The challenges with civil discovery are often overwhelming. At times, counsel may feel powerless to avoid discovery quagmires and the resulting costs and delays. Nevertheless, counsel can guide a matter through these complexities if they learn how to better manage the discovery process. In Navigating the Discovery Chess Match through Effective Case Management, I expound on three methods that can facilitate case management in discovery. The first emphasizes the benefits of proportionality in resolving preservation disputes over electronic data. The next involves providing early and more fulsome initial disclosures to enhance the FRCP 26(f) discovery conference. The final method focuses on the advantages of cooperation and transparency over unilateral conduct in the use of search methodologies. These methods should enable counsel to more efficiently manage the discovery chess match and guide a matter more effectively toward its ultimate resolution

"Digital Cultural Mapping: Transformative Scholarship in the Geospatial Humanities" is a proposal for a three-week summer institute at UCLA for an interdisciplinary group of 12 humanities scholars and advanced graduate students to learn how to develop innovative publications and courses that harness the theoretical and practical approaches of the "geospatial humanities." Situated at the intersection of critical cartography and information visualization, the Institute will combine a survey of the state of the art in interoperable geospatial tools and publication models, with hands-on, studio-based training in how to integrate GIS data into humanities scholarship, develop robust spatial visualizations, and deploy a suite of mapping tools in the service of creating publication- ready research articles and short monographs. The Institute will culminate in an "impact and evaluation" seminar of these publications with representatives from major university presses and journals

Inviting Scrutiny: How Technologies Are Eroding the Attorney-Client Privilege

The attorney-client privilege is sacrosanct, but its protections are eroding. Always narrowly construed, its zone of protection is becoming even smaller, particularly for in-house counsel. This is due to organizations’ inability to address the impact that technological innovations have had on the privilege. In many instances, new and disruptive technologies are assaulting the privilege as a result of unsuspecting corporate practices. This Article details how technology advancements coupled with heightened judicial scrutiny have chipped away at the protections the privilege affords to internal counsel. The historical basis for increased court scrutiny of in-house counsel’s privilege claims is detailed. With respect to technology, e-mail is spotlighted as a principal causation element in this process.1 In addition, the Article explores how social networking sites, cloud computing, and corporate “bring your own device” policies all have the potential to undermine the privilege assertions of in-house counsel. Finally, some best practices are discussed which, if followed, can help prevent further erosions to such claims
