The Problems of the Leased Line

    Get PDF
The part played by the leased line in railroad reorganizations prior to those of the present day seems to have be rather inconspicuous. In those earlier reorganizations, railroads, on the whole, were still in an era of expansion. While serious lease problems occasionally arose, they were generally capable of being solved without too much difficulty and without undue hardship to cither lessor or lessee. Today, however, the picture has been altered. Changes in transportation which have affected all railroads adversely have accentuated leased line problems. There are more problems than formerly and, in addition, they seem to be more serious. At the same time care must be taken not to overemphasize the difficulties, of leased lines. A majority of those whose lessees are undergoing reorganization have given rise to but few issues. Some, however, because of unusual circumstances in their particular instances, involve perplexing problems. It is this somewhat pathological type of case with which we are principally concerned in this brief survey of leased line problems

The Legislative Requirement That Zoning and Land Use Controls Be Consistent with an Independently Adopted Local Comprehensive Plan: A Model Statute

This Essay critically reviews the history of the “in accordance with a comprehensive plan” language in the Standard State Zoning Enabling Act and its companion, the Standard City Planning Enabling Act, drafted by an advisory committee of the U.S. Department of Commerce in the 1920s. It then discusses contemporary consistency requirements in state planning and land use enabling statutes. Finally, it presents a model statute intended to clarify the relationship between the local comprehensive plan and various types of land use decisions and actions

    Railroad Leases and Reorganization: II

    Get PDF
One of the most important questions raised in a study of the role of the railroad lease in reorganization is the manner in which the lessee\u27s trustees, in view of their rejection of the lease, will account for operation of the leased line. As pointed out in Part I of this article, the leased line will be actually operated by the lessee\u27s trustees both before and after rejection of the lease. Such operation means that expenses will be incurred in running trains, in maintenance, in making necessary capital improvements and in many other ways. Certain revenues will also result from this operation. Accounting for operation can be defined as ascertaining in dollars and cents whether the operation as a whole is at a profit or loss. The existence of either a profit or a loss has a twofold consequence for the lessor. It will play a part in determining the final treatment of the lessor in the lessee\u27s plan of reorganization. Moreover, and of importance here, it may have significant consequences during the reorganization proceeding itself

Effect Of Vaginal Versus Caesarean Delivery On Infant Development, Mothers\u27 Perceptions And Mother And Infant Interaction

    Get PDF
A rapidly rising rate of Caesarean childbirth in the United States has led to concern for the effects of this mode of delivery on mother and child. The purpose of this investigation was to assess the effect of mode of delivery on infant development, mother\u27s perceptions of their infants and mother-interaction. Seventy-eight Caesearian mothers and their healthy newborn babies were assessed two and thirty days postpartum. The sample consisted of 40 first and laterborn vaginally delivered infants, 20 firstborn, unplanned Caesearean delivered infants and 18 laterborn, elective Caesarean delivered infants. Measures included the neonatal Behavioral Assessment Scale, the Neonatal Perception Inventory, the State-Trait Anxiety Inventory, and an observation of the dyad, the MMPI Depression Scale, and the Kent Infant Development Scale. No differences were observed among groups of infants in level of infant development, pattern of mother and infant interaction, mothers\u27 perceptions of their infants or in mothers\u27 level of anxiety and depression during the postpartum period. A main effect of birth order was found for maternal anxiety at two days and infant development at 30 days. Firstborn mothers reported a higher level of anxiety following childbirth and rated their infants as more advanced at 30 days than mothers of laterborn infants. The absence of differences among mothers and vaginally and Caesarean delivered infants during the first postpartum month is consistent with previous research on Caesarean childbirth and highlights the importance of studying, not just mode of delivery, but factors such as social support and mother\u27s emotional well-being

The lived experience of counseling students in natural disaster

    Get PDF
After natural disaster, survivors may experience moderate to severe signs and symptoms of emotional distress which may subside or worsen as time passes (Substance Abuse and Mental Health Services Administration, 2022). Adults pursuing higher education when natural disaster strikes experience an additional array of unique issues which may exacerbate symptoms of emotional distress (Wilkinson et al.,2013). To create and improve curricular and co-curricular structures that meet the needs of their students, educators in many health and mental health disciplines can draw from a variety of quantitative and qualitative studies, particularly those focused on how their disciplines’ students navigate the experience of natural disaster while enrolled in a program of study (Henneman et al., 2020; Matthieu et al., 2007; Myhre et al., 2017; Szczygiel & Emery-Fertitta, 2021). However, there is little to no extant literature on counseling students’ experiences of surviving natural disaster while enrolled in graduate study. Using a qualitative, phenomenological approach this study sought to fill this identified gap in the literature to inform future inquiry and application. Six themes emerged from data analysis that described participants’ lived experience of natural disaster and perceptions of support offered by their program. The findings are discussed in the context of the research questions that framed the study. Implications for counseling and counselor education programs are presented along with limitations and recommendations for future research
