    Fashion design in America has never been covered by the extensive intellectual property (IP) protections afforded to other categories of creative works or to the art in other countries. As a result, America has become a safe haven for design pirates. Piracy disproportionately harms young designers who do not have established trademarks for their brands and must rely purely on creativity to propel their designs into the market. H.R. 2511 is a bill that aims to extend copyright protection to fashion designs, albeit narrowly. Compared with previous proposals to extend effective IP protection to fashion design, H.R. 2511 is more of a sui generis protection aimed at the particularities of the fashion industry. It was the result of intensive negotiations between parties of conflicting interests, and has been tailored to address specific yet ubiquitous problems in the fashion industry

    This Essay seeks to expose the complexity of the relationship between the United Kingdom (and Ireland, but the main focus will be the UK) and the European Union that resulted from the concessions made to the UK when the treaties of Amsterdam and Lisbon were negotiated: a right not to participate in the adoption and application of EU legislative measures in the field of Justice and Home Affairs ( JHA ), and the right to decide on a case-by-case basis to opt into such measures, following procedures reminiscent of the sophisticated rules of cricket. These concessions were made to allow the UK to preserve in particular the right to maintain controls on persons at all its borders and to conduct its own immigration policies. Its discretion to opt in or opt out has been somewhat restricted when it concerns measures belonging to or developing the Schengen acquis. But that has not stopped the UK from displaying its interest in participating in some parts of the Schengen acquis, so far mainly covering aspects of cross-border cooperation in areas of law enforcement and criminal justice.This Essay presents the views of an optimist as to the possible prospects of a further UK participation-in the longer run-in other parts of the Schengen acquis, such as the EU\u27s external border policy, common visa policy or expulsion policy, or the rules on free movement rights for legally residing third-country nationals

    The Ground Test Measurement System (GTMS) for determining vacuum decay leak rate within the orifice tubing assembly of SEADS is described. The system can also monitor the absolute pressure in the tubing assembly under certain conditions. The GTMS determines leak rate by measuring vacuum-pressure decay which can be converted into leakage flow rate. Results of performance testing and operation of the GTMS are given

    Business models for sustained ehealth implementation: lessons from two continents

    There is general consensus that Computers and Information Technology have the potential to enhance health systems applications, and many good examples of such applications exist all over the world. Unfortunately, with respect to eHealth and telemedicine, there is much disillusionment and scepticism. This paper describes two models that were developed separately, but had the same purpose, namely to facilitate a holistic approach to the development and implementation of eHealth solutions. The roadmap of the Centre for eHealth Research (CeHRes roadmap) was developed in the Netherlands, and the Telemedicine Maturity Model (TMMM) was developed in South Africa. The purpose of this paper is to analyse the commonalities and differences of these approaches, and to explore how they can be used to complement each other. The first part of this paper comprises of a comparison of these models in terms of origin, research domain and design principles. Case comparisons are then presented to illustrate how these models complement one another

    The development of obesity, as well as resultant type 2 diabetes, hypertension and cardiovascular disease, is causing concern in South Africa. Following the discovery of leptin in 1994, hopes were raised that the manipulation of the leptin axis might yield successful therapy for obesity. Although hope still remains, the role of leptin is more complex than was first envisaged. Strong evidence indicates that there is an important role for leptin in obesityrelated hypertension, although the net effects of hyperleptinaemia on cardiovascular pathophysiology remain complex and are not clearly understood. Therefore, the cardiovascular side-effects of leptin as a possible antiobesity drug deserve greater attention

    The evolution of organic mantles on interstellar grains

    By laboratory simulation of the chemical processes on dust grains it was investigated how solid organic materials can be produced in the interstellar medium. The ice mantles that accrete on grains in molecular clouds, consisting primarily of H2O, CO, H2CO, NH3, and O2, are irradiated by the internal UV field, resulting in the storage of radicals upon photodissociation of the original molecules. Transient heating events lead to the production of oxygen-rich organic species by recombination reactions. The experiments indicated that in this way the observed amount of organic material can be produced if a grain passes a few times through a molecular cloud during its life. After the destruction of the cloud the grains enter a more diffuse medium. Here they are subjected to the interstellar UV field as well as to collisions with atomic hydrogen. Experiments show that the intense photoprocessing results in the removal of small species like H2O and NH3 as well as in carbonization of the organic molecules. Contrary to this, the atomic H flux will maintain a certain hydrogen level in the mantle. These processes likely convert the original, oxygen-rich organics into an unsaturated hydrocarbon type material such as that observed towards IRS 7 and in Comet Halley grains

    The organic component of interstellar grains

    The 3.4 micron absorption feature observed in the spectrum of a number of Galactic Center (GC) sources indicates the presence of organic molecules in the interstellar medium. It is ascribed to the C-H stretch vibration of tetrahedrally bonded carbon. From the observed features due to the interstellar organic material, an estimate was made of its composition and abundance. The ratio of the number of C-H groups of tetrahedrally to those of trigonally bonded carbon was 1.5, the cosmic abundance of carbon was .00037, and the depth of the silicate absorption toward the GC was taken equal to 3.6
