    BG Group and “Conditions” to Arbitral Jurisdiction

    Although the Supreme Court has over the last decade generated a robust body of arbitration caselaw, its first decision in the area of investment arbitration under a Bilateral Investment Treaty was only handed down in 2014. BG Group v. Argentina was widely anticipated and has attracted much notice, and general approval, on the part of the arbitration community. In this paper we assess the Court’s decision from two different perspectives—the first attempts to situate it in the discourse of the American law of commercial arbitration; the second considers it in light of the expectations of the international community surrounding the proper construction of Conventions between states. Our initial goal had been to write jointly, with the hope that we could bridge our differences to find, if not common, at least neighboring, ground. On some points we did so, but ultimately our divergent appreciations of the proper way to interpret the condition precedent in the investment treaty in BG Group overcame the idealism with which we commenced the project. Nonetheless we have decided to present the two papers together to emphasize the dichotomous approaches to treaty interpretation that two moderately sensible people, who inhabit overlapping but non-congruent interpretive communities, can have.The Kay Bailey Hutchison Center for Energy, Law, and Busines

    Measuring wheel/rail contact stresses using ultrasound

    The investigation of contact area and pressure distribution in a wheel/rail contact is essential information required in fatigue and wear calculations to determine design life, regrinding requirements, and maintenance schedules. The aim of this work was to use ultrasound to non-destructively determine wheel/rail contact pressures. Three different contacts were investigated those resulting from; un-used, sand damaged, and worn wheel/rail specimens. A wheel/rail interface behaves like a spring. If the pressure is high the interface is very stiff, with few air gaps, and allows the transmission of an ultrasonic sound wave. If the pressure is low, interfacial stiffness is low and almost all the ultrasound is reflected. A spring model was used to determine maps of contact stiffness from wheel/rail ultrasonic reflection data. Pressure was then determined using a calibration experiment. Separate calibrations were performed for each of the three sets of wheel/rail specimens investigated. Measured contact pressure distributions are compared to those determined using analytical and computer bases numerical techniques

    Vacuum ultraviolet holography

    The authors report the first demonstration of holographic techniques in the vacuum ultraviolet spectral region. Holograms were produced with coherent 1182 A radiation. The holograms were recorded in polymethyl methacrylate and read out with an electron microscope. A holographic grating with a fringe spacing of 836 A was produced and far-field Fraunhofer holograms of sub-micron particles were recorded

    Novel utilization of powder-suspension hybrid feedstock in HVAF spraying to deposit improved wear and corrosion resistant coatings

    Deployment of a suspension feedstock has been known to alleviate problems associated with using sub-micron and nanosized powder feedstock for thermal spraying of monolithic as well as powder-suspension ‘hybrid’ composite coatings. However, a powder-suspension hybrid feedstock has never been previously used in high-velocity air-fuel (HVAF) spraying. In this work, for the very first time, a chromium carbide (Cr3C2) suspension has been co-sprayed along with an Inconel-625 (IN-625) powder by the HVAF process as an illustrative case study. Two variants of the IN-625 + Cr3C2 hybrid coatings were produced by varying relative powder-suspension feed rates. For comparison, pure IN-625 coating was also deposited utilizing identical spray parameters. Detailed microstructural characterization, porosity content, hardness measurement and phase analysis of the as-deposited coatings was performed. The suspension-derived carbides were retained in the bulk of the coating, resulting in higher hardness. In the dry sliding wear test, the hybrid coatings demonstrated lower wear rate and higher coefficient of friction (CoF) compared to the conventional, powder-derived IN-625 coatings. Furthermore, the wear rate improved slightly with an increase in Cr3C2 content in the hybrid coating. Post-wear analysis of the worn coating, worn alumina ball and the wear debris was performed to understand the wear mechanisms and material transfer in the investigated coatings. In the potentiodynamic polarization test, higher corrosion resistance for hybrid coatings than conventional IN-625 coatings was achieved, indicating that the incorporation of a secondary, carbide phase in the IN-625 matrix did not compromise its corrosion performance. This work demonstrates a novel approach to incorporate any finely distributed second phase in HVAF sprayed coatings to enhance their performance when exposed to harsh environments
