El presente ensayo analiza las principales reformas que el Código Civil y Comercial argentino introduce al Régimen patrimonial familiar. Como estrategia de abordaje, se estudian algunos antecedentes de la jurisprudencia de la Corte Federal sobre este tópico, a fin de detectar principios o reglas troncales que han sido fuente material del Código Civil y Comercial, y recoge algunas reformas que trae nueva legislación argentina en esta materia.This paper studies the right to maintenance of children and adolescents. It analyses the most relevant and important jurisprudence of the Federal Court on this topic in order to identify the principles or rules that have acted as the material source of the Civil and Commercial Code. Las uniones convivenciales en el derecho proyectado argentino: ¿será lo mismo casarse que no casarse?

Las uniones convivenciales constituyen una forma de organización familiar cada vez más difundida en Argentina, no obstante lo cual, el derecho vigente adolece de una regulación adecuada. El Proyecto de Código Civil y Comercial, enfocado desde el paradigma constitucional de los derechos humanos, incorpora una propuesta normativa diferenciada del matrimonio, que respeta la autonomía personal de los convivientes al tiempo que tutela los derechos esenciales de quienes optaron por esta forma de organización familiar. Propone una regulación parcial y equilibrada que propicia la celebración de pactos para acordar los efectos de la vida en común, pero establece un núcleo mínimo de garantías anclado en la responsabilidad familiar que se erige como régimen primario inderogable

Alimentos a los hijos a cinco años de vigencia del Código Civil y Comercial argentino

This article presents the main aspects of the alimony regime that regulate the amount owed by parents to children according to the Argentinian Civil and Commercial Code of 2015. It analyzes the content and amount of the alimony as well as the categories of beneficiaries. Some of these categories are children of legal age who study, unrecognized children and pregnant women. Additionally, it exposes some tensions deriving from hasty interpretations of the shared parental responsibility system. Finally, it explains the measures to take in order to guarantee compliance with the legal obligations of alimony
