The Tea Party Movement and the Perils of Popular Originalism

The Tea Party movement presents something of a curiosity for constitutional theory because it combines originalist ideology and popular constitutionalist methods. Like minotaurs, werewolves, and other half-man, half-animal hybrids of myth and legend, the Tea Party\u27s hybrid of originalism and popular constitutionalism serves to expose the limitations of both sources upon which it draws. Although originalists assert that interpreting the Constitution according to its original meaning would take politics out of constitutional law, the Tea Party movement shows that originalism also provides a powerful political rhetoric. Moreover, while popular constitutionalists assert that democracy would be advanced by empowering the people to effectuate their constitutional understandings through ordinary politics, the Tea Party movement shows that when a popular movement advances a narrow, nationalist understanding of the Constitution, popular constitutionalism can also serve to restrict popular democrac

The Tea Party has become a powerful force in American politics. Emerging in early 2009, the Tea Party has elicited mass support among the public with important implications for public policy and electoral politics. However, there remains significant debate over the political characteristics and motivations of Tea Party supporters. The emergence of the Tea Party has also led to speculation that supporters will form a third party. Using survey data collected in 2010 and 2011, this dissertation examines the relationship between Tea Party and third party supporters. Evidence is found that although Tea Party and third party supporters disapprove of President Obama and hold negative views of the economy, the two groups are fundamentally different in terms of their partisanship and political attitudes. Tea Party supporters are found to be ideologically conservative Republicans, while third party supporters are shown to be political independents holding negative opinions of both parties. Using American National Election Studies data, this dissertation also explains the motivations behind Tea Party support. Evidence is found that Tea Party support is motivated by traditional moral values, racial resentment, negative views of President Obama, negative opinions of immigrants, and libertarianism. This dissertation also examines the emotional component of Tea Party support finding that strong feelings of anger and fear, related to perceptions of the state of the country, motivates support. Finally, this dissertation analyzes an aggregation of public opinion data measuring opinions of the Tea Party from 2010 to 2011. Support for the Tea Party is found to have declined from 2010 through the end of 2011, with the most precipitous decline occurring among its most ardent supporters. Ultimately, the findings of this dissertation suggest that the emergence of the Tea Party has created a rift within the Republican Party between the moderate and ideologically extreme elements, constituting a barrier to legislative compromise

The Tea Party and the Constitution

This Article considers the Tea Party as a constitutional movement. I explore the Tea Party\u27s ambitious effort to transform the role of the Constitution in American life, examining both the substance of the Tea Party\u27s constitutional claims and the tactics movement leaders have embraced for advancing these claims. No major social movement in modern American history has so explicitly tied its reform agenda to the Constitution. From the time when the Tea Party burst onto the American political scene in early 2009, its supporters claimed in no uncertain terms that much recent federal government action overstepped constitutionally defined limitations. A belief that the Constitution establishes clear boundaries on federal power is at the core of the Tea Party\u27s constitutional vision. Yet the most distinctive-and I believe ultimately the most significant-aspect of the Tea Party\u27s constitutional vision is not necessarily the specifics of its constitutional claims (these ideas have long been common currency in conservative and libertarian circles), but the distinctly non-judicial and participatory approach the Tea Party has taken to its project of constitutional reform. The Tea Party offers a powerful case study what a recent generation of scholarship has identified as popular constitutionalism. Its constitutional agenda has little role for the courts. Tea Party activists have been strikingly successful in locating arenas of constitutional activism that do not depend upon the formal apparatus of the law, such as judges, lawyers, and complex legal doctrine. Rather than litigation, the Tea Party has pursued an agenda of constitutional practice focused on educational outreach and political mobilization. After describing the key elements of Tea Party constitutionalism, with a focus on the extrajudicial mechanisms through which the Tea Party has advanced its constitutional agenda, I conclude with an assessment of the possible impact of the Tea Party on constitutional law and practice, as well as its implications for future scholarship on popular constitutional mobilization

The Tea Party has come to prominence in the last several years as a force to be reckoned with in American politics. The Tea Party movement has affected major electoral races, publicly supporting some candidates and renouncing others, leading to placement of Tea Party-supporting representatives in Congress and losses by some highly favored opponents of the Tea Party. The movement relies on a great amount of support from Republicans, yet acts in ways that could classify it as an independent movement. In order to answer the question of what, exactly, the Tea Party movement is, and what it has the potential to become, this article examines survey data to compare attitudes and beliefs between Tea Party supporters and the rest of the population. The data point to a classification of the Tea Party as a faction of the Republican Party, with the potential for support independent of the major parties as a possible third party in the future

It was 1966 and I was seven years old. We lived in Berkeley, California. I was dressed up for a birthday party. I had on a white dress with frills around the sleeves and the hem. My white socks were ringed at the top with a thin strip of lace. I had folded them down so that the lace neatly encircled my ankle, right above my black patent-leather mary janes. I even had on my best underwear that had fringes of lace all across the bottom. My parents were driving me to the party. They said that we would leave the house a little bit early because they had to stop somewhere on the way. They were not dressed up like I was. They both wore jeans and sandals. It didn\u27t matter to me, I was the only one going to the party. ~ article excerpt
