Polygraph examination studies at the University of Silesia
"The Department of Criminalistics at the Faculty of Law and Administration of the
University of Silesia in Katowice has been studying the polygraph examinations
for exactly 30 years now. The Department has conducted many scientific studies in
this area and the staff have also provided expert opinions for use by law enforcement
agencies. The purpose of this article is to present the problems our staff currently
encounter in working with the polygraph within Polish criminal procedures
and to present practical examples illustrating some selected problems. The article
begins with a brief description of the history of the polygraph examinations

Problems with the management of the quality of forensic expert reports in Poland : based on the example of psychology of handwriting
The existing system of management of the quality of expert reports in Poland has serious flaws on key points. It lacks appropriate verification of experts who are put on the lists of expert witnesses (such lists are maintained by presidents of regional courts). It also lacks adequate supervision of forensic experts opinions in particular court cases. The authors illustrate these problems by an example of forensic experts who work in the area of psychology of handwriting. How many experts in the field of psychology of handwriting are put on the lists all over Poland? What do they state in their opinions? How do courts treat and supervise such experts' reports in particular cases? The authors place the issues in the context of controversy attributed to the methodological aspect of psychology of handwriting
Medialny wizerunek biegłych sądowych w Polsce
The purpose of this article is an attempt to answer the question of what media image of expert witnesses is created in Poland nowadays. Next step is the determination of consequences of the media image obtained from authors’ research. A lot of outcomes of empirical researches prove that the media affects its audience and creates social opinions. Politicians are in the reelection business and often create law to meet the social expectations only. It may cause the impact of the media on governing body’s decisions on expert witnesses too. The authors’ research includes opinions of witness experts formulated in different sorts of media: television, press and the Internet. It concerns period of six months in the year 2018. Hundreds opinions were taken into consideration. In this way the current media image of expert witnesses was established and discussed
Subiektywność w opiniach biegłych sądowych – prawne, etyczne i psychologiczne aspekty
Autorzy prezentują przegląd badań empirycznych dotyczących wpływu psychologicznych uwarunkowań na decyzje podejmowane przez biegłych sądowych. Czynniki te często wiążą się z pochodzącymi z zewnątrz kontekstualnymi nastawieniami oraz aktualnie stosowanymi standardami w zakresie metod używanych przez biegłych. Dotyczy to nie tylko metod opartych na badaniach porównawczych. Występują nawet sytuacje, w których pojawiają się różne interpretacje nawet odnośnie tego samego materiału genetycznego. Jest to jedna z przyczyn występowania coraz większej liczby błędów ekspertów z zakresu nauk sądowych. Autorzy omawiają prawne i etyczne aspekty prezentowanych badań. Porównują aktywność amerykańskich instytucji, mającą na celu zminimalizowanie błędów popełnianych przez ekspertów sądowych z destrukcyjną biernością wobec tych problemów w Polsce. Jako przykład uzasadniający taką tezę wskazują raport przygotowany we wrześniu 2016 roku dla prezydenta Stanów Zjednoczonych Ameryki Północnej. Na koniec autorzy formułują sugestie odnośnie najważniejszych zmian niezbędnych w polskiej praktyce opiniodawczej
Kierunki badań prowadzonych w Katedrze Kryminalistyki Wydziału Prawa i Administracji Uniwersytetu Śląskiego : historia i aktualność
W procesie stosowania prawa nawzajem uzupełniają się dwie sfery: normatywna
oraz deskryptywna. Sfera deskryptywna (opisowa) związana jest
z tworzeniem obrazu zdarzenia, łączeniem w tym celu różnego rodzaju informacji,
argumentów, prowadzenia odpowiednich wnioskowań. W sferze tej
wykorzystywane są twierdzenia takich nauk jak: kryminalistyka, medycyna
sądowa, psychologia sądowa, psychiatria sądowa. W sferze normatywnej rekonstruuje
się zakresy zastosowania określonych regulacji prawnych, przypisuje
się zachowaniom adresatów tych regulacji odpowiednie kwalifikacje deontyczne
(kwalifikuje się poszczególne zachowania określonych podmiotów
jako nakazane, zakazane, dozwolone, fakultatywne i inne)1. Niestety, czasami
spotykamy się z uprawianiem kryminalistyki jako odmiany specyficznej nauki
procesu karnego; autorzy zamiast skoncentrować się na sferze deskryptywnej
swoje rozważania poświęcają wyłącznie kwestiom normatywnym
Perswazyjność opinii biegłego
Celem artykułu jest przedstawienie cech procesu komunikacji (interakcji)
zachodzącego między biegłym a decydentem procesowym (w konkretnej sprawie
karnej albo cywilnej) oraz potraktowanie tej interakcji jako szczególny rodzaj
aktu perswazji. Należy jednak podkreślić, że interakcja biegły – decydent
procesowy nie wyczerpuje cech klasycznego aktu perswazji
Teismo ekspertizės standartų klausimu
The study aims to draw attention to many discussion areas related to creating
and introducing standards in judicial sciences. The creation of standards
in forensic sciences is not an end in itself. Standardizing the methodologies
used by forensic experts should serve to reach the truth. The proceeding authority
makes decisions based on facts with the help of experts’ conclusions.
The standard should have a reasonable scientific basis and be susceptible to
change linked to research development in its discipline. Every area of forensic
examination cannot operate without standards. Standards allow other subjects
to determine whether the expert’s activities are correct or incorrect. Incorrect
expert opinions are not in line with the standards currently in force in a specific
area of forensic science. In the author’s view, the creation of standards in forensic
sciences cannot be without the involvement of state institutions. These institutions
should provide an organizational and financial framework to develop
best practices in multidisciplinary teams and monitor recent scientific research
results on an ongoing basis. The system of standards should constantly be open
to changes in existing standards. In ensuring that experts can learn to conduct
research properly following current standards, the essential role is provided
by the possibility to learn from their own mistakes. This possibility should be
created in the framework of procedures established by the state institutions
Selected Problems in Evaluation of Polygraph Examination Results
Standardisation is absolutely essential in methods of polygraph examination because every quality control is based on comparing features of a specific polygraph examination and established polygraph examination standards. In
the case of polygraph examination, such a standardisation includes: • the manner of carrying out a pre-test interview with the examinee • the manner of selecting control questions • the choice of control questions • the manner of presenting questions to an examinee • the identifi cation of countermeasures • the measurement and quantifi cation of physiological responses • decision about the confi guration of obtained data.
However, the application of standards for an evaluation of polygraph examination results may be connected with limits in obtaining more detailed information or may meet resistance. The objective of this study is to provide examples of such cases. In my study, I use data from observations derived from two of my empirical research projects in polygrapher conclusion accuracy

tego rodzaju doniesienia (Pietruszka, 2006a, 2006b; Widacki, red., 2002,
s. 420 i n.) obciążone są przypadłościami metodologicznymi — wielkość
próby, sposób opracowania wyników badań, oraz wadami metodycznymi
— przeprowadzanie badań w obecności „widowni”, brak eliminacji dźwiękowych
„szumów” z otoczenia. Taka sytuacja jest niedopuszczalna. Wynik
badania za pomocą analizatora głosu może w istotny sposób wpłynąć na
losy badanego człowieka (np. w przypadku badań wykonywanych w organizacjach
biznesowych). Posługiwanie się urządzeniem niesprawdzonym
empirycznie pod względem jego efektywności wydaje się działaniem
nieetycznym oraz niepragmatycznym
