Sources of Member States' Power in the Council of the European Union
Power as a concept has been at the centre of attention of social sciences for
a long time. Yet our understanding of power remains elusive. The Council of
the European Union is a body where the main actors, Member States,
exercise power in order to influence the decisionmaking and its outcome.
Their basic aim is to defend the national interests. The primary objective of
this article is to offer an overview of the Member States' sources of power in
the Council, based on a review of the latest literature. We present both
structural and procedural sources of power. Then we explain that the
exercise of power depends also on concrete sectors and cases in which the
actors negotiate. Our text confirms that the results of various research
endeavours have often been contradictory and that continuing research is
needed in order to deepen the knowledge of Council decision-making

Dans la discussion scientifique de ces derniĂšres annĂ©es, beaucoup dâidĂ©es sur ce quâon appelle le « catharisme » ont Ă©tĂ© revisitĂ©es, sans que le raisonnement ait toujours Ă©tĂ© menĂ© Ă terme. Il nous semble logique de commencer lâanalyse critique de ce terme par une rĂ©vision des concepts sous-jacents qui le dĂ©finissent. Le dualisme en est un, que les « registres dâinquisition » permettent de scruter. On trouve dans cette source des propos dualistes qui ne sâinspirent pas de la prĂ©dication des bons hommes (ou « parfaits cathares ») et qui ne sont pas compatibles avec lâidĂ©e polĂ©mique et inquisitoriale de lâ« hĂ©rĂ©sie manichĂ©enne ». Il semble donc que le terme de dualisme, sans autres prĂ©cisions, est trop vague et insuffisant pour rendre compte du concept du catharisme.Many notions concerning « Catharism » have been revisited in the scholarly debate of recent years, although the reasoning in question has not always been brought to fruition. It seems logical to begin a critical analysis of this term by reviewing the underlying concepts that define it. Among these is dualism, which may be examined through « inquisitional registers ». These sources contain dualist statements that are not inspired by the preaching of the Good Men (or « Cathar Perfects ») and are not compatible with the polemical and inquisitorial idea of « Manichean heresy ». It seems therefore that dualism, too vague a term, is insufficient to render the concept of Catharism without further specifications

Evropeizace ÄeskĂœch zĂĄkonĆŻ 1998-2013: EmpirickĂ© Ășdaje o mĂĆe vlivu prĂĄva EU a dopadech na legislativnĂ proces
Europeanisation affects almost all aspects of social relations in the EU Member States and law is no exception. Yet we still know quite little about the overall extent of EU influence on Czech legal order, also because the research concentrates on more particular issues. This article presents results of a long-term empirical research that collected data on EU impulses on all bills submitted to the Chamber of Deputies between 1998 and 2013. After discussing methodology and data sources, the overall impact of EU law on Czech bills is determined through various innovative methods. Across them, it was found out that the influence is relatively stable after the accession, but varies profoundly between different thematic fields. The second part of the article explores the divergences between bills based on their level of Europeanization, namely in selected features of the legislative process and content of the proposal. A central hypothesis predicting lower involvement of Members of Parliaments in the case of Europeanized proposals is tested. The quantitative analysis offers inconclusive results, in some variables the differences are clearly visible (success rate of EU affected bills, length of plenary discussions), in others there is almost no variance (duration of the legislative process, voting results)

Mapping the legal scope for flexible implementation in EU directives
This paper analyses the extent to which EU directives allow for variation in the way that member states implement them. Such room for âflexible implementationâ may be used to overcome conflict during decision-making or to accommodate diversity in conditions within member states. The analysis is based on an original dataset of 164 directives adopted between 2006 and 2015, which are coded for the discretion they offer to member states. In addition to the overall level of discretion in directives, the paper also zooms in on five specific types of discretion. Based on these data, patterns of discretion across policy areas and different types of directives are explored.This project received funding from the European Unionâs Horizon 2020 research and innovation programme under grant agreement number 822304.
