, as well as a compensation for the lack of criterions of criticism within hermeneutics. I will divide the essay into three main topics, and i) start with explicating the transcendental-pragmatic approach of Apel, ii) continue by dealing with his criticism of as well as positive appropriation of hermeneutical thinking, and iii) work out examples of a critical-hermeneutical approach in the last parts of the essay. The main example used will be from contemporary Norwegian sociology, dealing with the possibility of a unitary critical approach. The closing part (iv) will have clarifying purposes

    The Methodological Usefulness of Deep Disagreement

    In this paper I begin by examining Fogelin’s account of deep disagreement. My contention is that this account is so deeply flawed as to cast doubt on the possibility that such deep disagreements actually happen. Nevertheless, I contend that the notion of deep disagreement itself is a useful theoretical foil for thinking about argumentation. The second part of this paper makes this case by showing how thinking about deep disagreements from the perspective of rhetoric, Walton-style argumentation theory, computation, and normative pragmatics can all yield insights that are useful no matter what one’s orientation within the study of argument. Thus, I conclude that deep disagreement –even if it were to turn out that there are no real-world occurrences of it to which we can point–is useful for theorists of argumentation. In this wise, deep disagreement poses a theoretical challenge for argumentation theory not unlike that posed by radical skepticism for traditional epistemolog

    "Freedom" through Repression: Epistemic Closure in Agricultural Trade Negotiations

    A central concern of critical theory is that of how the forces of Modern reason cause certain logics to become reified in the name of rational progress. Two such logics – the ongoing spread of liberal capitalism, and territorial particularism – are simultaneously embodied within social institutions such as the World Trade Organization (WTO) that regulate the global economy, a phenomenon that occurs on the premise of maximising global welfare. Building upon a critical reading of Jürgen Habermas' theory of communicative action, this article undertakes an empirical immanent critique of the extent to which such logics repress the possibility of normative imperatives being considered within agricultural trade negotiations. Specifically, it argues that the dialectic of functionalist and communicative rationality, operating as a theoretical heuristic, reveals that the DDA is susceptible to an ethical indictment that arises from its inability to countenance the alternatives to the dual logics of neo-liberalism and state-interest that could otherwise emerge from a free and rational discussion. The nature of the WTO as a site of social action is revealed to be that of a closed epistemic community in which important normative claims are repressed, and as such, one in which the underlying rational bases for communication are fundamentally distorted

    Assessing relevance

    This paper advances an approach to relevance grounded on patterns of material inference called argumentation schemes, which can account for the reconstruction and the evaluation of relevance relations. In order to account for relevance in different types of dialogical contexts, pursuing also non-cognitive goals, and measuring the scalar strength of relevance, communicative acts are conceived as dialogue moves, whose coherence with the previous ones or the context is represented as the conclusion of steps of material inferences. Such inferences are described using argumentation schemes and are evaluated by considering 1) their defeasibility, and 2) the acceptability of the implicit premises on which they are based. The assessment of both the relevance of an utterance and the strength thereof depends on the evaluation of three interrelated factors: 1) number of inferential steps required; 2) the types of argumentation schemes involved; and 3) the implicit premises required

    The philosophical significance of binary categories in Habermas’s discourse ethics

    The philosophical programme associated with the discourse ethics of Jürgen Habermas has been widely discussed in the literature. The fact that Habermas has devoted a considerable part of his work to the elaboration of this philosophical programme indicates that discourse ethics can be regarded as a cornerstone of his communication-theoretic approach to society. In essence, Habermas conceives of discourse ethics as a philosophical framework which derives the coordinative power of social normativity from the discursive power of communicative rationality. Although there is an extensive literature on Habermas’s communication-theoretic account of society, almost no attention has been paid to the fact that the theoretical framework which undergirds his discourse ethics is based on a number of binary conceptual divisions. It is the purpose of this paper to shed light on the philosophical significance of these binary categories in Habermas’s discourse ethics and thereby demonstrate that their complexity is indicative of the subject’s tension-laden immersion in social reality

    I submit that arguers may use apostrophe (direct address to someone present or absent) to pressure reluctant auditors to adhere to norms of argumentation, and illustrate with the exemplary case of Abraham Lincoln’s 1860 speech at Cooper Union. Lincoln uses apostrophe to manifest the norm of tenta-tively considering a reasonable case and to discharge his obligation to adhere to the norm; and in doing so pressures auditors to adhere to it

    Effective argumentation in international politics is widely conceived as a matter of persuasion. In particular, the ‘logic of arguing’ ascribes explanatory power to the ‘better argument’ and promises to illuminate the conditions of legitimate normative change. This article exposes the self-defeating implications of the Habermasian symbiosis between the normative and the empirical force of arguments. Since genuine persuasion is neither observable nor knowable, its analysis critically depends on what scholars consider to be the better argument. Seemingly, objective criteria such as universality only camouflage such moral reification. The paradoxical consequence of an explanatory concept of arguing is that moral discourse is no longer conceptualized as an open-ended process of contestation and normative change, but has recently been recast as a governance mechanism ensuring the compliance of international actors with pre-defined norms. This dilemma can be avoided through a positivist reification of valid norms, as in socialization research, or by adopting a critical and emancipatory focus on the obstacles to true persuasion. Still, both solutions remain dependent on the ‘persuasion vs. coercion’ problem that forestalls an insight into successful justificatory practices other than rational communication. The conclusion therefore pleas for a pragmatic abstention from better arguments and points to the insights to be gained from pragmatist norms research in sociology

    Discourse or dialogue? Habermas, the Bakhtin Circle, and the question of concrete utterances

The final publication is available at Springer via the link below.This article argues that the Bakhtin Circle presents a more realistic theory of concrete dialogue than the theory of discourse elaborated by Habermas. The Bakhtin Circle places speech within the “concrete whole utterance” and by this phrase they mean that the study of everyday language should be analyzed through the mediations of historical social systems such as capitalism. These mediations are also characterized by a determinate set of contradictions—the capital-labor contradiction in capitalism, for example—that are reproduced in unique ways in more concrete forms of life (the state, education, religion, culture, and so on). Utterances always dialectically refract these processes and as such are internal concrete moments, or concrete social forms, of them. Moreover, new and unrepeatable dialogic events arise in these concrete social forms in order to overcome and understand the constant dialectical flux of social life. But this theory of dialogue is different from that expounded by Habermas, who tends to explore speech acts by reproducing a dualism between repeatable and universal “abstract” discursive processes (commonly known as the ideal speech situation) and empirical uses of discourse. These critical points against Habermas are developed by focusing on six main areas: sentences and utterances; the lifeworld and background language; active versus passive understandings of language; validity claims; obligation and relevance in language; and dialectical universalism

    Public hearings as proceduralization of popular sovereignty policies in supreme courts : an intersubjective approach

    This paper aims to discuss in which sense public hearings in supreme courts of democratic rules of law can be seen as proceduralization of popular sovereignty policies. These policies constitute expressions of a normative claim for a wider “publicization of law” by democratic states’ institutional powers and organs; a claim that becomes evident when one undertakes an intersubjective interpretation of law. This theoretical argument will be presented in the first section of the paper through a new articulation of Jürgen Habermas’ discursive theory of law and his most recent studies on the concept of political public sphere. The theoretical section gives normative and procedural criteria for the second section of the paper, which consists on a critical analysis of the procedures and practical cases of public hearings held at the Brazilian Supreme Court, constituting the first scientific study to date on the Court’s use of this legal instrument
