Η ειδική δικαιοδοτική βάση του αδικήματος

Αντικείμενο της παρούσας μελέτης είναι η ειδική δικαιοδοτική βάση του αδικήματος, η οποία σε επίπεδο ευρωπαϊκού δικονομικού δικαίου εισάγεται με την διάταξη του άρθρου 7 σημείο 2 του Κανονισμού 1215/2012 του Ευρωπαικού Κοινοβουλίου και του Συμβουλείου, της 12ης Δεκεμβρίου 2012 για τη διεθνή δικαιοδοσία, την αναγνώριση και την εκτέλεση αποφάσεων σε ατικές και εμπορικές υποθέσεις. Με βασικό άξονα το πεδίο εφαρμογής των εξωσυμβατικών ενοχών επιχειρήθηκε μια αξιολογική ερμηνευτική προσέγγιση της νεότερης αλλλά και παλαιότερης νομολογίας του Δικαστηρίου της Ευρωπαϊκής Ενώσεως. Τέλος,δεν θα μπορούσε να παραλειφθεί η αναφορά στα γενικώς ισχύοντα του αυτόνομου αστικού δικονομικού δικαίου, δια τούτο προκρίθηκε η σύντομη αναφορά στην αντίστοιχη διάταξη του ΚΠολΔ, που καθιερώνει στο άρθρο 35 την συντρέχουσα ειδική δωσιδικία του αδικήματος.This research paper focuses on the special Jurisdiction in Tort claims within the European Union which is introduced by the provision of Article 7 (2) of Regulation (EU) No. 1215/2012 of the European Parliament and of the Council of 12 December 2012 on Jurisdiction and the Recognition and Enforcement of Judgments in Civil and Commercial Matters. Utilizing as a basis the scope of the lawsuits involving matters of non-contractual obligation(s), an interpretative approach was undertaken to examine the preceding and present case laws of the Court of Justice of the European Union. Furthermore, an examination of the Greek Code of Civil procedure which correspondingly establishes a similar provision in Article 35 could not be omitted from this study and is accordingly included

Η Ανάδειξη των Θέσεων του Πλούταρχου Υπέρ των Ζώων και η Ανάλυσή τους υπό μια πιο Σύγχρονη Προσέγγιση

Στην παρούσα διπλωματική εργασία θα ασχοληθούμε με κείμενα του Πλούταρχου τα οποία αναφέρονται στα ζώα τα οποία είναι: Πότερον ύδωρ ή πυρ χρησιμώτερον, Πότερα των ζώων φρονιμώτερα, τα χερσαία ή τα ένυδρα, Περί του τα άλογα λόγω χρήσθαι και Περί Σαρκοφαγίας Α’,Β’. Το πρώτο έργο του Πλούταρχου Πότερονύδωρ ή πυρ χρησιμώτερον αναφέρεται σε διάφορες κοσμολογικές αντιλήψεις της εποχής και για το τι τελικά είναι πιο χρήσιμο η φωτιά ή το νερό. Στο δεύτερο έργο του Πλούταρχου Πότερα των ζώων φρονιμώτερα τα χερσαία ή τα ένυδρα θα αναλυθούν θέσεις για το αν τα ζώα κατέχουν νοημοσύνη. Σε αυτόν τον διάλογο θα απορριφθούν οι θέσεις των Στωικών, θα καταλήξουν στη θέση υπέρ της νοημοσύνης των ζώων και θα συζητηθούν για το ποια ζώα έχουν περισσότερη νοημοσύνη τα ζώα της στεριάς ή της θάλασσας. Στο τρίτο έργο του Περί του τα άλογα λόγω χρήσθαι , ο Πλούταρχος εμπνευσμένος από τη δέκατη Ραψωδία της Οδύσσειας και μέσω αυτής θα κριθούν οι επικρατέστερες αντιλήψεις εκείνης της εποχής, οι αντιλήψεις των Στωικών όπου αρνούνταν ότι τα ζώα έχουν μερίδιο στη λογική. Το τελευταίο έργο του Πλούταρχου Περί Σαρκοφαγίας Α’,Β’αναλύεται ένας λιτός και πιο υγιεινός βίος χωρίς την βρώση κρέατος καθώς επίσης αναλύειτις ηθικές διαστάσεις που προκύπτουν από την κατανάλωση κρέατος. Ο προσδοκώμενος στόχος της παρούσας πτυχιακής μου εργασίας είναι συνεπώς να αναδείξω τις θέσεις του Πλούταρχου σε σχέση με τα ζώα και να καταφέρουμε να τις δούμε υπό μια άλλη οπτική γωνία θέτοντας κάποια ερωτήματα και απόψεις σύγχρονων φιλοσόφων.In this thesis we will deal with texts of Plutarch which refer to animals which are: “Aquane an ignis sit utilior”, “Terrestriane an aquatila animalia sint callidiora”, “Bruta animalia ratione uti , sive Gryllus” and “De esu carnium orationes I, II”. Plutarch's first work, “Aquane an ignis sit utilio”, deals with various cosmological concepts of the time and what is ultimately more useful, fire or water. In Plutarch's second work, “Terrestriane an aquatila animalia sint callidiora”, positions on whether animals possess intelligence will be analyzed. In this debate the Stoic positions will be rejected, come to the pro-intelligence position of animals, and discuss which animals have more intelligence the land animals or the sea animals. In his third work “Bruta animalia ratione uti, sive Gryllus”, Plutarch inspired by and through the tenth Rhapsody of the Odyssey will judge the prevailing views of that time, the views of the Stoics where they denied that animals have a share in reason. Plutarch's last work De esu carnium orationes I, IIanalyses a leaner and healthier life without eating meat as well as analysing the moral dimensions of eating meat. The expected goal of my present thesis is therefore to highlight Plutarch's positions on animals and to be able to see them from a different perspective by raising questions and opinions of modern philosophers

Η ευρωπαϊκή διαταγή δέσμευσης τραπεζικού λογαριασμού

Αντικείμενο της παρούσας διπλωματικής είναι ο υπ’ αρ. 655/2014 Κανονισμός της ΕΕ περί της διαδικασίας ευρωπαϊκής διαταγής δέσμευσης λογαριασμού προς διευκόλυνση της διασυνοριακής είσπραξης οφειλών σε αστικές και εμπορικές υποθέσεις. Ο κανονισμός τέθηκε σε εφαρμογή στις 18 Ιανουαρίου 2017 και εισάγει ένα ευρωπαϊκό ασφαλιστικό μέτρο με τη μορφή της συντηρητικής κατάσχεσης λογαριασμού στα χέρια τράπεζας ως τρίτης. Με την ευρωπαϊκή διαταγή δέσμευσης λογαριασμού, μπορεί να γίνει δέσμευση των τραπεζικών λογαριασμών ενός οφειλέτη που τηρούνται σε τράπεζα διαφορετικού κράτους μέλους από την κατοικία του δανειστή. Για παράδειγμα, ο δανειστής Α, κάτοικος Ελλάδας, έχει απαίτηση κατά του Β, κατοίκου Ιταλίας, ο οποίος τηρεί τραπεζικό λογαριασμό σε ιταλική τράπεζα. Ο Α μπορεί πλέον με τον κανονισμό 655/2014 να δεσμεύσει τον τραπεζικό λογαριασμό του Β στην ιταλική τράπεζα εκδίδοντας την ευρωπαϊκή διαταγή δέσμευσης χωρίς ειδοποίηση του Β και χωρίς τήρηση διαδικασιών κήρυξης εκτελεστότητας. Η ελληνική νομοθεσία προσαρμόστηκε στον κανονισμό με το άρθρο 42 του Ν. 4509/22.12.2017 με το οποίο εισήχθη το άρθρο 738Α στο Πέμπτο Βιβλίο (Ασφαλιστικά Μέτρα) του Κώδικα Πολιτικής Δικονομίας.The subject of this thesis is EU Regulation 655/2014 on the European Account Preservation Order procedure to facilitate cross-border debt recovery in civil and commercial matters. The Regulation came into force on the18th January, 2017 and introduces a European safeguard measure in the form of a conservative account attachment in the hands of a bank as a third party. With a European Account Preservation Order, a debtor's bank accounts held in a bank in a member state other than the creditor's domicile can be frozen. For example, creditor A, resident in Greece, has a claim against B, resident in Italy, who holds a bank account in an Italian bank. Resident A can now, under Regulation 655/2014, freeze Resident B's bank account in the Italian bank by issuing the European freezing order without notice to B and without following any enforcement procedures. The Greek legislation was adapted to the Regulation by article 42 of Law 4509/22.12.2017, which introduced article 738A in Book 5 (Security Measures) of the Code of of Civil Procedure

Corps, art et société (l'identité féminine dans l'art contemporain russe avant et après la chute du mur de Berlin et ses répercussions dans les autres pays orthodoxes de l'Europe de l'Est)

Corps, art et société. Si la culture se définit par rapport à ces trois notions, la création féminine dans la Russie contemporaine s'inscrit dans une quête identitaire vacillant entre les repères traditionnels et l'ouverture vers l'Occident. Se situant dans un espace en mutation permanente, se heurtant à la difficulté de discerner les frontières de l'utopie et de l'entropie, les artistes de la période qui a précédé l'effondrement communiste et de celle de la reconstruction post-soviétique ont été amenés à bâtir un " territoire de mémoire " commun. Dans un tel contexte de bouleversement idéologique, l'émancipation des femmes est loin d'être acquise. La création féminine est donc avant tout, pour les Russes, une affaire de recherche intérieure, de déconstruction - partielle et totale - du statu quo et d'invention d'une nouvelle identité. La question de l'art est indissociable d'une géographie corporelle qui surgit de l'abolition des frontières et de l'ouverture culturelle. Le corps des femmes devient de la sorte l'élément fondamental d'une création où se mêlent l'espace, l'érotisme et la religion. Verksamhetsutveckling genom kunduppföljning vid Licab : Med koppling till samhällsbyggnad, infrastruktur och industri

Detta examensarbete var skriven av två studenter som en avslutande del av samhällsbyggnadsprogrammet vid Luleå tekniska universitet. Arbetet genomfördes i samråd och på teknikkonsultföretaget Licab, där verksamhet inom infrastruktur, industri och samhällsbyggnad bedrivs. Genom dialog med ledningen på Licab identifierades behovet av en kunduppföljningsmetod med syfte att förbättra företagets kundrelation och öka kundnöjdheten. Examensarbetet blev därmed att analysera och förstå utvecklingen av ett tillvägagångssätt lämplig för Licab, med målet att främja företagets tillväxt på lång sikt genom effektivare kundrelationer. Vid utförandet av examensarbetet inhämtade studenterna information från ledningen, kunderna och representanter, samt att de genomförde en litteraturstudie och en jämförelse mellan verktygen Google Forms och Brilliant. Med resurser från företagets medarbetare och en tydlig tidsplan på 10 veckor, fördelat på totalt 400 timmar sammanlagt för båda studenterna, planerades och genomfördes arbetet strukturerat för att möta de förväntade kraven. Studenterna riktade frågeställningarna på att välja lämpligt verktyg, identifiera relevanta frågor, bestämma antalet frågor, definiera mottagarna, utvärdera svaren och undersöka hur kunduppföljningsmetoden kunde bidra till att förbättra kundrelationerna. Genom att uppnå dessa mål och besvara frågeställningarna vill studenterna erbjuda både öppna förslag och konkreta rekommendationer

Use of water covers for the prevention of acid mine drainage generation

Summarization: The present paper is focused on the study of the use of water covers over reactive sulphidic tailings from Lavrion, in order to mitigate the environmental impacts associated with the production of acid mine drainage. The experimental tests were carried out in laboratory columns, where a layer of tailings was covered with a layer of water, sea water and acidic solution. The quality of the water cover as well as the quality of the pore water within the tailings mass was monitored, by measuring several critical parameters, over an eight month period.
