    Western Donbass is a powerful coal-mining region in the Steppe zone of Ukraine. In this region, large areas are damaged by coal mining. The mine rocks spread all over the coal district of Dnipropetrovsk region often contain toxic inorganic contaminants. In this regard using mine rocks for biological reclamation is nowadays an important environmental issue.     The objective of this research is to analyze the influence of partial and simultaneous determinants of capital structure, including the cost of debt, business risk, size, growth, dividend policy, and profitability. This research also analyzes the influence of differences the capital structure determinants in two different sub sectors. Listed sub sector of coal mining and non coal mining companies at Indonesia Stock Exchange period 2008-2012 were examined. Based on the census method, 17 coal mining companies and 14 non coal mining companies were included in the research. This research applied multiple regression analysis and Chow test. The result showed that simultaneously, all six independent variables do not significantly affect the capital structure on the sub sector of coal mining but significantly affect it on the sub sector of non coal mining. Partially, the influence of six independent variables varied in sub sector of coal mining and non coal mining. The result of Chow test showed that all variables has a different influence on the capital structure between those two sub sectors

    Publications on Chronic Disease in Coal Dependent Communities in Central Appalachia

    CONTEXT: Agency and nonprofit reports have traditionally been the source of health information in Appalachia. Recently, publications have appeared in the literature associating coal mining, specifically mountain top mining, with numerous chronic health conditions spurring debate among environmental and industry interest groups. Publication quantity and quality were objectively assessed. This article reports on a literature review and analysis of publications on chronic disease in coal dependent communities in Appalachia. OBJECTIVE: To conduct a review and analysis of original, peer reviewed research publications on chronic health conditions in communities dependent on coal mining with a focus on central Appalachia and report on publication and research quantity and quality. DATA SOURCES: Thorough searches were conducted using PubMed, EBSCO, and CiNAHL computerized databases to identify original, peer-reviewed research articles addressing ‘Appalachia’, ‘health’ and ‘coal’. STUDY SELECTION: The computerized database search identified original research publications relevant to chronic health conditions (heart disease, lung disease, kidney disease, cancers, diabetes, obesity, etc.) and coal mining in central Appalachia. DATA EXTRACTION: Quantitative measures of the literature review provided information on author collaborations, year of publication, frequency of publication by contributing authors, etc. Journal impact factors were noted and other objective qualitative criteria were considered. DATA SYNTHESIS: Over 60 publications relevant to mining with 38 publications specific to Appalachia and health were identified. The publications were reviewed relative to relevance and article quality i.e., current, original research, application to central Appalachia and discussions of chronic human health and coal mining. Over the past five years most of the publications relevant to chronic disease and coal mining in central Appalachia resulted from a research group with a single common author. CONCLUSIONS: Science based evidence is needed and data must be provided by independent researchers from various disciplines of study to share different perspectives on how to alleviate the longstanding health disparities in central Appalachia. Studies will require the application of sound methodologies to validate the findings and support future interventions

    IMPLEMENTATION OF PRECAUTIONARY PRINCIPLE IN COAL MINING LICENSES IN CENTRAL BENGKULU REGENCY OF BENGKULU PROVINCE

    Coal mining license is a juridical instrument for businessmen to carry out coal mining activities. Coal mining license is also a preventive instrument to prevent coal mining activities from causing environmental damage and pollution. In the process of issuing and implementing coal mining licenses according to Law Number 32 of 2009 concerning Environmental Protection and Management, one must consider the precautionary principle, which is implemented by integrating environmental considerations, in making coal mining licenses decisions. However, coal mining activities carried out by 9 coal mining companies in the Watershed of Air Bengkulu, showed that there was environmental destruction and pollution seen along the Watershed of Air Bengkulu. This study aimed to determine the application of the precautionary principle to coal mining licenses and the legal consequences of coal mining license decisions that did not apply the precautionary principle. This research was conducted using juridical empirical/socio-legal research, and data analysis was carried out using a qualitative juridical approach. The results of this research showed that the government of Bengkulu Province has not applied the precautionary principle in the process and implementation of coal mining license in the Watershed of Air Bengkulu of Central Bengkulu Regency. The legal consequence of not applying the precautionary principle in the decision to issue 9 (nine) coal mining licenses which was an essential and material requirement in a decision to issue a permit was null and void (nietig van rechtwege) and could be canceled (vernietig baar), the government of Bengkulu Province has the authority to cancel the licenses decision because it is a State Administration official
