Certaines affaires sont trompeuses puisqu’elles mèneraient à croire que l’effet direct des ententes multilatérales peut être atteint en optimisant les mécanismes internationaux de résolution des conflits. Ceci n’est pas convaincant, en premier lieu, puisque dans le contexte des relations intergouvernementales, le contrôle de l’action des parties contractantes demeure élusif. Toute amélioration des procédures judiciaires, particulièrement en contexte multilatéral, est destinée à être marginalisée tant que l’on est confiné aux mécanismes intergouvernementaux de résolution des conflits. En second lieu, les implications de cela sur l’effet direct sont ténues. L’effet direct, ou le droit d'agir en justice des individus, n’est pas simplement une question légale abstraite ; il implique aussi des décisions de politique. Le désir d’application effective est mesuré avec d’autres objectifs tels que le maintien d’un certain niveau de démocratie et l’instrumentalisation des traités poursuivant des objectifs de politique interne et étrangère. L’examen de l’ancienne question de l’effet direct en combinant certains éléments de doctrine juridique et d’analyse de science politique offre un meilleur aperçu sur le critère de l’effet direct que la simple dépendance de la jurisprudence émergente.The criteria of direct effect of agreements concluded by the European Community have not yet been exhaustively dealt with in the case law of the European Court of Justice. Some of the cases are misleading because they would have us believe that direct effect of multilateral agreements can be achieved by optimizing international dispute settlement procedures. This is not convincing, first of all because in intergovernmental relations control over the performance of other contracting parties is illusive. Any improvement of judicial procedures, particularly in a multilateral context, is destined to be marginal as long as one is confined to mechanisms of mere intergovernmental dispute settlement. Secondly, the implications of this for direct effect are tenuous. Direct effect, or ‘standing’ by individuals, is not simply an abstract legal question but also entails policy decisions. The desirability of effective enforcement is weighed against other objectives such as the maintenance of a certain level of democracy, and the instrumentalization of treaties in the pursuit of foreign and internal policy objectives. A treatment of the age-old question of direct effect which combines elements of legal doctrine and political science analysis yields a better insight into the criteria for direct effect than simple reliance on the evolving case law

Propos introductif: L’action extérieure post-Lisbonne de l’UE : quel modèle pour quelle ambition ?

Pour nombre de raisons, souvent liées à la nature sui generis de la construction européenne elle même, l'observateur extérieur qui tente de discerner l'action  extérieure de l'UE ne peut être indifférent à cette dialectique qui la constamment caractérise. En effet, cinquante ans depuis sa création, il est frappant que de constater à quel point l'action extérieure de l'UE a été construite aux confins d'une dynamique aussi complexe qu'incertaine. D'une part, portée par son élan intégrateur, l'action extérieure de l'UE doit composer à la fois avec la résistance des États  membres à renoncer à leurs compétences dans un domaine régalien par excellence que constitue la politique étrangère, et avec le besoin pressant pour l'UE de s'affirmer sur la scène internationale en tant qu'acteur global. D'autre part, guidée par l'impératif de la cohésion/cohérence, l'action extérieure de l'UE doit renouer avec l'efficacité afin de donner sens à sa raison d'être et, par là même, à rendre la voix de l'UE identifiable et audible

Employment Impacts of EU Biofuels Policy: Combining Bottom-up Technology Information and Sectoral Market Simulations in an Input-output Framework

This paper analyses the employment consequences of policies aimed to support biofuels in the European Union. The promotion of biofuel use has been advocated as a means to promote the sustainable use of natural resources and to reduce greenhouse gas emissions originating from transport activities on the one hand, and to reduce dependence on imported oil and thereby increase security of the European energy supply on the other hand. The employment impacts of increasing biofuels shares are calculated by taking into account a set of elements comprising the demand for capital goods required to produce biofuels, the additional demand for agricultural feedstock, higher fuel prices or reduced household budget in the case of price subsidisation, price effects ensuing from a hypothetical world oil price reduction linked to substitution in the EU market, and price impacts on agro-food commodities. The calculations refer to scenarios for the year 2020 targets as set out by the recent Renewable Energy Roadmap. Employment effects are assessed in an input-output framework taking into account bottom-up technology information to specify biofuels activities and linked to partial equilibrium models for the agricultural and energy sectors. The simulations suggest that biofuels targets on the order of 10-15% could be achieved without adverse net employment effects. -- In diesem Papier werden die Beschäftigungswirkungen der Förderung von Biokraftstoffen in der Europäischen Union untersucht. Die Förderung von Biokraftstoffen wird mit der nachhaltigen Nutzung natürlicher Ressourcen, der Reduktion von Treibhausgasemissionen im Transportsektor und der Verminderung der Erdölabhängigkeit und damit einhergehender erhöhter Energiesicherheit in Europa begründet. Bei der Quantifizierung der Beschäftigungseffekte der Biokraftstoffförderung in Europa wurden verschiedene Effekte berücksichtigt: gesteigerte Nachfrage nach Agrarerzeugnissen und Kapitalgütern zu Herstellung von Biokraftstoffen, höhere Kraftstoffpreise, Preisrückgänge auf dem Rohölmarkt infolge der Substitutionseffekte des Biokraftstoffeinsatzes und Preissteigerungen bei Agrarprodukten und Lebensmitteln. Dazu wird ein Input-Output Modell um die Biokraftstofferzeugung erweitert und mit Partialmodellen des Agrar- und Energiesektors gekoppelt. Als besonders wichtige Faktoren für potentielle Beschäftigungseffekte haben sich die Entwicklung einer auf den Weltmärkten führenden EU Biokraftstoffindustrie und der abschwächende Effekte der Biokraftstoffe auf den Ölpreis erwiesen. Photophysical and photochemical applications of femtosecond time-resolved transient absorption spectroscopy

The aim of this paper is to provide the main pieces of information concerning the application of transient absorption (TA) spectroscopy with sub-picosecond laser pulses. A description of the experimental apparatus and of some detection schemes are included together with the most common mathematical formulas utilized to analyze the signals. The results, recently obtained in our laboratory and presented here, concern the investigation of the excited state dynamics of simple molecular systems. Examples of the measurements of the relaxation processes occurring in the lowest excited states of some aromatic molecules will be discussed in order to show the potentiality of the technique
