    The Case for CAPSL: Architectural Solutions to Licensing and Distribution in Emerging Music Markets

    Compulsory licensing in music has paved the way for a limited class of new noninteractive services. However, innovation and competition are stifled in the field of interactive or otherwise novel services due to high transaction costs inherent in direct licensing. While the creation of a new compulsory license available to a wider array of services may facilitate growth and diversity in new markets, it is unlikely that the legislative process can deliver a new compulsory regime in time to serve relevant interests. Furthermore, the risk exists that legislation written in response to contemporary technology will likely fail to recognize the diversity within the music industry, and therefore will underserve both artists and potential licensees. As such, this brief argues for the creation and adoption of a new standardized protocol for artists and labels to announce the availability of new content with attached standardized licensing terms for automated integration into the catalogs of new or existing digital music services. Such a protocol would allow for automated systems of pricing, distribution, and tracking to reduce transaction costs, increase market transparency, and commodify user participation

    Automated legal sensemaking: the centrality of relevance and intentionality

    Introduction: In a perfect world, discovery would ideally be conducted by the senior litigator who is responsible for developing and fully understanding all nuances of their client’s legal strategy. Of course today we must deal with the explosion of electronically stored information (ESI) that never is less than tens-of-thousands of documents in small cases and now increasingly involves multi-million-document populations for internal corporate investigations and litigations. Therefore scalable processes and technologies are required as a substitute for the authority’s judgment. The approaches taken have typically either substituted large teams of surrogate human reviewers using vastly simplified issue coding reference materials or employed increasingly sophisticated computational resources with little focus on quality metrics to insure retrieval consistent with the legal goal. What is required is a system (people, process, and technology) that replicates and automates the senior litigator’s human judgment. In this paper we utilize 15 years of sensemaking research to establish the minimum acceptable basis for conducting a document review that meets the needs of a legal proceeding. There is no substitute for a rigorous characterization of the explicit and tacit goals of the senior litigator. Once a process has been established for capturing the authority’s relevance criteria, we argue that literal translation of requirements into technical specifications does not properly account for the activities or states-of-affairs of interest. Having only a data warehouse of written records, it is also necessary to discover the intentions of actors involved in textual communications. But there seems to be no clear migration path nor goal which can cast light on the question where the finance industry and its various players will be and should be in a decade from now. The mission of the E-Finance Lab is the development and application of research methodologies in the financial industry that promote and assess how business strategies and structures are shared and supported by strategies and structures of information systems. Important challenges include the design of smart production infrastructures, the development and evaluation of advantageous sourcing strategies and smart selling concepts to enable new revenue streams for financial service providers in the future.     How Supervisors Influence Performance: A Multilevel Study of Coaching and Group Management in Technology-Mediated Services

    This multilevel study examines the role of supervisors in improving employee performance through the use of coaching and group management practices. It examines the individual and synergistic effects of these management practices. The research subjects are call center agents in highly standardized jobs, and the organizational context is one in which calls, or task assignments, are randomly distributed via automated technology, providing a quasi-experimental approach in a real-world context. Results show that the amount of coaching that an employee received each month predicted objective performance improvements over time. Moreover, workers exhibited higher performance where their supervisor emphasized group assignments and group incentives and where technology was more automated. Finally, the positive relationship between coaching and performance was stronger where supervisors made greater use of group incentives, where technology was less automated, and where technological changes were less frequent. Implications and potential limitations of the present study are discussed

    Transaction Streams: Definition and Implications for Trust in Internet-Based Electronic Commerce.

    In this paper we analyze how transactions related to the exchange of goods and services are being performed on the Internet. The adoption of electronic markets in an industry has a disintermediation potential because it can create a direct link between the producer and the consumer (without the need for the intermediation role of distributors). Electronic markets lower the search cost, allowing customers to choose among more providers (which ultimately reduces both the costs for the customer and the profits for the producer). In this paper we contend that electronic markets on the Internet have the opposite effect, resulting in our increase in the number of intermediators. We introduce transaction streams, which model how transactions are being conducted and help explain the types of new intermediators that are appearing on the Internet. We also describe mechanisms by which companies are exploring ways of extending transaction streams. To illustrate the model and validate our findings, we analyze transaction streams in the insurance industry and review associated concepts such as trust and brands.transactions; electronic markets;
