    What Went Wrong with Wang?: An Examination of Immigration and Naturalization Service v. Wang

    This Article examines the United States Supreme Court\u27s holding in INS v. Wang. The author argues that the decision severely limited judicial review of administrative decisions of suspension of deportation. She explores the factors considered by adjudicative bodies in ruling on extreme hardship and motions to reopen suspension proceedings, and examines the nature of the extreme hardship requirements in light of the holding in Wang. The author concludes that guidelines must be established which will aid in defining the term extreme hardship and establish a single evidentiary standard necessary to support this claim

    Current U.S. immigration law provides for the exclusion of all aliens who are determined ... to have a communicable disease of public health significance. In addition to numerous sexually transmitted diseases such as infectious syphilis and gonorrhea, communicable diseases of public health significance include infectious tuberculosis and human immunodeficiency virus (HIV). The first portion of this Article provides a brief overview of the history and epidemiology of tuberculosis, as well as the diagnosis and management of the disease. The Article next reviews current information on tuberculosis in immigrant populations and proceeds to a discussion of U.S. immigration processes relating to the excludability of non-U.S. citizens due to tuberculosis. Finally, the Article concludes with various recommendations for addressing the inadequacies of current methods for addressing tuberculosis within immigrant communities

    This Article examines the conflicting decisions of the Ninth Circuit Court of Appeals for the Ninth Circuit and the United States Supreme Court in the area of immigration and nationality law. The author examines the decisions of both courts, the precedents culminating in these conflicting decisions, and the views of these courts of their proper role in this area of law. The author argues that despite cautioning the Ninth Circuit to refrain from legislating law judicially, the Supreme Court has itself been an activist court that has allocated greater power to the federal government at the expense of individual rights, and that this activism results from an abdication by Congress of its duty to decide currently unresolved issues

    This Article analyzes the criteria established by the courts and the Immigration and Naturalization Service for determination of preference classification as a legitimated child where the legitimation occurs outside the United States. The author provides a comprehensive index of Board of Immigration Appeals decisions relating to legitimation under the laws of other counties, and concludes that a statutory amendment and the promulgation of additional regulations would resolve present inconsistencies and better effectuate the original purpose of existing immigration legislation

    RESUMEN: Para iniciar este debate en relación con algunas consideraciones éticas sobre la vulnerabilidad, primero se abordan aspectos generales sobre los principios básicos de la ética en la investigación. Existen tres principios básicos: el respecto a las personas, la beneficencia y no maleficencia y la justicia. El respeto por las personas incluye los elementos de consentimiento informado y la protección especial de las poblaciones vulnerables. La beneficencia también alude a dichas poblaciones vulnerables y a la directriz de maximizar los beneficios de los participantes y de la sociedad. Algunos autores han señalado un principio que debe vincularse al de beneficencia: la no maleficencia, lo que significa minimizar los riesgos de los sujetos del estudio

    Active Learning on Center Stage: Theater as a Tool for Medical Education

    Introduction: Knowledge and skill development related to communication must incorporate both affective and behavioral components, which are often difficult to deliver in a learning activity. Using theater techniques and principles can provide medical educators with tools to teach communication concepts. Methods: This 75-minute faculty development workshop presents a variety of techniques from theater and adapts them for use in medical education. Using examples related to diversity and inclusion, this session addresses general educational and theater principles, role-play, sociodrama, applied improvisation, and practical aspects of involving theater partners. The session materials include a PowerPoint presentation with facilitator notes, interactive activities to demonstrate each modality, and an evaluation. The sessions can be extended to longer formats as needed. Results: Forty-five participants at Learn Serve Lead 2016: The AAMC Annual Meeting attended the 75-minute session. We emailed 32 participants 5 months after the conference, and eight responded. Participants reported that their confidence level in using theater techniques as a tool for medical education increased from low-to-medium confidence presession to high confidence postsession. All survey respondents who were actively teaching said they had made changes to their teaching based on the workshop. All commented that they appreciated the active learning in the session. Many indicated they would appreciate video or other follow-up resources. Discussion: Principles and techniques from theater are effective tools to convey difficult-to-teach concepts related to communication. This workshop presents tools to implement activities in teaching these difficult concepts
